HomeMy WebLinkAbout2006-02-07 PLANNING AND ZONING February 7, 2006 MINUTES The regular meeting of the Planning and Zoning Commission was called to order by Chairman Richard McNeese at 6:32 p.m. for consideration of scheduled items in the Council Chambers in City Hall of the Municipal Complex. Chairman Richard McNeese stated there was a quorum of members of the Planning and Zoning Commission present. THE PLEDGE OF ALLEGIANCE AND INVOCATION: The Pledge of Allegiance was given by Commissioner Zahn and Invocation was given by Commissioner Huffman. Vice Chairman Grove left the meeting at approximately 6:00pm. ITEM 1 APPROVAL OF MINUTES for called meeting of January 17, 2006 Commissioner May made a motion to approve minutes for called meeting of January 17, 2006. Commissioner Portugal seconded the motion. The vote was as follows: Ayes: Chairman McNeese, Commissioners Zahn, Huffman, Portugal and May Nays: None Abstention: None The motion carried (5-0-0). Planning and Zoning Commission Minutes Page 2 February 7, 2006 ITEM 2 CASE #05-13-SUP — HOLD PUBLIC HEARING REGARDING A SPECIFIC USE PERMIT AND CONSIDER A RECOMMENDATION FOR AN ORDINANCE Receive public input regarding a request for a Specific Use Permit on Bryant Harrington Survey, A-808, Tracts 2-5C, for a Lumber, Building Materials with Open Storage in TX-121 (The 121 Gateway District) zoning, and consider a recommendation regarding an Ordinance. This property is located on southeast corner of E. Glade Rd. and Hwy 121. Chairman McNeese opened the public hearing. Mike Collins, Director of Planning and Development, gave a brief explanation of how the presentation of the cases will take place. He stated the application will bring forth his presentation that will explain many facts about the project as a whole. At that time questions will be taken from the audience and can be answered. Michael Coker, 2700 Swiss Ave., Dallas, representing Burk Collins Co. and Lowe's gave a presentation showing the project. Mr. Coker stated this was a consolidated site plan and believes they have met the intent of the ordinances in complying with all the site plan and landscaping requirements and off site detention. Mr. Coker explained the project also meets the Comprehensive Land Use that was established by the city. As part of the project overview, Mr. Coker explained that his client will be developing 400,000 plus square feet of retail and related space. Mr. Coker stated they want to promote the highest and best use of the property and feel they have done a good job in complying with this. They are providing safe pedestrian access, complimentary signs and entryways. The design is sensitive to adjoining areas of single family areas to the east. The lighting that will be along the back side of the units that back up to Gateway Blvd. will have wall packs and will be screened so there is no light trespass or glare that penetrates the residential neighborhood. Chairman McNeese asked for any proponents/opponents to come forward for comments. Pam Pereira, 2909 Roxboro Rd., Euless, asked how there will be buffering for the lights and noise from this project. Michael Coker explained the type of landscaping that will be used to buffer the residential area. Brian Cooks, 2913 Roxboro Rd., Euless, stated he was concerned about accessing Glade Rd. from Roxboro with additional traffic that will be generated from this project; where will dumpsters be located and screened; how will the noise impact the residential area from forklifts that would be coming from Lowe's; and where are the location of the sidewalks for pedestrian access. Planning and Zoning Commission Minutes Page 3 February 7, 2006 Robert Barker, City Engineer, stated there will be a median opening for Roxboro with the new construction that will take place on Glade Rd. He stated there will be a traffic signal place at the Gateway Blvd. location to help with traffic concerns in and out or Roxboro. Michael Coker explained there will be a 7 to 10 foot wide sidewalk on both sides of the street from Glade Rd. down to Centurion on Gateway Blvd. He stated that with the buffering and berming that has been designed will help with any noise and should impact any noise from the property. Stacia Hutson, 2609 Tallow, Euless, asked why there was not going to be a park on the property where the detention pond is going to be located because it was her understanding there would be one there from meetings that took place in previous years. Ms. Hutson asked wanted to know if the detention pond will always remain a detention pond and how many trees will be cut down in this area. Mike Collins stated the original property owner since that time, did not develop the property consistent with the zone change that had been approved at that time. Therefore, there was no triggering event for the park to be developed. Michael Coker state the detention pond will always remain at this location and they will be preserving as many trees as possible for this area. Emily George, 2927 Roxboro Rd., Euless, stated she was concerned with safety on the far east side regarding where the drainage ditch and roadway are located in proximity to one