RESOLUTION NO. 95-01 CCPD
A RESOLUTION OF THE TEMPORARY BOARD OF
DIRECTORS OF THE EULESS MUNICIPAL CRIME CONTROL
AND PREVENTION DISTRICT, CALLING A SALES AND USE
TAX ELECTION TO BE HELD WITHIN THE CITY, MAKING
PROVISIONS FOR THE CONDUCT THEREOF AND
RESOLVING OTHER MATTERS INCIDENT AND RELATED
THERETO.
WHEREAS, the Euless City Council has proposed creation of a Crime Control
and Prevention District for the City of Euless, to be known as the Euless Municipal
Crime Control and Prevention District, and has appointed a board of temporary
directors for such proposed district; and
WHEREAS, on September 26, 1995, the members of said temporary board
elected a chairman from their membership; and
WHEREAS, proper notice of a public hearing on the creation of said proposed
Crime Control and Prevention District has been published as required by law, and a
public hearing has been conducted as required by Iaw on the creation of the proposed
Crime Control and Prevention District, the proposed two-year budget for said
district and the proposed crime control plan for said district; and
WHEREAS, on September 29, 1995, and following the conclusion of said public
hearing, the temporary board adopted the aforesaid two-year crime control plan and
budget plan for said district; and
WHEREAS, Section 3.02 of Article 2370c-4, Tex. Rev. Civ. Stat. Ann., provides
that after a majority of the temporary directors of a proposed district have approved
a budget plan and a crime control plan, a majority of said temporary directors may
order that a creation election be held.
NOW, THEREFORE, BE IT RESOLVED BY THE TEMPORARY BOARD OF
DIRECTORS OF THE EULESS MUNICIPAL CRIME CONTROL AND PREVENTION
DISTRICT THAT:
Section 1. The statements made in the foregoing preamble being true and
correct and being adopted hereby as findings of fact, a referendum election (the
"Election") shall be held in and throughout the City of Euless, Texas, on Tuesday,
November 7, 1995, such date being a uniform election date as defined in Section
41.001 of the TEXAS ELECTION CODE, as amended (the "Code"). At the Election
the following proposition (the "Proposition') shall be submitted to a referendum vote
of the qualified voters of the City:

The creation of the Euless Municipal Crime Control and Prevention District
dedicated to crime reduction programs and the adoption of a proposed local
sales and use tax at a rate of one-quarter of one percent.

Sectiozi, All resident, qualified voters of the City shall be eligible to vote at
the Election.
Section 3, The City shall be divided into two election precincts which precincts
and the designated polling places therefore shall be as follows:

The precinct polling places shall be open from 7:00 a.xn. until 7:00 p.m. on the date
of the Election.
Section 4. Early voting by personal appearance will begin October 18, 1995, and
shall continue through November 3, 1995, with voting times on Saturday, October 28,
from 7:00 a.m. until 7:00 p.m., and on Sunday, October 29, from 11:00 a.m. to 4:00
p.m., and Thursday and Friday, November 2 and 3, from 7:00 a.m. to 7:00 p.m. Early
voting times for other days during the early voting period shall be from 8:00 a.m. to
5:00 p.m. Early voting in person shall be conducted by Robert Parten, as Early
Voting Clerk, at the Muller Building, 600 West Weatherford Street, Fort Worth,
Texas, and by the City Secretary, as deputy early voting clerk, at Midway Recreation
Center, 300 W. Midway Drive, Euless, Texas. The Tarrant County Election
Administrator shall be responsible for early voting ballot requests by mail.
Application for ballot by mail may be sent beginning September 8, but received no
later than October 31, and mailed to:

Section 5. Voting on the date of the Election and early voting by personal
appearance, shall be by the use of a lawfully approved electronic voting system using
optically scanned ballots. Early voting by mail shall be by the use of paper ballots.
The preparation of the necessary equipment and official ballots for the Election shall
conform to the requirements of the Code.

Section 6. The Proposition shall be set forth substantially in the following form,
so as to permit the electors to vote"FOR"or"AGAINST"the Proposition, to-wit:
FOR THE CREATION OF THE EULESS MUNICIPAL CRIME
CONTROL AND PREVENTION DISTRICT DEDICATED TO
AGAINST CRIME REDUCTION PROGRAMS AND THE ADOPTION
OF A PROPOSED LOCAL SALES AND USE TAX AT A RATE
OF ONE-QUARTER OF ONE PERCENT.
Section 7. The election materials enumerated in the Code shall be printed and
furnished in both English and Spanish for use at the precinct polling places and for
early voting. Notice of the Election prescribed by this ordinance shall be
promulgated, published and posted in keeping with the Code, and as required by
Section 9 hereof.
Section 8. The election officers shall make returns for the Election in the
manner prescribed by law, and the ballots that are properly marked in conformance
with the provisions of the Code for votes cast both during the period of early voting
and on the day of the Election shall be counted in the manner required by law.
Section 9. Substantial copies of this order in both English and Spanish shall
serve as proper notice of the Election, and said notice shall be (a) published once a
week for two consecutive weeks in a newspaper of general circulation within the
City, with the first such publication occurring at least thirty five (35) days before
the Election and (b) posted not later than the 21st day before the Election on the
bulletin board used for posting notices of meetings of the City Council of the City.
Section 10. The proposed tax rate to be considered at the election is a sales and
use tax of one-quarter of one percent. Attachment A hereto is incorporated herein
and is a summary form of the approved budget plan and crime control plan to be
financed by such tax.
ADOPTED at a meeting of the Temporary Board of Directors of the Euless
Municipal Crime Control and Prevention District on the 29th day of September,
1995, by a vote of 4 ayes, 2 nays, and 1 ab entions.
