HomeMy WebLinkAbout2018-09-11 MINUTES OF A REGULAR MEETING OF THE EULESS CITY COUNCIL Tuesday, September 11, 2018 A regular meeting of the Euless City Council was called to order by Mayor Linda Martin at 4:30 p.m. on Tuesday, September 11, 2018, in the Precouncil Conference Room of City Hall, 201 North Ector Drive. Those present included Mayor Linda Martin, Mayor Pro Tem Tim Stinneford, Council Members Jeremy Tompkins, Linda Eilenfeldt, Harry Zimmer, and Salman Bhojani. Council Member Eddie Price arrived at 4:38 p.m. During the Precouncil meeting: Mayor Linda Martin advised that the 9/11 Memorial held this morning in front of the Fire Administration Building was lovely. Additionally, she shared two recent emails from citizens praising several City departments including the Library, Texas Star, and the Planning Department. Council Member Salman Bhojani advised that he, Mayor Martin, Council Members Eddie Price and Linda Eilenfeldt, and Director of Planning and Economic Development Mike Collins attended the grand opening of Imperial Hibachi and Sushi in Glade Parks on Friday, September 7, 2018, and he was impressed with the food and service. City Manager Loretta Getchell advised that the City Council recently requested to attend a citizen emergency active shooter response class similar to the training conducted in Euless schools and requested an updated from Police Chief Mike Brown. Chief Brown advised that he is coordinating with the Hurst-Euless-Bedford Independent School District (HEB ISD) to arrange a time and date to host the class. He advised that he will provide additional details as they become available. Fire Chief Wes Rhodes announced that Assistant Fire Chief Jeff Morris has accepted the position of Fire Chief with Portland, Texas. In addition to serving as the Assistant Fire Chief, he has also served as the EMS Coordinator for the Fire Department since 2000. Effective Monday, September 17, 2018, Driver/Paramedic George Grim will be promoted to the rank of Battalion Chief and will serve as the EMS Coordinator and Health and Safety Officer for the Fire Department. Additionally, he advised that the Fire Department has contracted with HFC Services to work in conjunction with the Fire Department and Public Works Department to paint the City's fire hydrants from red to silver. Currently, the work will focus on hydrants located north of State Highway (SH) 183, along segments of Main Street, Industrial Boulevard, and Harwood Road. City Manager Getchell reviewed the regular agenda. Council Minutes Page 2 of 12 September 11, 2018 Assistant City Manager Chris Barker introduced Kelly Biegler, Public Affairs Manager, Atmos Energy, and presented the Atmos Rate Review Mechanism (RRM) update. Mr. Barker advised that the City Council had previously approved Ordinance No. 2187 on March 13, 2018, approving a tariff authorizing an annual RRM. The Atmos Mid-Tex Cities Steering Committee negotiated with Atmos to decrease the proposed system-wide revenue increase of $42 million down to $24.9 million. An item will be presented at the September 25, 2018 City Council meeting for City Council consideration to approve this increase set to take effect October 1, 2018. Finance Director Janina Jewell presented the Financial update and advised that car rental tax collections was up five percent over the same period last year (July 2018) and also up five percent year to date. Assistant City Manager Barker presented the Transportation/Midtown Express update and advised that the City is working with TxDOT and Southgate Constructors regarding lane striping issues and signal light timing in the construction corridor. Additionally, he advised that the traffic signals along Cheek-Sparger Drive and Gateway Drive are scheduled to be coordinated by the end of September. Director of Parks and Community Services Ray McDonald presented the Parks update including attendance/number of visits to the aquatic center, swimming pool, Euless Family Life Center, youth summer camps, as well as the summer facility rentals. Additionally, he highlighted the summer youth work program, and the summer track program, as well as the workmanship of Parks Manager Terry Boaz who hand built many of the outdoor features at the temporary library. Council Minutes Page 4 of 12 September 11, 2018 ITEM NO. 1. PRESENTATION OF EMPLOYEE SERVICE PINS Director of Public Works and Engineering Hal Cranor introduced