another. Michael Coker stated there is a sidewalk that will be in front of the ditch and would not be putting in barricades in unless the city requests them to be placed at that location. Lisa Young, 3019 Roxboro Rd., Euless, stated she was concerned about smelling food coming from the restaurants. Michael Coker stated there should not be a problem with any odors due to the neighborhood being approximately '/ mile from them and with the new equipment that is being used by the restaurants helps to cut down on this type of problem. Brian Crooks, 2913 Roxboro Rd., asked if there would be any consideration for extra buffering on the east side of Gateway Blvd. to mitigate the noise from the street. Mike Collins stated staff has considered the appropriate mitigation of noise and additional buffers can be obtained by placing everything on the west side of Gateway. Any issues involving the street and noise buffering would need to be a separate discussion. Planning and Zoning Commission Minutes Page 4 February 7, 2006 Beverly Gonzalez, 2921 Roxboro Rd., Euless, asked if there would be any type of brick wall constructed behind their property because she is concerned about access to their property. Michael Coker stated there will be a limited retaining wall around Lowe's and landscaping trees on top of the berming on the west side of Gateway Blvd. Chairman McNeese closed the public hearing. Commissioner Zahn expressed he felt this was a fine project and was in favor. Commissioner Zahn made a motion to approve case #05-13-SUP with the following conditions: 1) Three (3) areas are specifically designated for outdoor storage and may be located in the following areas: garden center; parking lot outdoor display area; and, adjacent to customer loading area, as identified on the site plan exhibit, and 2) The parking lot permanent display area will be constructed and maintained with enhanced pavement treatment and landscaping and shall not be used for the storage or sale of rental equipment. Commissioner May seconded the motion. The vote was as follows: Ayes: Chairman McNeese, Commissioners Zahn, Huffman, Portugal and May Nays: None Abstention: None The motion carried (5-0-0). ITEM 3 CASE #05-13-SP — CONSIDER A RECOMMENDATION FOR A SITE PLAN Consider a recommendation regarding a request for a Site Plan for Commercial Development proposed to be located at Bryant Harrington Survey, A-808, Tracts 2-5C, southeast corner of E. Glade Rd. and Hwy 121. There was no discussion among the commissioners. Commissioner Huffman made a motion to approve case #05-13-SP. Commissioner Portugal seconded the motion. The vote was as follows: Ayes: Chairman McNeese, Commissioners Zahn, Huffman, Portugal and May Nays: None Abstention: None The motion carried (5-0-0). Planning and Zoning Commission Minutes Page 5 February 7, 2006 ITEM 4 CASE #05-16-SUP — HOLD PUBLIC HEARING REGARDING A SPECIFIC USE PERMIT AND CONSIDER A RECOMMENDATION FOR AN ORDINANCE Receive public input regarding a request for a Specific Use Permit on Bryant Harrington Survey, A-808, Tracts 2-5C, for a RESTAURANT WITH DRIVE THRU in TX-121(The 121 Gateway District) zoning, and consider a recommendation regarding an Ordinance. This property is located on southeast corner of E. Glade Rd. and Hwy 121. Chairman McNeese opened the public hearing. Mike Collins, Director of Planning and Development, stated this is related to Lot 2 that has been described previously as including the inline retail as well as the four specific out parcels adjacent to the Hwy 121 frontage road. This case relates directly to building #14 for a drive through restaurant and staff is recommending approval. Chairman McNeese asked for any proponents/opponents to come forward for comments. Brian Crooks, 2913 Roxboro Rd., Euless, asked for clarification of where the drive through lane would be located. Chairman McNeese closed the public hearing. There was no discussion among the commissioners. Commissioner Zahn made a motion to approve case #05-16-SUP. Commissioner Huffman seconded the motion. The vote was as follows: Ayes: Chairman McNeese, Commissioners Zahn, Huffman, Portugal and May Nays: None Abstention: None The motion carried (5-0-0). ITEM 5 CASE #05-18-SUP — HOLD PUBLIC HEARING REGARDING A SPECIFIC USE PERMIT AND CONSIDER A RECOMMENDATION FOR AN ORDINANCE Receive public input regarding a request for a Specific Use Permit on Bryant Harrington Survey, A-808, Tracts 2-5C, for a Restaurant With Drive Thru in TX-121 (The 121 Gateway District) zoning, and consider a Planning and Zoning Commission Minutes Page 6 February 7, 2006 recommendation regarding an Ordinance. This property is located on southeast corner of E. Glade Rd. and Hwy 121. Chairman McNeese opened the public hearing. Mike Collins, Director of Planning and Development, stated there was no additional comment for this case. Chairman McNeese asked for any proponents/opponents to come forward for comments. Seeing none the public hearing was closed. There was no discussion among the commissioners. Commissioner Portugal made a motion to approve case #05-18-SUP. Commissioner May seconded the motion. ITEM 6 CASE #05-14-SP — CONSIDER