PLANNING AND ZONING COMMISSION April 18, 2000 MINUTES The Pre-Commission meeting of the Planning and Zoning Commission was called to order by Chairman McMillon at 5:30 p.m. in the Building "C' Conference Room. Seven members of the Planning and Zoning Commission were in attendance. PLANNING AND ZONING COMMISSION CONSIDERATION OF SCHEDULED ITEMS -COUNCIL CHAMBERS Chairman Robert McMillon called the Planning and Zoning Commission meeting to order at 7:00 p.m. for the consideration of scheduled items. He stated there were seven members of the Planning and Zoning Commission present. Planning and Zoning Commission Minutes Page 2 April 18,2000 PLEDGE OF ALLEGIANCE AND INVOCATION: Commissioner McNeese led the Pledge of Allegiance and Commissioner Sloan gave the Invocation. APPROVAL OF MINUTES Chairman McMillon asked if there were any corrections or additions to the proposed minutes of the last meeting. Commissioner Richard McNeese made the motion to approve the minutes as presented. Commissioner Bill Tarin seconded the motion. The vote was as follows: Ayes: Chairman McMillon, Commissioners McNeese, Tarin, Grove, Hughes, Deithloff, Sloan Nays: None The motion carried. REGULAR AGENDA ITEM 1 CASE #99-03-PP — PUBLIC HEARING REGARDING A PRELIMINARY PLAT Receive public input regarding a request for a Preliminary Plat changing Lakewood Addition, Lot Al, to Lakewood Addition, Block 4, Lot A (open space), Block 4, Lots 1-33 and Block 5, Lots 1-15. This property is located at the Northeast corner of Ash Lane and Lakeshore Drive. Bo Bass, Director of Planning and Development, briefly described the case. He also stated that the City Engineer had issued a letter indicating that all acceptable public improvement plans have been received. He stated that staff recommends approval. Chairman McMillon called for a case representative to come forward. Mr. Tim Spires with Tipton Engineering, 6330 Broadway Boulevard, Suite C, Garland, Texas, stated he would answer any questions the Commissioner might have. Chairman McMillon opened the public hearing and called for proponents or opponents to come forward. There being none he closed the public hearing. ITEM 2 CASE #99-03-PP — CONSIDERATION OF A PRELIMINARY PLAT Consider a request for a Preliminary Plat changing Lakewood Addition, Lot Al, to Lakewood Addition, Block 4, Lot A (open space), Block 4, Lots 1-33 and Block 5, Lots 1-15. This property is located at the Northeast corner of Ash Lane and Lakeshore Drive. ITEM 3 CASE #00-01-PP — CONSIDERATION OF A PRELIMINARY PLAT Consider a request for a Preliminary Plat changing Jasper Survey, Ab. 861, Tr. 5F1 to Jasper Addition, Lot 6. This property is located on S.H. 183 just east of Dock McGinnis Drive. Bo Bass, Director of Planning and Development, briefly described the case, and stated that staff recommends approval. Chairman McMillon called for a case representative to come forward. Mr. Jim Dewey, JDJR Engineer Consultants, Inc., 2505 Texas Drive, Suite 109, Irving, Texas, stated he would answer any questions from the Commissioners. Commissioner McNeese moved to approve Case #00-01-PP and was seconded by Commissioner Hughes. The vote was as follows: Ayes: Chairman McMillon, Commissioner Hughes, Grove, Tarin, Deithloff, Sloan, McNeese Nays: None The motion carried. ITEM 4 CASE #00-02-PD — PUBLIC HEARING REGARDING A PLANNED DEVELOPMENT Receive public input regarding a request for a Planned Development changing the zoning of Levi Franklin Survey, Abstract 513, Tract 3. This request is for changing the zoning from TX-121 (The 121 Gateway District) and R-1 (Single Family Detached Dwelling District) zoning to PD (Planned Development based on TX-121 Development Standards) zoning. This property is located north of Mid-Cities Boulevard and east of S.H 121. Chairman McMillon stated that item #00-02-PD had been scheduled to be heard at the April 4, 2000, meeting but had been tabled to the April 18, 2000, meeting. He also stated that in order to hear Case #00-02-PD a motion had to be made to Planning and Zoning Commission Minutes Page 4 April 18,2000 remove this case from the table. Commissioner Grove moved to bring Case#00- i 02-PD off the table for consideration. The motion was seconded by Commissioner Tarin. The vote was as follows: Ayes: Chairman McMillon, Commissioner Hughes, Grove, Tarin, Deithloff, Sloan, McNeese Nays: None The motion carried. Bo Bass, Director of Planning and