MINUTES
The regular meeting of the Planning and Zoning Commission was called to order
by Chairman McNeese at 6:36 p.m. for consideration of scheduled items in the
Council Chambers in Building "B" of the Municipal Building. Chairman McNeese
stated there was a quorum of members of the Planning and Zoning Commission
present.

THE PLEDGE OF ALLEGIANCE AND INVOCATION: The Pledge of
Allegiance was given by Commissioner Hughes and Invocation was given by
Commissioner Huffman.
APPROVAL OF MINUTES
Commissioner Hughes made a motion to approve minutes from June 4, 2002 as
written. Vice Chairman Grove seconded the motion. The vote was as follows:
Ayes: Chairman McNeese, Vice Chairman Grove, Commissioners Tarin,
Huffman, Hughes and Deithloff.
Nays: None
Abstention: None
The motion carried (6-0-0).

ITEM 1 CASE #02-01-UDC — HOLD PUBLIC HEARING REGARDING A
UNIFIED DEVELOPMENT CODE AND CONSIDER A
RECOMMENDATION FOR ORDINANCE NO. 1535
Receive public input and consider a recommendation regarding a
request by City of Euless for a change to Code of Ordinances
Chapter 84 "Unified Development Code" in order to to amend
Permitted Primary Uses.
Mike Collins gave a brief overview of this case. The applicant, The City of
Euless, is requesting an amendment to the Permitted Primary Uses of the Code
of Ordinances Chapter 84 "Unified Development Code" to include "Senior
Housing" and "Senior citizens assisted living". Also, Sec. 84-7(b) would also be
amended to include the following definitions:
Senior Housing — "Housing in a variety of residential settings for seniors (fifty-five
or older) who live independently, but desire residential and personal care
services without on-site nursing care facilities."
Senior Citizens Assisted Living — "Housing in a variety of residential settings
engaged in providing a range of residential and personal care services, such as
assistance with medications and daily activities such as bathing and dressing,
with on-site nursing care facilities." This use is included under Residential
Accommodations in Table 4-A. More intense levels of medical care are identified
as Nursing and personal care facilities under the Institutional and Education
Facilities. Table 4-A would be amended to include Senior Housing as a primary
use under residential accommodations and required to follow Parking Group 2
and Special Conditions "p" (private recreation facility) and "e" (600 feet of
common open space per dwelling).
With these amendments approved, any Senior Housing proposed on property
zoned R-3, R-4, or R-5, would require a Specific Use Permit. Any Senior
Citizens Assisted Living proposed on property zoned R-2, R-3, R-4, or R-5 would
require a Specific Use Permit. the City was asked to consider a formal request
for a "Senior Housing" project in the Fall of 2001. Approval of the recommended
UDC amendments would enable staff to provide specific development standards
information to any future applicant for a similar type of development.
Chairman McNeese opened the public hearing and asked for any
proponents/opponents to come forward for comments.
There were none so the public hearing was closed.
There were no comments from the Commissioners.

Commissioner Hughes made a motion for approval of recommendation to the
City Council of case #02-01-UDC. Commissioner Deithloff seconded the motion.
The vote was as follows:

Huffman, Hughes and Deithloff.
Nays: None
Abstention: None
The motion carried (6-0-0).
ITEM 2 CASE #02-02-UDC — HOLD PUBLIC HEARING REGARDING A
UNIFIED DEVELOPMENT CODE AND CONSIDER A
RECOMMENDATION FOR ORDINANCE NO. 1536
Receive public input and consider a recommendation regarding a
request by City of Euless for a change to Code of Ordinances
Chapter 84 "Unified Development Code" in order to to amend
Garage Enclosures/Carports/Off-Street Parking.
Mike Collins stated that staff was requesting this item be postponed indefinitely.
Vice Chairman Grove made a motion to table case #02-02-UDC indefinitely.
Commissioner Tarin seconded the motion. The vote was as follows:
Ayes: Chairman McNeese, Vice Chairman Grove, Commissioners Tarin,
Huffman, Hughes and Deithloff.
Nays: None
Abstention: None

