HomeMy WebLinkAbout2001-10-02 PLANNING AND ZONING MINUTES OCTOBER 2, 2001 MINUTES The regular meeting of the Planning and Zoning Commission was called to order by Chairman McNeese at 6:30 p.m. for consideration of scheduled items in the Council Chambers in Building "B" of the Municipal Building. Chairman McNeese stated there was a quorum of members of the Planning and Zoning Commission present. MEMBERS AND STAFF PRESENT: MEMBERS ABSENT Chairman McNeese Gene Sloan Vice Chairman Grove Robert McMillon Bill Tarin John Deithloff Ron Hughes Mike Collins, Director of Planning and Development Ron Young, Asst. Dir. of Public Works Kurt Kasson, Building Official Karla Dickerson, Administrative Secretary VISITORS: John Colby, Colby-Stanley Homes, Inc. THE PLEDGE OF ALLEGIANCE AND INVOCATION: The Pledge of Allegiance was 9 given by Vice Chairman Grove and Invocation was given by Commissioner Deithloff. APPROVAL OF MINUTES Commissioner Deithloff made the motion to approve minutes from September 4, 2001. Vice Chairman Grove seconded the motion. The vote was as follows: Ayes: Chairman McNeese, Vice Chairman Grove, Commissioners McMillon, Tarin, Deithloff, and Hughes Nays: None Abstention: None The motion carried. C Planning and Zoning Commission Minutes Page 2 October 2, 2001 REGULAR AGENDA ITEM 1 CASE #01-10-SUP — HOLD PUBLIC HEARING REGARDING A SPECIFIC USE PERMIT AND CONSIDER A RECOMMENDATION FOR ORDINANCE NO. 1500. Receive public input regarding a request for a Specific Use Permit on A.J. Huitt Survey, Abstract No. 709, Tract 31, for a Professional Office in R-1 (Single Family Detached Dwelling District) zoning, and consider a recommendation regarding Ordinance No. 1500. This property is located on 511 S. Main Street. Mr. Mike Collins, Director of Planning and Development, gave a brief overview of the Specific Use Permit request. The purpose of the public hearing is the receive public input regarding a request to amend 99-08 Specific Use Permit on A.J. Huitt Survey, Abstract No. 709, Tract 31, also known as 511 S. Euless Main Street. The city approved a Special Use Permit for a Professional Office located at 511 S. Euless Main Street on August 10, 1999. The property was utilized as a former residence and was converted for use as a Professional Office. The specific conditions that were approved under the original SUP that staff is recommending approval on a renewal of a new SUP would be; the use specifically identified on the ordinance and on the Specific Use Permit be allowed, that is as a Real Estate Agent and Manager's Office. The exterior appearance of the building and yards would remain residential in nature, with the exception of a sign, parking and other items specifically approved by the Planning and Development Ordinance No. 1367. No changes would be made to the exterior of the building, nor could the existing structure be expanded. John Colby of Colby-Stanley Properties remain the owner and be the primary user of the property. And lastly the customer activity after dark is specifically excluded for all tenants of the property. Chairman McNeese opened the public hearing. Chairman McNeese asked if the applicant was present and to come forward for any comments. John Colby, 4001 Mockingbird, Colleyville, TX, stated that two years ago when he came before the Commission he was asking to have a PD zoning to turn the property into something that would be a credit for the City of Euless. He feels that they have done this and more for the City and this project has proven to be a credit to the South Euless area. Presently he has two employees located at this facility and they also have a Networking Systems tenant that has two employees. Chairman McNeese closed the public hearing with no further proponents/opponents. Commissioner McMillon stated to Mr. Colby that he appreciated that he has done everything that he said he would do and to thank him for the improvements to the Planning and Zoning Commission Minutes Page 3 October 2, 2001 property. Commissioner McMillon asked Mr. Colby if he was in agreement with the four stipulations that were noted by Mike Collins. Mr. Colby stated that he was in agreement. The only change he would like to request was to extend the limit for more than the two years. Mike Collins stated that the only provision that we have to deal with the SUP as established is a two year time period and we have recognized and acknowledged that before the Commission and City Council and would hope in the future we would be able to do something that would allow this Commission and the City Council the discretion to authorize SUP's a period longer than the two years. Vice Chairman Grove thanked Mr. Colby for taking such good care of the property and that it appears that the residents are appreciative for the appearance of the property as well. Chairman McNeese stated that he was opposed to the request when it was first brought before the Commission, but stated that it was a very pleasing sight to drive by and that Mr. Colby has done a good job. There were no comments or questions from the Commission. Commissioner McMillon made a motion to approve Case #01-10-SUP with the four conditions that are outlined in the letter by Mr. Collins dated October 2, 2001 as presented. Commissioner Deithloff asked if he was referring to the summary that has seven (7) conditions. Mr. Collins stated that those were tied to the original SUP. Staffs recommendation is that the last three are no longer relevant. Commissioner asked about the fifth condition. Mr. Collins stated that this condition is no longer relevant due to being beyond the initial issuance of the Certificate of Occupancy. Commission Deithloff wanted this on record. Commissioner Tarin seconded the motion. The vote was as follows: Ayes: Chairman McNeese, Vice Chairman Grove, and Commissioners McMillon, Tarin, Deithloff, and Hughes Nays: None Abstention: None The motion carried.