Development, briefly described the case and discussed existing and proposed land uses. He stated that this development brings town homes, a classic transitional land use. He also stated that the primary access to the single family is off Mid-Cities Boulevard and that the town home access is principally off Mid-Cities Boulevard. He stated that this project will build part of the proposed Gateway Boulevard. He stated that staff believes a secondary access off Allen is necessary just for flow in this community. Mr. Bass also stated that traffic flow on Allen Drive would be limited to the people living in the single family area or people invited into the that area. Mr. Bass stated the developer proposes an eight feet masonry wall on the east and north elevations to further buffer existing single family from the new project, and that ring of lots adjacent to the existing single family will also be larger in scale. Mr. Bass stated that staff recommends approval. Chairman McMillon called for a case representative to come forward. Mr. John Dickerson, President of Dickerson Development, Inc., 8333 Douglas Avenue, Suite 1300, Dallas, Texas, described roadway and creek issues as obstacles overcome to develop the property. Mr. Dickerson stated Allen Drive is on the Thoroughfare Plan to come through this property. Mr. Dickerson stated to decrease the traffic flow on Allen Drive is to create a gated community. He also stated that by gating it the streets would be designated private and maintained by a Homeowners' Association. The Homeowners' Association would maintain all the common areas in the single family portion of the community and also maintain the front yards. Mr. Dickerson stated that a master Homeowners' Association comprised of the town homes and single family associations to provide for the maintenance and upkeep of the three lakes, of the hike and bike trails, and the green belt. He also stated that by request from the homeowners all construction traffic would be prohibited on Allen Drive and the gates will be closed on Allen Drive and construction traffic will be directed to the south entrance. Chairman McMillon opened the Public Hearing. Chairman McMillon called for anyone in the audience who would like to discuss this case. C Planning and Zoning Commission Minutes Page 5 April 18,2000 Mr. John Baze, 505 Westover, property owner, stated that he had talked to many contractors and developers about this property, but none came up with a plan like Mr. Dickerson. Mr. Baze stated that this will benefit the citizens and the City of Euless. Mr. John Hiser, 2611 Tallow Dr., stated his concerns are about the town home density, the square footage of the single family lots and the traffic on Allen Drive. Mr. Hiser proposed an entrance through Gateway, leaving Allen Drive and Priest Drive alone. Ms. Toni Epps, 520 Allen Drive, stated her concerns about Allen Drive opening up into her neighborhood and the average lot size in that area being 10,000 square feet. She also stated concerns about impact on the school district which is almost at capacity, that she is against town homes / multi-family dwellings, and that the single family lots should be larger. Sue Caldwell, 513 Allen Drive, stated her concerns about traffic on Allen Drive and recommended a different exit. She also stated she would like consideration of stop signs at Baze and Allen Drive to control traffic going through. Ms. Caldwell asked what the chances were of Allen Drive being widened. Several other citizens voiced concerns about the average size of lots (stating that they should be 10,000 square feet in keeping with the existing neighborhood), traffic on Baze and Allen Drive, and schools becoming over crowded. Chairman McMillon called for Mr. Dickerson to come up and address questions on the town homes. Mr. Dickerson stated that the average price of a garden home is $200,000 and the typical household includes one or two kids. He also stated they do not anticipate a great influx into the school district. Mr. Dickerson stated his office had spoken with Joe Bailey, the Deputy Superintendent of the Grapevine Independent School District, who says there is no concern about over crowding of Bear Creek Elementary. He also stated in reference to questions about 10,000 square feet lot sizes, these lot sizes are not to pad our pockets nor to pad Mr. Baze's pockets. Mr. Dickerson stated these lots have