MINUTES
The regular meeting of the Zoning Board of Adjustment was called to order by Vice
Chairman Ruby Anne Crites at 6:35 p.m. for consideration of scheduled items in the
Council Chambers in City Hall of the Municipal Building. Vice Chairman Ruby Anne
Crites stated there was a quorum of members of the Zoning Board of Adjustment present.

ITEM 1 ELECTION OF OFFICERS — CHAIRMAN AND VICE CHAIRMAN
Board Member Wooldridge made a motion to elect Ruby Anne Crites as Chairman.
Board Member Zimmer seconded the motion. The vote was as follows:
Ayes: Vice Chairman Crites; Board Members Wooldridge, DeVries, Zimmer, and Ellis
Nays: None
Abstention: None
The motion carried (5-0-0)
Board Member Wooldridge made a motion to elect Steven Ellis as Vice Chairman. Board
Member DeVries seconded the motion. The vote was as follows:
Ayes: Chairman Crites; Board Members Wooldridge, DeVries, Zimmer, and Ellis
Nays: None
Abstention: None

ITEM 2 APPROVAL OF MINUTES for called meeting of July 28, 2009
Board Member DeVries made a motion to approve the minutes for called meeting of July
28, 2009. Vice Chairman Ellis seconded the motion. The vote was as follows:
Ayes: Chairman Crites; Vice Chairman Ellis; Board Members Wooldridge, DeVries, and
Zimmer
Nays: None
Abstention: None

ITEM 3 CASE #09-04-ZBA — HOLD PUBLIC HEARING AND CONSIDER A
REQUEST FOR A SIGN VARIANCE
Receive public input regarding a request for a Sign Variance. The
applicant is requesting a variance to the residential real estate sign
definition and use. This property is located within the San Marino Villas
Subdivision, Block B, Lot 1, 600 Rosemead Drive.
-- Chairman Crites opened the public hearing.
Chris Barker, Director of Planning and Development, gave a brief description of the
case. The applicant, Mr. Al Aston, representing the San Marino Villas Homeowner's
Association is requesting a variance to the City of Euless Sign Ordinance to allow the
permanent construction of a real estate sign on private property. The sign proposed by
the applicant is approximately four and a half (4.5') feet tall by two and a half (2.5') feet
wide. The function of the sign would be to identify the subdivision and to be utilized by
property owners within the subdivision to dispense information on properties within the
subdivision available for sale. San Marino Villas is a gated community with a privately
maintained road network. The subdivision contains thirty (30) lots. It is the intent of the
applicant and homeowner's association to utilize the sign exclusively for the sale of
residential property and not allow individual real estate signs to be placed on the
individual lots for sale. The City of Euless has recently approved a major revision to the
Sign Ordinance. Consisting of 53 pages, this is the most comprehensive revision of the
ordinance in recent years. An effort was made by the City to expand the definitions of
typical sign usage in the community. The ordinance contains the following definition:
Sec 84-232 Definitions and Requirements
(77) RESIDENTIAL REAL ESTATE SIGN (RRES) - An on-site, temporary Stake
Sign used to advertise a home or residential property for sale or lease. A
RRES is used to advertise the name of the owner or realtor, telephone
number, property information, and/or website address.

Time - No sign permit required. A RRES may be erected 24 hours each
and every day.
Place -A RRES shall be erected only on the lot on which the home or
property is for sale or lease. A RRES shall be erected no closer than ten
(10') feet from the street pavement.
Manner- A RRES shall not exceed six (6) square feet in area. The
maximum height of a RRES shall not exceed four (4') feet. A maximum of
one RRES shall be erected on a lot.
The variance granted by the Zoning Board of Adjustment would be to:
1. Allow a permanent residential real estate sign to be located on the proposed
property.
2. Allow the sign to exceed the maximum size allowed by the residential real estate
sign.
3. Allow the sign to be located closer than ten (10') feet of the pavement.
The sign is to be located on private property, adjacent to a privately maintained road
where it will be visible from Fuller-Wiser Road. The proposed location will not create any
visual hazards or intrude into public right-of-way. The intent of the sign ordinance
revision was to increase the aesthetics of the community while maintaining an
appropriate level of accessibility to signs for residential and non-residential uses. Not all
appropriate uses of signs or sign types could possibly be considered in such an
ordinance.
Al Aston, 618 Rosemead Drive, Euless, Texas, stated with the new pavement on Fuller
Wiser Road there are new lane markings and a person would have to be in the right
lane pulling into their subdivision drive way to see the sign. They will be adding more
shrubbery around the sign and the color of the sign will blend in because it will be a
similar color. They have several people that drive through and the sign will prevent
them entering the community. The sign will give the people driving through information
on the property being sold. This sign will help sell their property and keep an attractive
subdivision. They will maintain the sign and do not want the color to fade.
Board Member Zimmer asked the applicant if there will be other postings other than real
estate.
Al Aston stated this will only be for real estate signage.
Chairman Crites asked for any proponents/opponents to come forward for any
comments. Seeing none the public hearing was closed.

Member Brown seconded the motion. The vote was as follows:
