HomeMy WebLinkAbout2008-09-25 ZONING BOARD OF ADJUSTMENT September 25, 2008 MINUTES The regular meeting of the Zoning Board of Adjustment was called to order by Chairman Luther Dube at 6:34 p.m. for consideration of scheduled items in the Council Chambers in City Hall of the Municipal Building. Chairman Luther Dube stated there was a quorum of members of the Zoning Board of Adjustment present. Mike Collins, Director of Planning and Development Chris Barker, Assistant Director of Planning and Development Holly Witt, Administrative Secretary VISITORS: Katy Roy, Barbara Polk THE PLEDGE OF ALLEGIANCE AND INVOCATION: The Pledge of Allegiance and Invocation was given by Robert Wooldridge. ITEM 1 APPROVAL OF THE MINUTES for called meeting of April 24, 2008 Board Member Crites made a motion to approve the minutes with a correction on page 3, paragraph 11: change the street name from James Park to Penoak Court. Board Member Wooldridge seconded the motion. The vote was as follows: Ayes: Chairman Dube, Board Members Wooldridge, Zimmer, Crites, Alternate Board Member Ellis Nays: None Abstention: None The motion carried 5-0-0 ITEM 2 CASE #08-02-ZBA — HOLD PUBLIC HEARING AND CONSIDER A REQUEST FOR A ZONING VARIANCE Receive public input regarding a request for a Zoning Variance for Huntington Place Addition, Block 12, Lot 1. The applicant is requesting a variance to the side yard setback requirements. This property is located at 512 Huntington Drive. Zoning Board of Adjustment Minutes September 25, 2008 Chairman Dube opened the public hearing. Mike Collins, Director of Planning and Development, gave a brief description of the case. The applicant, Ms. Katy Roy, is requesting consideration of a variance relating to the side yard building setback requirements for a single-family home located on property zoned "R1" single-family detached dwelling district. The subject property is located at 512 Huntington Drive, in the Huntington Place Addition. The Unified Development Code, Section 84-102, "R-1" Single-family detached dwelling district, Subsection (c)(6), establishes minimum side yard setback requirements of; a) Interior side yards-four feet on one side, nine feet on the other. b) Corner lot-15 feet on street side..... Specifically, the applicant seeks to make an addition to her home on the southwest corner. This addition would result in the southern side yard setback needing to be decreased from the currently platted 25 feet (and currently required 15 feet) to a distance of 5 feet. Staff recommends approval of the applicant's request that would allow the southern side yard setback to be established at 5 feet. This recommendation is based on the fact that the portion of Koen Lane located immediately adjacent to Ms. Roy's property is a dead end street, the length of which is no longer than the depth of Ms. Roy's property. The City has neither right-of-way to facilitate, nor any present or future plans to extend Koen Lane. As such, the southern property line of Ms. Roy's property functions much like an interior side yard. The UDC requirement for interior side yards is "four feet on one side, nine feet on the other". The subject property's primary structure is located well in excess of 15 feet from the northern property line. This would require the other side yard setback, per the UDC, to be a minimum of 4 feet. Ms. Roy's request for a 5 foot side yard setback would exceed that requirement. Staff supports the applicant's request, and would recommend that the ZBA authorize a variance to the side yard setback requirement. Chairman Dube asked for any proponents/opponents to come forward for any comments. Seeing none the public hearing was closed. There were no questions among the Board. Board Member Crites made a motion to approve case #08-02-ZBA as requested to allow a 5' variance on the street side of this corner lot located at 512 Huntington Drive. Alternate Board Member Ellis seconded the motion.
