HomeMy WebLinkAbout2007-05-17 ZONING BOARD OF ADJUSTMENTS May 17, 2007 MINUTES The regular meeting of the Zoning Board of Adjustments was called to order by Board Member Dube at 6:37 p.m. for consideration of scheduled items in the Council Chambers in City Hall of the Municipal Complex. Board Member Dube stated there was a quorum of members of the Zoning Board of Adjustments present. MEMBERS AND STAFF PRESENT: MEMBERS ABSENT Presiding Chairman Luther Dube Alternate Robert Wooldridge Troy Mennis Alternate Harry Zimmer Tim Stinneford Alternate Steven Ellis Ruby Anne Crites Karin Newell Mike Collins, Director of Planning and Development Chris Barker, Planning and Development Manager Robert Barker, City Engineer Holly Witt, Administrative Secretary VISITORS: Rosana Chestain THE PLEDGE OF ALLEGIANCE AND INVOCATION: The Pledge of Allegiance and Invocation was given by Board Member Dube. ITEM 1 ELECTION OF OFFICERS —CHAIRMAN AND VICE CHAIRMAN Board Member Stinneford made a motion to elect Luther Dube as Presiding Chairman for this called meeting and wait until the next called meeting to elect officers. Board Member Newell seconded the motion. The vote was as follows: Ayes: Board Members Mennis, Dube, Stinneford, Crites, Newell Nays: None Abstention: None The motion carried (5-0-0) ITEM 2 APPROVAL OF MINUTES for called meeting of November 30, 2006 Board Member Crites made a motion to approve the minutes for called meeting of November 30, 2006 with the following correction: Add the letter E to the end of Ann in the list of Members and Staff Present. Board Member Mennis seconded the motion. The vote was as follows: Zoning Board of Adjustment Minutes Page 2 May 17, 2007 Ayes: Presiding Chairman Dube, Board Members Mennis, Stinneford, Crites, Newell Nays: None Abstention: None The motion carried (5-0-0) ITEM 3 CASE #07-01-ZBA — HOLD PUBLIC HEARING AND CONSIDER A REQUEST FOR A VARIANCE Receive public input regarding a request for a Variance. The applicant is requesting the variance in order to construct a storage building. This property is located on Chelsea Park Estates, Block A, Lot 15, 2811 Newkirk Court. Presiding Chairman Dube opened the public hearing. Mike Collins, Director of Planning and Development, gave a brief description of the case. The applicant, Rosana Chestain, requests consideration of a variance involving an existing storage building constructed on a concrete slab. Specifically, approximately 40 s.f. of the 16' x 16' (256 s.f.) storage building encroaches into a 7.5' private utility easement. The length of this easement is approximately 91.17' and contains 690 -- square feet. Oncor has overhead electric lines. The applicant represents that the phone service line and cable service line are not located beneath the slab. Sec. 84-85 (b) (3) of the Unified Development Code establishes that accessory buildings are not permitted when such buildings are located within any easement unless the building is portable and written permission has been given by the easement holder. Mike asked for this case to be tabled in order to provide sufficient amount of time for staff to obtain information from the private utility companies to determine if they would allow encroachment of the storage building to remain in place. Mike Collins stated the applicant, Rosana Chestain, was available for any questions. Rosana Chestain, 2811 Newkirk Court, Euless, Texas, stated the location of the storage shed does not cause any substantial or permanent damage to neighboring properties. Presiding Chairman Dube asked for any proponents/opponents to come forward for comments. Seeing none the public hearing was closed. Board Member Stinneford made a motion to table case #07-01-ZBA to a future meeting with no specific date identified, in order for the private utility companies to provide staff information on whether there are conditions under which each would find it acceptable or not to allow the structure to remain. Board Member Newell seconded the motion.