ITEM 3 CASE #02-03-UDC — HOLD PUBLIC HEARING REGARDING A
UNIFIED DEVELOPMENT CODE AND CONSIDER A
RECOMMENDATION FOR ORDINANCE NO. 1537
Receive public input and consider a recommendation regarding a
request by City of Euless for a change to Code of Ordinances
Chapter 84 "Unified Development Code" in order to to amend
Fence and free standing wall setback requirements.
Mike Collins gave a brief overview of this case. The applicant, The City of
Euless, is requesting an amendment to Fence and free standing wall setbacks of
the Code of Ordinances Chapter 84 "Unified Development Code". Specifically,

Sec. 84-363(a)(1)would be proposed as follows: "The property shall not be
zoned for one- or two-family dwellings, with a lot size of one-half acre or less."
The following sentence would be included in a new Sec. 84-363(a)(4) "Fences
shall not be constructed less than ten feet (10') off of the front property line."
The Planning and Zoning Commission and the City Council considered this
issued in January of 2002. Further review of the ordinance would show that a
front setback requirement is needed in order to provide a safer buffer between
the roadway and the fence. Also, it was determined that the current code
standard of one-acre lots is too restrictive. Allowing front yard fencing with a ten-
foot (10') setback on a one-half acre lot would maintain sound planning, aesthetic
consistency, and site distance and safety standards.
As required by state law, notice of the Planning and Zoning Commission public
hearing was published in the Fort Worth Star Telegram — Northeast Tarrant
County Zone on Saturday, June 9, 2002, which was not less than 10 days prior
to the P&Z meeting. Notice of the City Council public hearing was published in
the Fort Worth Star Telegram — Northeast Tarrant County Zone on Saturday,
June 9, 2002, which was not less than 15 days prior to the City Council meeting.
Chairman McNeese opened the public hearing and asked for any
proponents/opponents to come forward for comments.
There were none so the public hearing was closed.
There were no comments from the Commissioners.
Commissioner Hughes made a motion for approval of recommendation to the
City Council of case #02-03-UDC. Vice Chairman Grove seconded the motion.
The vote was as follows:
Ayes: Chairman McNeese, Vice Chairman Grove, Commissioners Tarin,
Huffman, Hughes and Deithloff
Nays: None
Abstention: None
The motion carried (6-0-0).
ITEM 4 CASE #02-04-UDC — HOLD PUBLIC HEARING REGARDING A
UNIFIED DEVELOPMENT CODE AND CONSIDER A
RECOMMENDATION FOR ORDINANCE NO. 1538
Receive public input and consider a recommendation regarding a
request by City of Euless for a change to Code of Ordinances