constraints, including the building of Gateway Boulevard, drainage, culverts, dams and crossings. He stated that without these constraints they could build 10,000 square feet lots. Mr. Dickerson also stated their goal is to create minimal impact on the surrounding properties. Chairman McMillon closed the public hearing and opened up discussion among Commissioners. C Planning and Zoning Commission Minutes Page 6 April 18,2000 ITEM 5 CASE #00-02-PD — RECOMMENDATION REGARDING A PLANNED DEVELOPMENT Consider a recommendation regarding a request for a Planned Development changing the zoning of Levi Franklin Survey, Abstract 513, Tract 3. This request is for changing the zoning from TX-121 (The 121 Gateway District) and R-1 (Single Family Detached Dwelling District) zoning to PD (Planned Development based on TX-121 Development Standards) zoning. This property is located north of Mid-Cities Boulevard and east of S.H 121. Commissioner Hughes asked about the commitment to build an 8' fence on the north and east sides, and whether this will be equally attractive on both sides of the property. Mr. Dickerson stated it will look the same on both sides, a masonry product fence that is 8' tall. Commissioner Hughes asked if all the fences will be put in at one time and if would construction be blocked from the homeowners. Mr. Dickerson answered yes, at the first turning of dirt to the building of the lakes the construction of the fence would begin. Bo Bass, Director of Planning and Development, stated that in his professional opinion the numbers will not work with 10,000 square foot lots, and that the other option within the 121 zoning would be commercial uses. He stated that staff does not want to see Priest connect to Gateway, but that fire and police need a second access. He said steps have been taken to reduce flow by gating the street. Commissioner Grove stated that the fear everyone has about town homes is their going to turn into $1,800 per month apartments and asked what can be done to prevent rental of these units. Mr. Dickerson stated that Texas Law prevents them from restricting anyone who owns property from renting said property, but that restriction could be placed on a person owning more than two units in the neighborhood via a deed restriction. Commissioner Grove asked about having a crash gate [emergency only entrance] at Allen Drive. Mr. Dickerson answered that would have a severe impact on the value of new single family homes. Commissioner McNeese asked for clarification of the fence's location. Mr. Dickerson stated he would install an eight feet fence to end of the last existing house on the east and north sides. Commissioner McNeese asked if the lakes and trails would not be connected to the public in any way. Mr. Dickerson said that was correct. Commissioner McNeese asked why the decision was made not to light the trails. Mr. Dickerson Planning and Zoning Commission Minutes Page 7 April 18,2000 stated that lighting the trail would invite usage after dark and if a light were burned out it would therefore invite a dangerous situation or crime. Commissioner Tarin stated he would like to know the time frame of the project. Mr. Dickerson stated they would like to break ground in August, starting on the lakes and fence at the same time. He stated it would take nine to twelve months to develop out the single family portion roads and infrastructure and the like amount of time for the townhouses. He estimated a three years completion from the beginning for the single family side. Commissioner Deithloff stated the overall use is good but he felt the best density would be R-1 zoning. Commissioner McNeese asked if there were plans to widen Allen Drive and how would this affect the school district. Mr. Bass stated there were no plans to widen Allen Drive and this property has been zoned single family for decades and the school district had known about the zoning for a long time. Commissioner McNeese asked if other residential options existed for development instead of townhouses. Mr. Dickerson stated they had considered it but it didn't make economic sense and that the lakes create natural buffering. He stated the townhouse lots enable them to pay for the infrastructure. Chairman McMillon summarized the points made. Commissioner Groves asked for clarification of minimum air conditioned space building on R-1 being 2,200 square feet, R-1 L being 1,600 square