Field Tech III Ross Baugess. Ross was accompanied by his wife, Tracey. Mayor Martin presented Ross with a service pin commemorating his 5 years of service with the City. REGULAR AGENDA ITEM NO. 2. HELD PUBLIC HEARING FOR SPECIFIC USE PERMIT NO. 18- 03-PD AND APPROVED FIRST AND FINAL READING OF ORDINANCE NO. 2203 Mayor Martin opened the public hearing at 7:09 p.m. Director of Planning and Economic Development Collins presented the item to the City Council and advised that the applicant, Lennar Homes, is seeking to change the zoning of 36.288 acres in the James Matson Survey, Abstract No. 1080 located at Westpark Way and West Pipeline Road from Single Family Detached Dwelling (R-1), Community Business (C-2), and Texas Highway 10 Multi-Use (TX-10) zoning districts to Planned Development (PD) zoning to allow single family residential. Lennar Homes is seeking approval of a Planned Development ordinance for a 108 lot single-family subdivision with similar design standards as approved in the Riverwalk Planned Development Ordinance No. 1904. Additionally, the Planning and Zoning Commission held public hearings on August 7, 2018, and August 21, 2018, and recommended approval of the Planned Development by a vote of 6-0-0. Land Development Manager Jack Rowe and Community Development Manager Justin Christ were present to address any questions. Jack Rowe, 3427 Cedar Springs Road, Dallas, Texas, advised that it is Lennar's intention to improve on the existing zoning for the benefit of the residents and the City with over six acres of open space. Mayor Martin asked to hear from any proponents followed by opponents wishing to speak regarding the case. Sheryl Hanisko, 2304 Christopher Lane, Euless, Texas, registered her opposition to the Planned Development and expressed concern regarding noise, heavy equipment and debris, and increased crime during the construction period as well as saving mature trees. Dennis Jones, 2304 Christopher Lane, Euless, Texas, registered his opposition to the Planned Development and expressed concern regarding the proposed density of the development, as well as the results of a traffic study. Joe Roberts, 2144 Eva Lane, Euless, Texas, registered his opposition to the Planned Development and expressed his concern regarding plans for flood mitigation and tree removal. Mayor Martin closed the public hearing at 7:31 p.m. Council Minutes Page 5 of 12 September 11, 2018 Council Member Tompkins inquired about the green space and tree coverage. Mr. Rowe confirmed that much of the green space would remain natural and native. He also emphasized that the requested Planned Development is more restrictive as opposed to what is allowed under the current zoning as the current zoning allows for as many as 115 homes. Council Member Tompkins requested that Mr. Collins confirm the next steps following approval of this Planned Development. Mr. Collins confirmed that the Planned Development case would approve the lot layout for the development. As part of the preliminary platting process, the developer will present a preliminary drainage and utility plan, and once the preliminary plat has been reviewed and approved, the developer would proceed with the civil engineering and construction plans. Council Member Bhojani referenced Ms. Hanisko's concern regarding increased crime and inquired if a study had been commissioned. Justin Christ, 910 Pinecrest Drive, Richardson, Texas, advised that Lennar has not commissioned a crime study. Ms. Hanisko advised that she has observed criminal activity during housing construction elsewhere but does not have statistics to confirm. Mayor Pro Tem Stinneford stated that Lennar, under the current zoning, would be allowed to build a greater number of homes with less green space and less restrictions. The proposed development includes less density, more green space, and is a higher quality development overall. Council Member Eilenfeldt inquired about the proposed average home value. Mr. Rowe confirmed that the average home will be sold for $400,000 or greater. Additionally, Mr. Collins confirmed that a lot layout is included as part of the ordinance as an exhibit. ITEM NO. 3. HELD PUBLIC HEARING FOR SPECIFIC USE PERMIT NO. 18- 04-SUP AND APPROVED FIRST AND FINAL READING OF ORDINANCE NO. 2204 Mayor Martin opened the public hearing at 7:43 p.m. Director of Planning and Economic Development Collins presented the item to the City Council and advised that the applicant, Glade Infrastructure LLC and Quiktrip Corporation, proposes to construct a 4,840 square foot gasoline sales and convenience store within the southern entrance to Glade Parks. The proposed store would be located at the intersection of the southbound frontage road of State Highway (SH) 121, Cheek- Sparger Road, and Rio Grande Boulevard. Additionally, the Planning and Zoning Commission held a public hearing on August 21, 2018, and recommended approval of the specific use permit by a vote of 6-0-0 with the following conditions: 1) The Specific Use Permit is tied to the Business Owner: QuikTrip Corporation; 2) The Specific Use Permit is tied to the Business Name: QuikTrip; and 3) The Specific Use Permit may be revoked if one or more of the conditions imposed by this permit has not been met or has been violated. Mayor Martin asked to hear from any proponents of the case. QuikTrip Real Estate Manager Tom Edwards, 1120 North Industrial Boulevard, Euless, Texas, expressed his appreciation to Director of Planning and Economic Development Mike Collins, Senior Planner Stephen Cook, and City staff for their assistance during the Specific Use Permit process. This would be the fourth QuikTrip store in Euless in addition to their corporate office. He advised that this store would be the first Generation 3 prototype in Euless and presented the new features of the prototype. Mayor Martin asked to hear from any opponents of the case. There being none, Mayor Martin closed the public hearing at 7:49 p.m. Council Member Bhojani motioned to approve the first and final reading of Ordinance No. 2204, a Specific Use Permit for 2.746 acres of the Jesse Doss Survey, Abstract No. 441, Tracts 4132, 6132 and portions of Tracts 4B and 613; BBB and CRR Survey, Abstract No. 204, Tracts 5, 5D and 5E; 3801 Cheek-Sparger Road for a Gasoline Sales/Convenience Store in Planned Development District (PD). ITEM NO. 4. HELD PUBLIC HEARING FOR SPECIFIC USE PERMIT NO. 18- 08-SUP AND APPROVED FIRST AND FINAL READING OF ORDINANCE NO. 2205 Mayor Martin opened the public hearing at 7:50 p.m. Director of Planning and Economic Development Collins presented the item to the City Council and advised that TxDOT purchased property from the applicant, Motel 6, for the Airport Freeway widening project. The acquisition impacted an emergency access easement on the south side of the property and in order to re-establish this easement, it was necessary for Motel 6 to demolish the far east end building. Motel 6 corporate made the decision to renovate the entire property but the hotel was constructed before the City of Euless Unified Development Code was adopted requiring all hotels to be approved by a Specific Use Permit (SUP) in the C-2 zoning districts. Recognizing that the hotel was a legally existing non-conforming use, Motel 6 corporate proposed that the City consider approval of a Specific Use Permit. Additionally, the Planning and Zoning Commission held a public hearing on August 21, 2018, and recommended approval of the specific use permit by a vote of 6-0-0 with the following conditions: 1) The Specific Use Permit is tied to the Property Owner: G6 Hospitality, LLC; 2) The Specific Use Permit is tied to the Business Name: Motel 6; 3) The hotel will be inspected by the City of Euless and maintained in accordance with applicable provisions of the City of Euless Property Maintenance Code. Information about hotel inspection standards is provided to the owner and operator; and 4) The Specific Use Permit may be revoked if one or more of the conditions imposed by this permit has not been met or has been violated. Mr. Collins advised that, in addition to the conditions listed above, Motel 6 agreed to replace a fence along the back of the property with an eight-foot wall. After the Planning and Zoning Commission meeting, they requested to build a 10-foot masonry wall and the neighboring property owners agreed to the change. Staff has recommended the inclusion of this requirement as part of the Specific Use Permit approval. Mayor Martin asked to hear from any proponents of the case. Design and Construction Principal Kyle Wyatt, 4001 International Parkway, Carrollton, Texas, expressed his appreciation to the City Council. He advised that Motel 6 has not introduced a new product in 10 years and expressed his excitement for the change to this property. Mayor Martin asked to