ZONING BOARD OF ADJUSTMENTS
May 10, 2012
MINUTES
The regular meeting of the Zoning Board of Adjustments was called to order by Chairman Ruby
Anne Crites at 6:30 p.m. for consideration of scheduled items in the Council Chambers of City
Hall located at 201 N Ector Drive, Euless, Texas.

THE PLEDGE OF ALLEGIANCE AND INVOCATION: Board Member Linda Eilenfeldt gave the
invocation and led the Pledge of Allegiance.
ITEM 1: ELECTION OF OFFICERS
Board Member Robert Wooldridge made a motion to nominate Ruby Anne Crites to remain as
Chairman and Steve Ellis to remain as Vice Chair. Board Member Linda Eilenfeldt seconded the
motion. The vote was as follows:
Ayes: Chairman Crites, Vice Chair Ellis, Board Members Wooldridge, and Eilenfeldt.
Nays: None
Abstentions: None
The motion carried.
ITEM 2: APPROVAL OF MINUTES
Chairman Crites called for a motion to approve the minutes of September 28, 2010 as
presented. Board Member Wooldridge moved to approve the minutes. Vice Chair Ellis
seconded the motion. The vote was as follows.
Ayes: Chairman Crites, Vice Chair Ellis, Board Members Wooldridge, and Eilenfeldt.
Nays: None
Abstentions: None
The motion carried.
ITEM 3: CASE #12-01-ZBA - HOLD A PUBLIC HEARING AND CONSIDER A
REQUEST FOR A ZONING VARIANCE
Receive public input regarding a zoning variance for Allen M Downen Survey, A-
415, Tract 4A01, 1200 W Euless Boulevard. The applicant is requesting variance

to the front yard setback requirements and minimum lot size requirements. The
property is zoned Texas Highway 10 Multi-Use Zoning District (TX-10).
Chairman Crites opened the public hearing.
Stephen Cook, Senior Planner presented the case to the Board. Mr. Edmond Lewis is the
applicant and owner of Euless Guns and Ammo located at 1200 W Euless Boulevard.
The property was originally developed as a fuel service station. Having moved from another
location on SH 10, Euless Guns and Ammo remodeled and converted the existing structure into
retail space in 2001, The lot and structure are not compliant with the minimum standards for
front yard setback from property line and minimum lot size. These standards are set by Section
84-112(c) Texas Highway 10 Multi-Use district (TX-10) of the Euless Unified Development
Code.
TX-10 zoning requires that the front yard setback be twenty (20') feet if the whole front yard is
landscaped and thirty (30') if not all landscaped. The front portion of the existing overhang
structure is approximately fourteen (14') feet from the front property line.
TX-10 zoning requires a minimum lot size of 22,500 square feet or approximately one-half acre.
The existing lot size is approximately 17,930 square feet. Adjacent uses are a church to the
west and the City of Euless Municipal Court and Police Department on the north and east sides
of the subject property.
The parcel was developed many years before the TX-10 zoning district was adopted in 1997 as
part of the City-wide zoning change. Further, the front yard size was reduced by the Texas
Department of Transportation (TxDOT) through right of way acquisition related to the SH 10
widening in 2002.
The property owner is requesting these two variances based on the following circumstances:
the property was developed prior to the adoption of the Texas 10 zoning district; and, the
TxDOT right-of-way acquisition reduced the property in such a way as to cause the property to
not be in compliance with all applicable zoning district development standards.
The Development Services Group reviewed the case and has certified that it meets the intent of
the Unified Development Code. Staff recommends that the variances be granted because the
literal enforcement of the TX-10 standards would result in the unnecessary hardship on the
property owner due to exceptional shallowness and shape of the physical property.
Mr. Cook indicated to the Board that the applicant Mr. Lewis was in attendance in the meeting
and was available for any questions.
Chairman Crites asked if the applicant had any comments.
Mr. Edmond Lewis, 4604 Jim Mitchell TO West, Colleyville, Texas 76034 - stated that he would
like the Board to make a positive decision in this case in order to keep a positive business
environment in Euless.
Chairman Crites asked if there were any proponents or opponents to the case. Seeing none,
Chairman Crites closed the public hearing.

Chairman Crites asked the Board if there were any other comments or questions from the
Board.
Board Member Eilenfeldt told the applicant that she appreciated that he brought forward the
case to bring his property into compliance.
Board Member Wooldridge made a motion to approve the variance. Vice Chair Ellis seconded
the motion. The vote was as follows.-