A RECOMMENDATION FOR A SITE PLAN Consider a recommendation regarding a request for a Site Plan for Commercial Development proposed to be located at Bryant Harrington Survey, A-808, Tracts 2-5C. There was no discussion among the commissioners. Commissioner May made a motion to approve case #05-14-SP. Commissioner Huffman seconded the motion. Planning and Zoning Commission Minutes Page 7 February 7, 2006 ITEM 7 CASE #05-14-SUP — HOLD PUBLIC HEARING REGARDING A SPECIFIC USE PERMIT AND CONSIDER A RECOMMENDATION FOR AN ORDINANCE Receive public input regarding a request for a Specific Use Permit on Bryant Harrington Survey, A-808, Tracts 2-5C, for a BANKING INSTITUTE WITH DRIVE THRU in TX-121 (The 121 Gateway District) zoning, and consider a recommendation regarding an Ordinance. This property is located on southeast corner of E. Glade Rd. and Hwy 121. Chairman McNeese opened the public hearing. Mike Collins, Director of Planning and Development, stated this case a bank drive through that is located on the far northwest corner. Chairman McNeese asked for any proponents/opponents to come forward for comments. Seeing none the public hearing was closed. There was no discussion among the commissioners. Commissioner Huffman made a motion to approve case #05-14-SUP. Commissioner Portugal seconded the motion. ITEM 8 CASE #05-15-SUP — HOLD PUBLIC HEARING REGARDING A SPECIFIC USE PERMIT AND CONSIDER A RECOMMENDATION FOR AN ORDINANCE Receive public input regarding a request for a Specific Use Permit on Bryant Harrington Survey, A-808, Tracts 2-5C, for a RESTAURANT WITH DRIVE THRU in TX-121 (The 121 Gateway District) zoning, and consider a recommendation regarding an Ordinance. This property is located on southeast corner of E. Glade Rd. and Hwy 121. Chairman McNeese opened the public hearing. Mike Collins, Director of Planning and Development, stated this corresponds to a restaurant with a drive through and building #12 and staff recommends approval. ITEM 9 CASE #05-15-SP — CONSIDER A RECOMMENDATION FOR A SITE PLAN Consider a recommendation regarding a request for a Site Plan for Commercial Development proposed to be located at Bryant Harrington Survey, A-808, Tracts 2-5C. Mike Collins, Director of Planning and Development, stated this case corresponds to the two previous Specific Use Permits along with a retail site. There was no discussion among the commissioners. Commissioner May made a motion to approve case #05-15-SP. Commissioner Portugal seconded the motion. The vote was as follows: Ayes: Chairman McNeese, Commissioners Zahn, Huffman, Portugal and May Nays: None Abstention: None The motion carried (5-0-0). ITEM 10 CASE #05-16-SP — CONSIDER A RECOMMENDATION FOR A SITE PLAN Consider a recommendation regarding a request for a Site Plan for Commercial Development proposed to be located at Bryant Harrington Survey, A-808, Tracts 2-5C. Planning and Zoning Commission Minutes Page 9 February 7, 2006 Mike Collins, Director of Planning and Development, stated this case corresponds to four out parcels identified as proposed restaurants without drive through. Staff recommends approval. Commissioner May asked if the ramp does not get changed will the ingress/egress on Hwy 121 stay in place. Michael Coker stated the driveway will stay in place whether they receive the ramp change or not. Commissioner Portugal stated the reduction in speed limit on the frontage road is good. Commissioner Huffman made a motion to approve case #05-16-SP. Commissioner Portugal seconded the motion. The vote was as follows: Ayes: Chairman McNeese, Commissioners Zahn, Huffman, Portugal and May Nays: None Abstention: None The motion carried (5-0-0). ITEM 11 CASE #05-17-SP — CONSIDER A RECOMMENDATION FOR A SITE PLAN Consider a recommendation regarding a request for a Site Plan for Commercial Development proposed to be located at Bryant Harrington Survey, A-808, Tracts 2-5C. Mike Collins, Director of Planning and Development, stated this case is specific to a 4.6 acre tract at the southeast corner of the development. The end user is identified as LA Fitness to develop a 45,000 square foot membership sports and recreation club. Staff is recommending approval. Commissioner Portugal asked if this fitness center is a 24 hour operation. Michael Coker stated they do not know at this time what their proposed hours of operation are going to be. Commissioner Zahn made a motion to approve case #05-17-SP. Commissioner Huffman seconded the motion. The vote was as follows: Ayes: Chairman McNeese, Commissioners Zahn, Huffman, Portugal and May Nays: None Abstention: None Planning and Zoning Commission Minutes Page 10 February 7, 2006 The motion carried (5-0-0). ITEM 12 REPORTS Ron Young, Director of Public Works, reported on the opening of Hwy 360 lanes and a ribbon on the 16th of the month. Bill Ridgway, Director of Economic Development, stated that everything brought up tonight has been discussed in great detail and this development will bring good things to the City of Euless. Bob McFarland, City Attorney, stated if anyone had any questions about an earlier issue to contact his office. ITEM 13 DIRECTOR'S REPORT There were no reports.
