HomeMy WebLinkAbout2004-06-24 ZONING BOARD OF ADJUSTMENTS June 24, 2004 MINUTES The regular meeting of the Zoning Board of Adjustments was called to order by Chairman Victor Blood at 6:40 p.m. for consideration of scheduled items in the Council Chambers in City Hall of the Municipal Complex. Chairman Victor Blood stated there was a quorum of members of the Zoning Board of Adjustments. MEMBERS AND STAFF PRESENT: MEMBERS ABSENT Chairman Victor Blood Vice Chairman Thomas Stover Luther Dube Robert McMillon Eddie Price Mike Collins, Director of Planning and Development Eric Wilhite, Planning and Development Manager Karla Allen, Administrative Secretary VISITORS: Russell Owen; Harold Knorr; Theda Adams — THE PLEDGE OF ALLEGIANCE AND INVOCATION: The Pledge of Allegiance and Invocation was given by Victor Blood. ITEM 1 APPROVAL OF MINUTES for called meeting of April 29, 2004 Board Member Price made a motion to approve minutes for April 29, 2004 as presented. Board Member Dube seconded the motion. The vote was as follows: Ayes: Chairman Blood, Board Members Dube, McMillon and Price Nays: None Abstention: None The vote was as follows: (4-0-0). ITEM 2 CASE #04-04-ZBA – HOLD PUBLIC HEARING AND CONSIDER A REQUEST FOR A ZONING VARIANCE Receive public input regarding a request for a ZONING VARIANCE. The applicant is requesting the variance in order to construct a CARPORT. Eric Wilhite, Planning and Development Manager, gave a brief overview of the case. This case is to receive public input regarding a request for a zoning variance. The applicant is asking for a zoning variance in order to construct a carport on Midway Park Addition, Block 3, Lot 19. This property is located at 814 Collin Dr. The applicant, Ms. Adams, is requesting a variance related to the proposed construction of a carport in order to attach it to her house and extend it out into the existing driveway as proposed in the exhibits. Chairman Blood asked for the applicant or applicant's representative to come forward for comments. Harold Knorr, 2932 Winston Ct., Bedford, Ms. Adams brother-in-law, stated Ms. Adams is trying to have a carport constructed possibly in a temporary situation 2-4 years until she is walking again. Theda Adams, 814 Collin Dr., explained she became wheelchair bound after an accident and should be able to walk again within the next few years. Her recovery is slow but has been progressing. She is asking for the carport to help protect her when she has to get into and out of her vehicle during inclement weather. Chairman Blood asked for any proponents to come forward for comments. Russell Owen, 806 Collin Dr., Euless, stated he has lived in this area for many years and loves this area. The majority of the homes in this area is one car garage units and is smaller in size for the vehicles that are being built today. He would like to see Ms. Adams have this carport to help her during inclement weather. He would also like to see this area have the capability to have carports in order to protect their vehicles from outside elements. Chairman Blood asked for any opponents to come forward for comments. Seeing none the public hearing was closed. Board Member Price asked staff what the process would be in order to change an ordinance that would allow carports in general. Mike Collins, Director of Planning and Development, explained it would require an amendment to the Unified Development Code specific to this and there could be an ordinance revision from a process standpoint that would identify the physical boundaries of a geographical area and establish specific provisions for that area. Board Member Dube advised Ms. Adams they try to see why the variance is being requested. He stated he did look at the property in question and did not observe any carports in the area and thought it would be distractive to have a carport in front of her house even though the neighbors have voiced they would like for her to have one. If Zoning Board of Adjustment Minutes Page 3 June 24, 2004 the board does grant this variance for her particular situation how many other neighbors would then want a carport is another situation they must consider. Ms. Adams stated she did not know how many other neighbors would want to have a carport. She is also not aware of anyone else in the same similar situation that would need a carport. Her neighbors have always been good to her and she has never had any problems in her neighborhood. Chairman Blood asked Mr. Owen if the board were to grant this variance would he be looking to ask for a carport variance as well. Mr. Owen stated he would like to have a carport to protect his vehicle and felt there would be many others that would like to have the same. They love their homes and do not want to move to another home that has a garage that could accommodate their needs. Mike Collins, Director of Planning and Development, asked Mr. Owens that there is an applicant that has representing a justification for some type of cover that because of her physical condition when there is bad weather would like some cover overhead, not for her vehicle but for herself, while getting in and out of her vehicle. If you were coming before the zoning board to get a carport constructed do you think the reasons why you want it fall into the same category as this situation. Mr. Owens stated it would not. Her reason is valid and should be granted. Board Member Price read the requirements for granting a variance to the audience for "—' their information. Chairman Blood stated there are options they could look at in order to grant this variance. Some of the options would be to have a shorter carport, temporary structure, time frame, or removal once you are no longer the owner of the house. Another question is if any of these options are enforceable. Board Members discussed many different options they could take in order to help be able to grant this variance. Board Member Dube made a motion to approve case #04-04-ZBA with the following conditions: granted to Ms. Adams to build a freestanding overhead cover as approved by the Building Official not to exceed 13' encroachment on the existing 30' setback which is to be removed 4 years from this date with the option to request an extension. Board Member Price seconded the motion. The vote was as follows: Ayes: Chairman Blood, Board Members Dube, McMillon and Price Nays: N one Abstention: None The motion carried (4-0-0).
