Discount grocer preparing to open Texas stores faces
lawsuit in Midwest

As Aldi prepares to open its first Texas stores in March, the German-owned discount grocer is
fighting a legal action in the Midwest involving unpaid overtime and more than 200 store
managers. _
The federal class action suit was filed in Cleveland in August, but several more managers joined
as plaintiffs this week. Like the others, they say they performed no managerial duties that would _
exempt them from overtime pay under federal law.
Such suits are popping up nationwide as large retail chains are accused of stretching job _
descriptions to get employees to work off the clock. In recent years, Taco Bell, Abercrombie &
Fitch and Big Lots settled with managers in similar disputes.
Former Aldi manager Howard McNelley of Elyria, Ohio, started the suit, saying that for nine
years he stocked shelves, cleaned the store and operated the cash register but never supervised
more than one person and did not have the authority to hire or fire, according to his complaint. _
The chain said McNelley worked only eight years and denied that he did cleanup or other menial
jobs. And while he occasionally put in more than 40 hours in a week, such unpaid work is
allowed under the Fair Labor Standards Act, it said.
"As a matter of policy and practice, Aldi consistently adheres to all employee-related laws and
regulations," said Martha Swaney of the MWW Group public relations firm, who serves as a
spokeswoman for Aldi. "We look forward to presenting the facts in court."
"Aldi prides itself on providing a work environment that respects each employee and rewards its
staff with generous salaries and benefits that are significantly higher than the industry standard,"
Swaney said. "As a testament to that, it's common for Aldi employees to celebrate 15, 20 and 25
years of service."
With the local unemployment rate hovering at 8 percent, Aldi ran several well-attended job fairs
in recent months. It was seeking store managers and hourly staff for 27 stores to open in the
Metroplex from March through May.
An Aldi recruiting Web site said 11 stores will open around March 18, including six in Tarrant
County. Aside from stores at 1628 Precinct Line Road in Hurst and 2417 W. Park Row Blvd. in
Pantego, there will be four in Fort Worth: 7440 McCart Ave., 700 Alta Mere Drive, 5728 N.
Tarrant Parkway and 5617 S. Hulen St., it said.
Five Dallas County stores will open about April 15, followed by four more in the region April
22, including one in Fort Worth at 9660 Legacy Drive,the Web site said.
