HomeMy WebLinkAbout2018-09-25 MINUTES OF A REGULAR MEETING OF THE EULESS CITY COUNCIL Tuesday, September 25, 2018 A regular meeting of the Euless City Council was called to order by Mayor Linda Martin at 4:30 p.m. on Tuesday, September 25, 2018, in the Precouncil Conference Room of City Hall, 201 North Ector Drive. Those present included Mayor Linda Martin, Mayor Pro Tem Tim Stinneford, Council Members Jeremy Tompkins, Linda Eilenfeldt, Harry Zimmer, and Salman Bhojani. Council Member Eddie Price arrived at 4:33 p.m. During the Precouncil meeting: Council Member Jeremy Tompkins advised that he and his wife, Lori, participated in the Mayoral GrapeStomp at Grapevine's annual Grapefest event on Saturday, September 15, 2018, where they placed 2nd behind North Richland Hills. Additionally, he and Lori were awarded the "Most Enthusiastic" title. Mayor Linda Martin expressed her appreciation to Council Members Linda Eilenfeldt and Salman Bhojani, and Assistant to the City Manager Betsy Deck for attending the Salvation Army Mayoral Red Kettle Challenge Breakfast with her this morning. She advised that Euless will participate in the Mayoral Red Kettle Challenge on Saturday, December 15, 2018, and will be competing against nine other cities to raise money for the Salvation Army. Fire Chief Wes Rhodes announced that Division Chief Chanc Bennett will be promoted to the rank of Assistant Fire Chief. Police Chief Mike Brown announced several upcoming events: • Saturday, September 29, 2018, Euless Citizens Police Academy Alumni Association (ECPAAA) barbeque fundraiser, Euless Senior Center, 6:00 to 9:00 p.m.; • Tuesday, October 2, 2018, National Night Out, the Police and Fire Departments will attend several community events, 7:00 p.m.; and • Saturday, October 6, 2018, Public Safety Open Houses, Police and Courts Building and Fire Station No. 3, 10:00 a.m. to 2:00 p.m. City Manager Loretta Getchell announced several upcoming events: • Thursday, September 27, 2018, Police Department Swearing-In Ceremony, Police Training Room, 4:30 p.m.; • Friday, September 28, 2018, Fire Department Badge Pinning Ceremony, City Council Chambers, 3:30 p.m.; and • Thursday, October 4, 2018, Nepali Community Meeting, City Hall Precouncil meeting room, 6:30 p.m. City Manager Getchell reviewed the regular agenda. Council Minutes Page 2 of 8 September 25, 2018 Library Administrator Sherry Knight presented the Library update including the recent move to the temporary library, location, and children's programming at the Simmons Center. Additionally, she introduced Kiera Elledge, Hurst-Euless- Bedford Independent School District (HEB ISD) Coordinator of STEM and School Libraries. Ms. Elledge provided an update regarding the 3rd annual HEB Reads! Community Summer Learning Initiative for Hurst, Euless, and Bedford, including the mission, goals, and statistics from this year's program. Texas Star General Manager Glenda Hartsell-Shelton provided an update regarding the condition of the golf course following the recent rain storms as well as the plan for how the greens will be treated for winter. Golf Superintendent Scott Boven provided additional details regarding treating the greens during the winter. Assistant City Manager Chris Barker introduced Amanda Strucker, Senior Account Executive, American Municipal Services (AMS). Ms. Strucker provided a brief overview of municipal court debt collections as well as background about the company and its processes. She advised that the City of Euless has an 84 percent resolution rate for municipal court cases and a 71 percent resolution rate for utility and EMS billings. Finance Director Janina Jewell presented the Financial update and advised that sales tax is down 2.8 percent year to date and car rental tax collections are up five percent year to date. CLOSED SESSION The City Council convened into closed session at 6:08 p.m. for deliberation regarding the following: Seek legal advice from the City Attorney as authorized by Section 551.071 of the Texas Government Code related to: • Jason Patrick Jones v. PLEDGES OF ALLEGIANCE Council Member Salman Bhojani led the pledges of allegiance to the flags of the United States and