HomeMy WebLinkAbout04 2000-06-13 RESOLUTION NO. 00-04CCPD RESOLUTION OF THE BOARD OF DIRECTORS OF THE EULESS MUNICIPAL CRIME CONTROL AND PREVENTION DISTRICT, CALLING A SALES AND USE TAX ELECTION TO BE HELD WITHIN THE CITY FOR CONTINUATION OF THE EULESS CRIME CONTROL AND PREVENTION DISTRICT, MAKING PROVISIONS FOR THE CONDUCT THEREOF, AND RESOLVING OTHER MATTERS INCIDENTAL AND RELATED THERETO. WHEREAS, the qualified voters of the City of Euless in an election held on November 7, 1995 created the Euless Crime Control and Prevention District and authorized the imposition of a sales and use tax at the rate of one-quarter (1/4) of one (1) percent; and WHEREAS, under applicable provisions of the Local Government Code such sales and use tax and the existence of the Euless Crime Control and Prevention District shall terminate upon the fifth (5th) anniversary of the date the district began to levy taxes; and WHEREAS, applicable provisions of the Local Government Code authorize the Board of Directors of the Euless Crime Control and Prevention District after the fourth (4th) anniversary of the date the district was created to order a referendum on continuation of the Crime Control and Prevention District and the sales and use tax for a permitted term of years after notice and a public hearing; and WHEREAS, after notice and public hearing the Board of Directors of the Euless Municipal Crime Control and Prevention District desire to order a referendum for the continuation of the Euless Crime Control and Prevention District and the collection of the sales and use tax for a term of twenty (20) years. NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Euless Municipal Crime Control and Prevention District that: SECTION 1 The statements made in the foregoing preamble being true and correct and being adopted hereby as findings of fact, a referendum election (the "Election") shall be held in and throughout the City of Euless, Texas, on Saturday, August 12, 2000, such date being a uniform election date as defined in Section 41.001 of the TEXAS ELECTION CODE, as amended (the "Code"). At the Election, the following proposition (the "Proposition") shall be submitted to a referendum vote of the qualified voters of the City which ballot shall be printed to permit voting for or against the Proposition: PROPOSITION Whether the Euless Municipal Crime Control and Prevention District should be continued for twenty (20) years and the Crime Control and Prevention District sales tax should be continued for twenty (20) years. SECTION 2 All resident, qualified voters of the City shall be eligible to vote at the Election. SECTION 3 The City shall be divided into two election precincts which precincts and the designated polling places therefore shall be as follows: Registered voters living in County Precincts 3036, 3160, 3183, 3247, 3329, 3335, 3336, 3391, 3414, 3432, 3511, and the portion of Precincts 3175 and 3457 that are within the City of Euless limits will vote at the Euless Public Library, 201 N. Ector Drive, Euless, Texas. Registered voters living in County Precincts 3216, 3389 and the portion of precincts 3322, 3390, 3396 and 3457 that are in the City of Euless limits will vote at Bear Creek Elementary School, 401 Bear Creek Drive, Euless, Texas. Voting on Election Day, August 12, 2000, shall be conducted at two polling places, Bear Creek Elementary School, 401 Bear Creek Drive, Euless, Texas, and the City of Euless Public Library, 201 N. Ector Drive, Euless, Texas, between the hours of 7:00 a.m. and 7:00 p.m. SECTION 4 Early voting by personal appearance will begin July 26, 2000, and shall continue through August 8, 2000, at the Euless Public Library, 201 N. Ector Drive. Hours for early voting shall be as follows: Wed — Fri July 26 — 28 8:00 a.m. — 5:00 p.m. Mon —Wed July 31 —August 2 8:00 a.m. — 5:00 p.m. Thursday August 3 7:00 a.m. — 7:00 p.m. Friday August 4 8:00 a.m. — 5:00 p.m. Monday August 7 8:00 a.m. — 5:00 p.m. Tuesday August 8 7:00 a.m. — 7:00 p.m. Application for ballot by mail must be received no later than August 4, 2000, and shall be mailed to: Susan Crim Early Voting Clerk 201 N. Ector Drive Euless, TX 76039 SECTION 5 The following named persons are hereby appointed officers for said elections: Euless Public Library: Election Judge Barbara Girouard Alternate Judge Helen Harvey Bear Creek Elementary School: Election Judge Debbie Anderson Alternate Judge Lynn Price Early Voting Ballot Board: Judge Martha Burleson The Presiding Election Judge for each precinct shall appoint not less than two nor more than ten qualified election clerks to serve and assist in conducting said election; provided, that if the Presiding Judge actually serves as expected, the Alternate Presiding Judge shall serve as one of the clerks. The Early Voting Ballot Board Judge shall appoint two other members to the Early Voting Ballot Board. All appointments shall be in accordance with the terms and provisions of the Texas Election Code. Election judges and clerks shall be compensated for services rendered at a precinct polling place at an hourly rate of$6 per hour. SECTION 6 The preparation of the necessary equipment and official ballots for the Election shall conform to the requirements of the Code. SECTION 7 The ballot shall be printed substantially in the following form, so as to permit the voting "FOR" or "AGAINST" the Proposition, to-wit: FOR WHETHER THE EULESS CRIME CONTROL AND PREVENTION DISTRICT SHOULD BE CONTINUED FOR TWENTY (20) YEARS AND THE CRIME CONTROL AND AGAINST PREVENTION DISTRICT SALES TAX SHOULD BE CONTINUED FOR TWENTY (20) YEARS AT A RATE OF ONE-QUARTER OF ONE PERCENT. ADOPTED at a meeting of the Board of Directors of the Euless Municipal Crime Control and Prevention District on the 13th day of June, 2000, by a vote of 6 ayes, 0 nays, and 0 abstentions.