feet, and TH being 1,100 square feet living area. Mr. Dickerson said yes. Commissioner Hughes moved to recommend approval of Case #00-02-PD, with the following stipulations: 1.) that minimum air conditioned living area square footage of R-1 be 2,200, R-1 L be 1,600 square feet, and TH be 1,100 square feet; 2.) that fences on north and east property lines be constructed at start of construction; 3.) that fences be eight feet along north and east property lines of the entire property; 4.) that the construction of sidewalks be placed as follows: a. by the developer on streets with no facing lots; b. within town home portion at the time the driveway aprons are poured; c. within the single family portion by the builder on each lot; 5.) that deed restrictions include prohibition of ownership of more than two town homes. Commissioner Tarin seconded the motion. Commissioner Deithloff asked that the minutes reflect that his decision was based on [the idea that] the use is highest and best for the property but the TH (Townhouse Dwelling District) zoning is too dense, and this should be the R-1 (Single Family Detached Dwelling District) nature. Commissioner Grove requested that notification be sent to the neighbors for the City Council meeting. ITEM 6 CASE #00-07-SUP — PUBLIC HEARING REGARDING A SPECIFIC USE PERMIT Receive public input regarding a request for a Specific Use Permit on Levi Franklin Survey, A-513, Tract 3, for a private street gated community in TX-121 (The 121 Gateway District) and R-1 (Single Family Detached Dwelling District) zoning. This property is located north of Mid-Cities Boulevard and east of S.H.121. Commissioner Grove moved to bring off the table Case # 00-07-SUP. Commissioner McNeese seconded the motion. The vote was as follows: Ayes: Chairman McMillon, Commissioners Groves, Sloan, Tarin, Hughes, McNeese, Deithloff Nays: None The motion carried. Chairman McMillon opened the Public Hearing. There being no speakers, Chairman McMillon closed the Public Hearing. ITEM 7 CASE #00-07-SUP — RECOMMENDATION REGARDING A SPECIFIC USE PERMIT Consider a recommendation regarding a request for a Specific Use Permit on Levi Franklin Survey, A-513, Tract 3, for a private street gated community in TX-121 (The 121 Gateway District) and R-1 (Single Family Detached Dwelling District) zoning. This property is located north of Mid-Cities Boulevard and east of S.H.121. Commissioner McNeese moved to recommend approval with the stipulations being: Planning and Zoning Commission Minutes Page 9 April 18,2000 1.) that an eight feet fence be constructed along the entire length of northern and eastern property lines (not inclusive of waterways); 2.) that construction of the fence coincide with the beginning of construction of the lakes. Commissioner Hughes seconded the motion. The vote was as follows: Ayes: Chairman McMillon, Commissioners Groves, Sloan, Tarin, Hughes, McNeese, Deithloff Nays: None The motion carried. ITEM 8 CASE #00-09-SUP — PUBLIC HEARING REGARDING A SPECIFIC USE PERMIT Receive public input regarding a request for a Specific Use Permit on Edward Taylor Survey, Ab. 1550, Tr. 1A3, for a Private Street Gated Community in TH (Townhouse Dwelling District) zoning. This property is located to the north and west of the intersection of Fuller-Wiser and S. H. 360. Bo Bass, Director of Planning and Development, briefly described the case. He stated that about three years ago the City rezoned this tract of land from C-2 (Community Business District) zoning to TH (Townhouse Dwelling District) zoning. Mr. Bass stated this was an excellent transitional land use between the multi-family dwelling units to be built, the existence of Hwy 360, and D/FW Airport. He stated in terms of transition, it is a good land use, to mitigate the negative impacts. He stated the developer had met with the property owners. Mr. Bass stated there were three conditions that staff would like to recommend for approval: 1.) that mitigation of the loss of trees on this property be in the form of replacement trees, with a minimum of 30 trees planted, a ratio of one per thirty linear feet for the entire south elevation and the west elevation of this property; 2.) that a minimum six feet masonry wall be constructed on the entire east, south and west elevations; 3.) that an eight feet portion [of the masonry fence] be constructed for the following lots on the south side: lots 22, 