Texas. ITEM NO. 1. PRESENTATION OF EMPLOYEE OF THE MONTH FOR OCTOBER Director of Parks and Community Services Ray McDonald and Recreation Manager Frank Ocampo introduced Recreation Specialist/Programs Coordinator Sonja Howard. Sonja was accompanied by her husband, Robert, son, Robbie, daughter, Jada. Mayor Martin presented Sonja with a plaque commemorating her selection as Employee of the Month for October. Mayor Pro Tem Stinneford motioned to approve the consent agenda items number 2 through 4. Council Member Bhojani seconded the motion. AUTHORIZED PURCHASE OF AUTOMOTIVE AND EQUIPMENT TIRES Authorized the purchase of automotive and equipment tires from Republic Tire & Supply, Euless, Texas, through the State of Texas Multiple Award Schedule (TXMAS) contract. The contract will be for a one year term with the option to renew annually. The estimated expenditure is $70,000. ITEM NO. 3. APPROVED RESOLUTION NO. 18-1537 Approved Resolution 18-1537, requesting financial assistance by authorizing an application to be filed with the Texas Water Development Board for a Drinking Water State Revolving Fund (DWSRF) Loan in order to provide funding for the Well Replacement Construction-Fuller and Far North project. ITEM NO. 4. APPROVED CITY COUNCIL MINUTES Approved City Council minutes of the regular meeting of September 11, 2018. REGULAR AGENDA ITEM NO. 5. AUTHORIZED MAYOR TO NEGOTIATE AND EXECUTE CONVEYANCE DOCUMENTS Council Member Eilenfeldt motioned to authorize the Mayor to negotiate and execute conveyance documents for the purchase of property located at Cresthaven Addition, Block 3, Lot 6, 1001 Highland Drive. Council Member Tompkins seconded the motion. Ayes: Mayor Martin, Mayor Pro Tem Stinneford, Council Members Tompkins, Price, Eilenfeldt, Zimmer, and Bhojani Council Minutes Page 5 of 8 September 25, 2018 Nays: None Mayor Martin declared the motion carried. ITEM NO. 6. APPROVED REQUEST FOR A TEMPORARY USE PERMIT NO. 18-04-CC Director of Planning and Economic Development Mike Collins advised that St. John the Baptist Greek Orthodox Church is seeking a Temporary Use Permit to host its' annual Mid-Cities Greek Food Fest on the church grounds. The Church has coordinated with several City departments including the Police and Fire Departments as well as the Public Works Department. Festival Chairperson Cynthia Pursley was present to address any questions. Council Member Tompkins inquired if any additional temporary lighting would be available in the nearby parking areas for festival visitors. Cynthia Pursley, 303 Cullum Drive, Euless, advised that the festival has rented additional lighting in the past and they would be doing so again this year. Council Member Price motioned to approve Temporary Use Permit No. 18-04-CC, for a Greek Food Festival to be located on Alexander and Cullum Subdivision, Lot 6R and Lot 7R, 303 Cullum Drive, for four consecutive days, October 11, 2018 and concluding on October 14, 2018. Council Member Zimmer seconded the motion. Ayes: Mayor Martin, Mayor Pro Tem Stinneford, Council Members Tompkins, Price, Eilenfeldt, Zimmer, and Bhojani Nays: None Mayor Martin declared the motion carried. ITEM NO. 7. APPROVED FIRST AND FINAL READING OF ORDINANCE NO. 2207 Assistant City Manager Barker advised that Ordinance No. 2207 is a negotiated rate increase between Atmos Energy Corporation and the Atmos Cities Steering Committee. The rate increase will take effect October 1, 2018. The average residential customer will see an increase of approximately $1.06 per month. Council Member Bhojani motioned to approve the first and final reading of Ordinance No. 2207, approving a negotiated settlement between the Atmos Cities Steering Committee and Atmos Energy Corporation, Mid-Tex Division regarding their 2018 Rate Review Mechanism (RRM) filing. Ayes: Mayor Martin, Mayor Pro Tem Stinneford, Council Members Tompkins, Price, Eilenfeldt, Zimmer, and Bhojani Nays: None Mayor Martin declared the motion carried. ITEM NO. 8. HELD PUBLIC HEARING REGARDING PLANNED DEVELOPMENT 18-01-PD AND APPROVED FIRST AND FINAL READING OF ORDINANCE NO. 2206 Mayor Martin opened the public hearing at 7:21 p.m. Director of Planning and Economic Development