ORDINANCE NO. 1905 AN ORDINANCE AMENDING CHAPTER 82 "TRAFFIC AND MOTOR VEHICLES," ARTICLE III "OPERATION OF VEHICLE," SECTION 82-63 "SAME - SCHOOL ZONES," TO AMEND STREET NAME TO WEST PIPELINE ROAD; PROVIDING A PENALTY FOR VIOLATIONS HEREOF; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Euless has adopted school zone speed regulations to provide for traffic safety adjacent to school locations; and WHEREAS, the City desires to amend the street name within a designated school zone for Central Junior High School. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: Section I. That Chapter 82 "Traffic and Motor Vehicles," Article Ill "Operation of Vehicle," Section 82-63 "Same - School zones," be hereby amended by amending subsection (b)(1) to revise street names within the Central Junior High School zone to read as follows: Sec. 82-63. Same—School Zones (b) School zones enumerated. (1) Central Junior High School zone: a. On West Pipeline Road between signs posted at or near the property lines of 2025 West Pipeline Road (Bell Manor Addition, block 5, lot 19A1, southwest corner) for westbound traffic and 3201 West Pipeline Road (McCoy Survey, abstract 10-73, lot 2C, northwest corner) for eastbound traffic. b. On Raider Drive between signs posted at or near the property line of 3011 Needles (Bell Hi Addition, block 3, lot 12, southwest corner) and West Pipeline Road for northbound traffic. c. On Raider Drive from West Pipeline Road (continuation of zone established in subsection (b)(1)a. of this section) and end of zone sign for southbound traffic. Section II. Penalty for Violation. Any person, firm or corporation violating any of the terms and provisions of this ordinance shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be fined in accordance with Chapter 1, Section 1-12, Euless Code of Ordinances. Each such violation shall be deemed a separate offense and shall be punishable as such hereunder. Section III. Severability Clause. That it is hereby declared to be the intention of the City Council that the section, paragraphs, sentences, clauses, and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or sentence. Section IV. Saving Clause. That Chapter 82 of the Code of Ordinances, City of Euless, Texas, as amended, shall be in full force and effect, except as expressly amended hereby. Section V. Effective Date. This ordinance shall be in full force and effect from and after its passage and publication as provided by the Euless City Charter and the laws of the State of Texas PRESENTED AND GIVEN FIRST AND FINAL READING AND APPROVED at a regular meeting of the Euless City Council on the 22nd day of March 2011, by a vote of 7 ayes, 0 nays, and 0 abstentions.