21, 20, and 19, to prevent any conflict with traffic lights coming in off the access road; and also an eight feet portion of the fence along the west side, lots 20, 19, 18. Mr. Bass stated DRC recommended approval based on these conditions. Chairman McMillon opened the Public Hearing. C Planning and Zoning Commission Minutes Page 10 April 18,2000 Mr. Bryan Klein, Hoover/Klein Group, 1361 West Euless Boulevard Suite #99, stated that there are no exceptions to the City codes. He stated the Specific Use Permit (SUP) is required for two reasons: 1.) Private streets; 2.) Gated community, and this development meets all the requirements per City code for these two. Mr. Keith Wood, 404 Lexington Lane, stated this is a far step in the right direction. He stated he had one question, why not eight feet fence on the west and south area. He requested that the fence be required at the start of construction. He asked that the trees be four inch caliper, and that deed restrictions be placed so that no one can own more than one unit. Mr. Tom Thornton, 2908 Whetstone Drive, requested the Commission recommend 1.) An eight feet fence all around property for uniformity and aesthetics; 2.) the requirement that two stories not have windows facing the back of the property. He stated he would like to see transitional homes keep the same standards as the non-transitional homes have. Mr. Michael McGee, 507 Rosemary Lane, expressed concerns about the drainage off this property. Mr. McGee stated he had talked with Mr. Ron Young on site about the concrete channel to be replaced with underground pipe. He stated that the trees may not survive, and that he hoped this would be addressed. Mr. McGee also agreed with the neighbors that an eight feet fence would be nice around the entire property. He expressed concerns about street lighting, which would affect his bedrooms. He asked that the fence be required to be constructed first. He expressed concerns about the access exiting off of S.H. 360 going to Fuller-Wiser Road and stated it could be a potential conflict. Mr. Doug Thedford, 505 Rosemary Lane, expressed the same concerns as Mr. McGee, and asked why four parking spaces had been added and what the time frame was for the project. He thanked Ron Young for coming out to the site. Two other citizens expressed the same concerns. Mr. Wood asked if the pipe could be put north of the concrete trench , and then the channel just filled, so no digging would be required, stating that maybe this would save the trees. Chairman McMillon closed the Public Hearing. C Planning and Zoning Commission Minutes Page 11 April 18,2000 ITEM 9 CASE #00-09-SUP — RECOMMENDATION REGARDING A SPECIFIC USE PERMIT Consider a recommendation regarding a request for a Specific Use Permit on Edward Taylor Survey, Ab. 1550, Tr. 1A3, for a Private Street Gated Community in TH (Townhouse Dwelling District) zoning. This property is located to the north and west of the intersection of Fuller-Wiser and S. H. 360. Chairman McMillon asked Mr. Klein to come back to the podium for questions from the Commission. Chairman McMillon asked how the developer would feel about building an eight feet fence around the perimeter of the site. Mr. Klein stated the developer was not in a negotiating position because the town home use is a permitted use. He stated the issue is a SUP for a gate and private streets and the conditions should be related only to this. Mr. Bass stated that to mitigate impact of new development the City could request additional items that can be negotiated through the SUP process. Mr. Tom Hoover, Hoover/Klein Group, stated that they had looked at the drainage issues. He stated that preliminary calculations showed there would be no ponding of water. He stated it would receive water onto the project; drainage will be improved and will convey the design storm that the City has directed them. Commissioner Hughes asked if the developer would consider an eight feet masonry fence on western and southern property line, which would solve the light pollution. Mr. Klein added that Texas Department of Transportation has approved the access permit. Commissioner Hughes asked if they would consider the fence being constructed at start of construction. He asked if they would be willing to restore the quality of the property, in addition to the required trees, such as one for each 30 feet of southern and western linear