HomeMy WebLinkAbout2006-08-31 ZONING BOARD OF ADJUSTMENTS August 31, 2006 MINUTES The regular meeting of the Zoning Board of Adjustments was called to order by Vice Chairman Eddie Price at 6:35 p.m. for consideration of scheduled items in the Council Chambers in City Hall of the Municipal Building. Vice Chairman Eddie Price stated there was a quorum of members of the Zoning Board of Adjustments present. MEMBERS AND STAFF PRESENT: MEMBERS ABSENT Vice Chairman Eddie Price Chairman Victor Blood Troy Mennis Luther Dube Robert McMillon Ruby Anne Crites, Alt. Robert Wooldridge, Alt. Mike Collins, Director of Planning and Development Kurt Kasson, Building Official Holly Witt, Administrative Secretary VISITORS: Sheila Ware, Patrick McCombs THE PLEDGE OF ALLEGIANCE AND INVOCATION: The Pledge of Allegiance was given by Board Member Dube and Invocation was given by Vice Chairman Price. ITEM 1 APPROVAL OF MINUTES for called meeting of February 24, 2005 Board Member Mennis made a motion to approve the minutes for called meeting of February 24, 2005 as written. Alt. Board Member Crites seconded the motion. The vote was as follows: Ayes: Vice Chairman Price, Board Members Mennis, Dube, McMillon, Alt. Board Members Crites Nays: None Abstention: None The motion carried (5-0-0) ITEM 2 ELECTION OF OFFICERS Board Member Dube made a motion to appoint Victor Blood as Chairman. Board ._. Board Members Crites Nays: None Abstention: None The motion carried (5-0-0) Board Member Mennis made a motion to appoint Eddie Price as Vice Chairman. Board Member Dube seconded the motion. The vote was as follows: Ayes: Vice Chairman Price, Board Members Mennis, Dube, McMillon, Alt. Board Members Crites Nays: None Abstention: None The motion carried (5-0-0) ITEM 3 CASE #06-01-ZBA — HOLD PUBLIC HEARING AND CONSIDER A REQUEST FOR A ZONING VARIANCE Receive public input regarding a request for a Zoning Variance. The applicant is requesting a variance to rear set back requirements. This property is located on Ashbrook Estates, Block A, Lot 11, 706 Ashbrook Court. Vice Chairman Price opened the public hearing. Mike Collins, Director of Planning and Development, gave a brief description of the case. This item is before the Zoning Board of Adjustment because of an error made by staff. Approval was inadvertently granted in May 2002 by the Planning and Development Department that enabled construction of a covered rear patio at 706 Ashbrook Court in the Ashbrook Estates Subdivision. The patio is located within fifteen feet (15') of the rear property line, which encroaches within the twenty-five foot (25') rear setback. The roof of the covered patio extends from, and is the same color and pitch as, the roof of the primary structure. The covered patio appears as though it was part of the original construction of the house. Vice Chairman Price asked the applicant or representative to come forward for comments. Sheila Ware, 706 Ashbrook Court, Euless, stated she would like to have a clear title of the structure that was built back in 2002. Patrick McCombs, 718 Ashbrook Court, Euless, stated he built the original structure and that the neighbors are supportive. Vice Chairman Price closed the public hearing. Board Member Dube made a motion to approve case #06-01-ZBA as requested that the fifteen foot set back is intended to establish the set back consistent to what is on the ground. Alt. Board Member Crites seconded the motion. The vote was as follows: Ayes: Vice Chairman Price, Board Members Mennis, Dube, McMillon, Alt.
