HomeMy WebLinkAbout2007-10-16 PLANNING AND ZONING October 16, 2007 MINUTES The regular meeting of the Planning and Zoning Commission was called to order by Chairman Richard McNeese at 6:36 p.m. for consideration of scheduled items in the Council Chambers in City Hall of the Municipal Complex. Chairman Richard McNeese stated there was a quorum of members of the Planning and Zoning Commission present. MEMBERS AND STAFF PRESENT: MEMBERS ABSENT: Chairman Richard McNeese Vice Chairman Tony May George Zahn Monty Huffman LuAnn Portugal Andy Bearden Troy Mennis Mike Collins, Director of Planning and Development Chris Barker, Planning and Development Manager Ron Young, Director of Public Works Robert Barker, City Engineer Bill Ridgway, Director of Economic Development JT Ackerman, Public Works Manager Kurt Kasson, Building Official Holly Witt, Administrative Secretary VISITORS: Dave Kirk, Joe and Natalie Williams THE PLEDGE OF ALLEGIANCE AND INVOCATION: The Pledge of Allegiance was given by Vice Chairman May and Invocation was given by Commissioner Zahn. ITEM 1 APPROVAL OF MINUTES for called meeting of October 2, 2007 Vice Chairman May made a motion to approve the minutes for called meeting of October 2, 2007. Commissioner Bearden seconded the motion. The vote was as follows: Ayes: Chairman McNeese, Vice Chairman May, Commissioners Huffman, Portugal, Bearden Nays: None Abstention: Commissioners Zahn and Mennis The motion carried (5-0-2) Planning and Zoning Commission Minutes Page 2 October 16, 2007 ITEM 2 CASE #07-11-SUP — HOLD PUBLIC HEARING REGARDING A SPECIFIC USE PERMIT AND CONSIDER A RECOMMENDATION FOR AN ORDINANCE Receive public input regarding a request for a Specific Use Permit on Heritage Towne Crossing, Block B, Lot 1 for a Used Merchandise Store in TX-121 (The 121 Gateway District) zoning, and consider a recommendation regarding an Ordinance. This property is located on 1301 W. Glade Road #110. Chairman McNeese opened the public hearing. Chris Barker, Planning and Development Manger, gave a brief description of the case. The Applicant, Natalie Williams, Teen Collections, L.L.C., d.b.a. Plato's Closet, is seeking renewal of a Specific Use Permit (#02-11-SUP) that had been approved in October 2002. Ms. Williams owns a used merchandise retail business called Plato's Closet, operating as a franchise from the Winmark Corporation. The business is located in Suite #110 of the Heritage Towne Crossing shopping center. Specifically, Plato's Closet purchases "gently used" clothing directly from customers for resale that is of a certain brand, quality and type that is established by the Franchiser, the Winmark Corporation., The Franchiser provides a software program that allows the Franchisee in each local market to determine the purchase price and the suggested sales price based on the brand name, the quality of the item, and the age of the item. Plato's Closet has been operating successfully for five (5) years. Chris Barker stated the applicant, Natalie Williams, was available for any questions. Chairman McNeese asked for any proponents/opponents to come forward for any comments. Seeing none the public hearing was closed. Commissioners Portugal and Mennis stated they appreciate her business. Chairman McNeese asked Natalie how business was going. Natalie Williams, 1301 W. Glade Road #110, Euless, Texas, stated business has improved with each year. Last year they had $679,000 in sales and this year they anticipate $814,000. They have a growth of 20%. Commissioner Zahn made a motion to approve case #07-11-SUP with the following conditions: 1) Tied to Teen Collections, L.L.C., d.b.a. Plato's Closet; and 2) Tied to the owner, Natalie Williams. Commissioner Portugal seconded the motion. The vote was as follows: Ayes: Chairman McNeese, Vice Chairman May, Commissioners Zahn, Huffman, Portugal, Bearden, Mennis Planning and Zoning Commission Minutes Page 3 October 16, 2007 Nays: None Abstention: None The motion carried (7-0-0) ITEM 3 CASE #07-06-SUP — HOLD PUBLIC HEARING REGARDING A SPECIFIC USE PERMIT AND CONSIDER A RECOMMENDATION FOR AN ORDINANCE Receive public input regarding a request for a Specific Use Permit on J.E. Whitener Estates Addition, Block 1, Lot 1A1 for a Telecommunication Facility in R-1 (Single-Family Detached Dwelling District) zoning, and consider a recommendation regarding an Ordinance. This property is located on 151 S. Pipeline Road E. Chairman McNeese opened the public hearing. Mike Collins, Director of the Planning and Development, stated that prior to the meeting the applicant's representative, Dave Kirk, requested this item be tabled to the next scheduled meeting in order to be able to prepare a detailed presentation that would respond to questions the commission had during pre session. Chairman McNeese asked for any proponents/opponents to come forward for any comments. Seeing none the public hearing was closed. Commissioner Mennis asked the applicant's representative, Dave Kirk, to bring pictures of existing and proposed towers would look like. Commissioner Zahn made a motion to table case #07-06-SUP until the next scheduled meeting, November 6, 2007. Commissioner Bearden seconded the motion. The vote was as follows: Ayes: Chairman McNeese, Vice Chairman May, Commissioners Zahn, Huffman, Portugal, Bearden, Mennis Nays: None Abstention: None The motion carried (7-0-0) ITEM 4 REPORTS There were no reports.