Chapter 84 "Unified Development Code" in order to to amend Utility
services.
Mike Collins gave a brief overview of the case. The applicant, The City of
Euless, is requesting an amendment to the Code of Ordinances Chapter 84
"Unified Development Code"—Zoning District Regulations, referring to Utility
services. The amendments are necessary in order to strengthen the City's ability
to enforce the placement of on-site utilities. Specifically, the ordinance language
would clarify the requirement that utility service, including electric, must be
placed underground on new developments in all zoning districts.
Sec. 84-107 "R-3" (c)(21) (which applies to "R-4" and "R-5") is the only section
that includes the language, "Utility services —All utility services shall be buried".
Therefore, the following language should be added within each section (c)
District development standards, the language "Utility services —All utility services
should be buried. See Sec. 84-447(2)(k) Construction Standards for additional
requirements." Specifically, the following sections would be amended to include
this language: Sec. 84-101 "R-1C" (c)(14); Sec. 84-102 "R-1" (c)(14); Sec. 84-
103 "R-1L" (c)(15); Sec. 84-104 "R-1A" (c)(14); Sec. 84-105 "R-2" (c)(13); Sec.
84-106 "MH" (c)(16); Sec. 84-107 "TH" (c)(17); Sec. 84-110 "C-1" (c)(11); Sec.
84-111 "C-2" (c)(10); Sec. 84-112 "TX-10" (c)(20); Sec. 84-113 "L1" (c)(12); Sec.
84-114 "L-1" (c)(9); Sec. 84-115 "1-2" (c)(9); and , Sec. 84-116 "TX-121" (c)(10).
The language "Site Plan approval requirements — none for one- or two-family
dwellings. See Article VIII", would be added to the following new sections: Sec.
84-101 "R-1C" (c)(15); Sec. 84-102 "R-1" (c)(15); Sec. 84-103 "R-1L" (c)(16);
and, Sec. 84-104 "R-1A" (c)(15). The language "Site Plan approval —see Article
VIII. City Council approval required prior to construction commencing.", would be
added to the following new sections: Sec. 84-105 "R-2" (c)(14); Sec. 84-106
"MH" (c)(17); Sec. 84-107 "TH" (c)(18); Sec. 84-110 "C-1" (c)(12); Sec. 84-111
"C-2" (c)(11); Sec. 84-112 "TX-10" (c)(21); Sec. 84-113 "LI" (c)(13); Sec. 84-114
"L-1" (c)(10); Sec. 84-115 "1-2" (c)(10); and , Sec. 84-116 "TX-121" (c)(11).
Chairman McNeese opened the public hearing and asked for any
proponents/opponents to come forward for comments.
There were none so the public hearing was closed.

Commissioner Deithloff made a motion for approval of recommendation to the
City Council of case #02-04-UDC. Commissioner Huffman seconded the motion.
The vote was as follows:

ITEM 5 CASE #02-05-UDC — HOLD PUBLIC HEARING REGARDING A
UNIFIED DEVELOPMENT CODE AND CONSIDER A
RECOMMENDATION FOR ORDINANCE NO. 1539
Receive public input and consider a recommendation regarding a
request by City of Euless for a change to Code of Ordinances
Chapter 84 "Unified Development Code" in order to to amend
Preliminary Plat proceedures.
Mike Collins gave a brief overview of the case. The applicant, The City of Euless,
is requesting an amendment to the Preliminary Plat procedures of the Code of
Ordinances Chapter 84 "Unified Development Code".
Specifically, Sec. 84-407 (c)(2) (b)would read as follows: "A preliminary water and
wastewater layout and a preliminary storm drainage layout have been reviewed by
and are acceptable to the City Engineer."This would replace the current wording:
"The construction plans have been reviewed by and are acceptable to the City
Engineer." (2)(c) would read as follows: "Provision for a note on the preliminary
plat stating that installation and dedication of public improvements will be made
prior to the submission of a final plat." This would replace the current wording:
"Provision for the installation and dedication of public improvements has been
made."
Sec. 84-407 (c)(5) would read as follows: "Approval of a preliminary plat by the
commission constitutes authorization for the property owner's professional
engineer to begin preparation of construction plans for public improvements."
Sec. 84-407 (d)(2) would be amended to replace the sentence that reads; "The
city engineer will release the plans for construction, subject to approval of the
preliminary plat by the commission and payment of all inspection fees.", with a
sentence that reads as follows: "The construction plans may be released subject
to concurrence by the City Engineer that the plans meet the minimum
requirements of the City of Euless, and payment of inspection fees, escrows due
(if any) and pro rata charges due (if any) are current."
These amendments do not eliminate any requirements, but is considered more
"developer friendly". Rather, it simply changes the work completion sequence
that culminates in the acceptance of the public improvements and Final Plat
being filed.
Chairman McNeese opened the public hearing and asked for any
proponents/opponents to come forward for comments.

The motion carried (6-0-0).
ITEM 6 REPORT
Ron Young, Asst. Dir. of Public Works, reported that the Harwood Rd. project is
getting closer to being finished. There are six lanes open and the foundation for
streetlights are ready.
ITEM 7 DIRECTOR'S REPORT
Mike Collins advised the Commissioners the July 16th meeting would have
between three and five different residential developments, which include three
single family and two townhouse developments. Also, there is a potential for
three to five commercial type projects.