hear from any opponents of the case. There being none, Mayor Martin closed the public hearing at 7:58 p.m. Council Minutes Page 8 of 12 September 11, 2018 Council Member Tompkins motioned to approve the first and final reading of Ordinance No. 2204, a Specific Use Permit for Municipal Service Company of Texas Subdivision, Lot AR, 110 West Airport Freeway for a Hotel in Community Business District (C-2). Council Member Price seconded the motion. APPROVED EULESS DEVELOPMENT CORPORATION BUDGET FOR FY2018-2019 Finance Director Jewell presented details of the proposed Euless Development Corporation budget for FY2018-2019. Mayor Pro Tem Stinneford motioned to approve the Euless Development Corporation (EDC) Budget for Fiscal Year 2018-2019 Council Member Eilenfeldt seconded the motion. Ayes: Mayor Martin, Mayor Pro Tem Stinneford, Council Members Tompkins, Price, Eilenfeldt, Zimmer, and Bhojani Nays: None Mayor Martin declared the motion carried. ITEM NO. 6. APPROVED FIRST AND FINAL READING OF ORDINANCE NO. 2199, ADOPTING THE CITY OF EULESS OFFICIAL OPERATING AND CAPITAL BUDGETS FOR FY2018-2019 AND AMENDING THE BUDGET FOR FY2017-2018 Finance Director Jewell presented details of the proposed City of Euless Operating and Capital budgets for FY2018-2019 as well as amendments to the FY2017-2018 budget. Council Member Bhojani motioned to approve the first and final reading of Ordinance No. 2199, adopting the City of Euless Official Operating and Capital Budgets for Fiscal Year 2018-2019, and amending the Budget for Fiscal Year 2017-2018. Council Member Eilenfeldt seconded the motion. RATIFIED THE PROPERTY TAX REVENUE INCREASE REFLECTED IN THE FY2018-2019 BUDGET Finance Director Jewell advised that a separate vote to ratify increased property tax revenue in the proposed budget is required by state law. Mayor Pro Tem Stinneford motioned to ratify the property tax revenue increase reflected in the Fiscal Year 2018-2019 budget. Council Member Tompkins seconded the motion. Ayes: Mayor Martin, Mayor Pro Tem Stinneford, Council Members Tompkins, Price, Eilenfeldt, Zimmer, and Bhojani Nays: None Mayor Martin declared the motion carried. ITEM NO. 8. APPROVED FIRST AND FINAL READING OF ORDINANCE NO. 2200 Finance Director Jewell advised that public hearings regarding the proposed tax rate of $0.4625 per $100 of assessed value were held on August 28, 2018, and September 4, 2018. Mayor Pro Tem Stinneford motioned that the property tax rate be increased by the adoption of a tax rate of $0.4625 per $100 of assessed value, which is effectively a 6.34 percent increase in the tax rate, by adoption of Ordinance No. 2200. Council Member Zimmer seconded the motion. Ayes: Mayor Martin, Mayor Pro Tem Stinneford, Council Members Tompkins, Price, Eilenfeldt, Zimmer, and Bhojani Nays: None Mayor Martin declared the motion carried. ITEM NO. 9. APPROVED FIRST AND FINAL READING OF ORDINANCE NO. 2201 Finance Director Jewell advised that Ordinance No. 2201 adopts the tax roll from the Tarrant Appraisal District. Council Member Eilenfeldt motioned to approve the first and final reading of Ordinance No. 2201, adopting the Tax Roll for 2018. APPROVED FIRST AND FINAL READING OF ORDINANCE NO. 2202 Finance Director Jewell presented the item and reviewed the proposed rate changes. She stated that the proposed rates would become effective October 1, 2018. Additionally, she advised that the proposed adjustments to the current water and wastewater fee structure are sufficient to cover the overall cost of operating the system and that the proposed rates are based on the estimated rates provided by the Trinity River Authority (TRA.) Council Member Bhojani motioned to approve the first and final reading of Ordinance No. 2202, amending the City of Euless Code of Ordinances, Chapter 30, "Fees", Section 30- 35, "Water and Wastewater Service — Monthly Rates", and Section 30-37 "Monitored Group Class." Council Member Tompkins seconded the motion. City Council Mayor Pro Tem Stinneford announced that the Euless Citizens Police Academy Alumni Association (ECPAAA) will host a fundraising barbecue benefitting the Euless Police Department on Saturday, September 29, 2018, at the Euless Senior Center from 6:00 P.M. to 9:00 P.M. Mayor Martin announced that the City Council and City staff will lay a wreath at the 9/11 Memorial in front of the Fire Administration Building immediately following adjournment. ITEM NO. 15.