footage. Commissioner Sloan asked if there would be any tall lights. Mr. Klein replied no. Mr. Bass asked Mr. Hoover to show sidewalks. Mr. Hoover said there will be exterior sidewalks to the property on access road and no interior sidewalks. Chairman McMillon asked Mr. Bass to address the size of trees when planted. Mr. Bass stated the maximum required is 2 '/' diameter, and that for survivability he recommends 2 Y" x 3". Commissioner McNeese stated he would like to see an eight feet fence along the west and south sides, and a six feet fence on the other sides. Planning and Zoning Commission Minutes Page 12 April 18,2000 Mr. Bass asked Mr. Klein to explain the lighting issues. Mr. Klein stated there would be no pole lighting on this property. Chairman McMillon stated this is an increase in density and that was why several feel we can ask for eight feet fence. Mr. Martin van Wolfswinkel, 2131 N. Collins Street, Arlington, Texas, stated concerning the fence at the start of construction, that they would first build the wall along S.H. 360 and would like to ask that it be a six feet masonry wall with wings. He stated that he has no problem with masonry on west side, but would like to study the issue of a masonry wall along the south side. He stated that he concurred that there needs to be mitigation of trees 2 %" to 3" along the south side and along the west side up to the fire lane—one for every thirty feet. Commissioner Grove suggested instead of locking himself into one every thirty feet, that he figure the number of trees (30 trees) and give himself the latitude to group the trees for the most effective mitigation. Chairman McMillon summarized points, that the developer will supply 30 trees including comments from neighbors regarding placement, a 6' masonry fence along S.H. 360, and 8' masonry along the west side. Commissioner McNeese clarified that the thirty trees are in addition to regular requirements. Mr. Van Wolkswinkel stated he agreed. Commissioner Hughes stated a concern about light screening along south side near entrance. Mr. Van Wolfswinkel stated he would extend the masonry wall along the entrance to lot 21. Commissioner Sloan stated he would like to see an eight feet masonry wall around the entire property except six feet along S.H. 360. Commissioner Sloan moved to recommend approval of Case #00-09-SUP with the following stipulations: 1.) An eight feet masonry fence on the south, west, and north side of the property; 2.) A six feet masonry fence on the east side. Commissioner Grove asked to amend the motion, to not require masonry on the north property line, that a six feet wood fence be accepted. Commissioner Hughes asked to amend the motion, that the west, south, and east property line fencing be constructed at the time that construction commences. Chairman McMillon asked that the amendment include the mitigation of the thirty trees of 2 W to 3" caliper, with placement along South boundary to be decided at time of Planning and Zoning Commission Minutes Page 13 April 18,2000 construction. Commissioner Hughes asked that the amendment also include that the masonry fence be finished on both sides. Commissioner Sloan accepted the amendments. Commissioner Hughes seconded the motion. The vote was as follows: Ayes: Chairman McMillon, Commissioners Groves, Sloan, Tarin, Hughes, McNeese, Deithloff Nays: None The motion carried. ITEM 10 CASE #00-08-SP — RECOMMENDATION REGARDING A SITE PLAN Consider a recommendation regarding a request for a Site Plan for a Private Street Gated Town House Community proposed to be located at Edward Taylor Survey, Ab. 1550, Tr. 1A3, to the north and west of the intersection of Fuller-Wiser and S. H. 360. Commissioner Sloan moved to recommend approval of Case #00-08-SP. Commissioner Grove seconded the motion. The vote was as follows: Ayes: Chairman McMillon, Commissioners Groves, Sloan, Tarin, Hughes, McNeese, Deithloff Nays: None The motion carried. ITEM 11 CASE #00-01-FP— CONSIDERATION OF A FINAL PLAT Consider a request for a Final Plat changing A.M. Downen Survey, Ab. 415, Tr. 4A and 4A2 to Fountain Center Addition, Lot 2. This property is located 1102 W. Euless Boulevard. Commissioner Deithloff moved to approve Case #00-01-FP. Commissioner Tarin seconded the motion. The vote was as follows: Ayes: Chairman McMillon, Commissioners Groves, Sloan, Tarin, Hughes, McNeese, Deithloff Nays: None The motion carried.