Collins presented the item to the City Council and advised that the applicant, Jason Rose, is requesting to rezone 4.056 acres of land located at the northwest corner of Midway Drive and Fuller-Wiser Road that is currently zoned Single Family Detached Dwelling (R-1) to Planned Development (PD). The proposed project would create 13 residential lots with the front of the homes facing Midway Road and two open space lots. All 13 lots have a detached rear-entry garage connected to the house with a breezeway and accessed by a private alley. Additionally, the Planning and Zoning Commission held a public hearing on September 4, 2018, and recommended approval of the specific use permit by a vote of 7-0-0. Applicant Jason Rose was present to address any questions. Jason Rose, 2120 Cosmos Way, Argyle, Texas, provided a brief background on the property, the proposed homes, design elements, and his reason for requesting a zoning change to Planned Development. He advised that several large 100 year old trees are currently on the property and those will be preserved in the plan. Mayor Martin asked to hear from any proponents followed by opponents of the case. There being none, Mayor Martin closed the public hearing at 7:25 p.m. Council Member Tompkins inquired about the vegetation surrounding the 100 year old trees and if it would be cleared away to allow views of the northern end of the property. Additionally, he inquired about the look and consistency of the houses. Mr. Rose confirmed that the shrubbery and growth surrounding the trees would be removed to allow greater visibility, and that there are seven different types of elevations for a home buyer to choose from and no more than two of the same type of elevation can be chosen. Council Member Zimmer inquired about the wrought iron fencing around the homes as well as the fencing along Fuller-Wiser Road. Council Minutes Page 7 of 8 September 25, 2018 Mr. Rose confirmed that all of the wrought iron fencing will be the same height and the fencing will run the length of Fuller-Wiser Road as well as allow landscaping. Council Member Eilenfeldt motioned to approve the first and final reading of Ordinance No. 2206, a request to change the zoning on 4.056 acres on Midway Square Addition, Phase Three, Block D, Lot 1 located at the northwest corner of Midway Drive and Fuller- Wiser Road from Single Family Detached Dwelling (R-1), to Planned Development (PD) zoning to allow single family residential. Council Member Tompkins seconded the motion. Ayes: Mayor Martin, Mayor Pro Tem Stinneford, Council Members Tompkins, Price, Eilenfeldt, Zimmer, and Bhojani Nays: None Mayor Martin declared the motion carried. ITEM NO. 9. APPROVED SITE PLAN NO. 18-09-SP Director of Planning and Economic Development Collins presented the item to the City Council. He advised that the applicant, Harwood Land Partners, LLC, owns 5.9 acres at the northwest corner of Harwood Road and State Highway (SH) 360. The Planning and Zoning Commission approved a Land Plan (18-01-LP) on August 7, 2018 that included this property. The Land Plan identified internal circulation, access and overall drainage issues for a six lot mixed-commercial development. The proposed site plan is for the development of two of these lots intended to be retail and/or medical office lease buildings. The Planning and Zoning Commission considered the item on September 4, 2018, and recommended approval of the Site Plan by a 7-0-0 vote. Council Member Tompkins inquired if any fencing would be constructed to separate the commercial property from the nearby single family neighborhood. Mr. Collins advised that there will be no fencing as it was not required. Mayor Pro Tem Stinneford motioned to approve Site Plan No. 18-09-SP, for Commercial Development proposed to be located on 1.3 acres of the Richard Crowley Survey, Abstract 312, portions of Tract 6A2A1 to be platted as Harwood and 360 Addition, Block A, Lots 1 and 2, 900 block of East Harwood Road. Council Member Bhojani seconded the motion. Ayes: Mayor Martin, Mayor Pro Tem Stinneford, Council Members Tompkins, Price, Eilenfeldt, Zimmer, and Bhojani Nays: None Mayor Martin declared the motion carried.
