ZONING BOARD OF ADJUSTMENT
MARCH 29, 2018
MINUTES
A regular meeting of the Zoning Board of Adjustment was called to order by Chairman
Crites at 6:00 p.m. on March 29, 2018 in the Pre-Council Conference Room of City Hall,
201 North Ector Drive. Those present included Chairman RubyAnne Crites, Vice
Chairman Clarence Moore, and Board Members: Steve Elliot, Charles Cinquemani, Ron
Young, and Alternate Board Member, Carol Dufinetz.
During the Pre-Session Meeting:
• Senior Planner Stephen Cook reviewed the regularagenda.
ZONING BOARD OF ADJUSTMENT CONSIDERATION OF SCHEDULED ITEMS —
PRE-COUNCIL CONFERENCE ROOM
The Euless Zoning Board of Adjustment continued their meeting in the Council Chambers
at 6:35 p.m. for consideration of scheduled items.

THE PLEDGE OF ALLEGIANCE
Board Member Cinquemani led the pledge of allegiance.
ITEM 1. ELECTION OF OFFICERS — CHAIRMAN AND VICE CHAIRMAN
Board Member Young made a rnotion for RubyAnn Crites for Chairman and Clarence
Moore as Vice-Chairman. Board Member Elliot seconded the motion. The vote was as
follows:
Ayes: Chairman Crites, Vice-Chairman Moore and Board Members: Elliot,
Cinquemani and Young.

Nays: None.
Abstention: None
Chairman Crites declared the motion carried. (5-0-0).
ITEM 2. APPROVED ZONING BOARD OF ADJUSTMENT MINUTES
Board Member Young made a motion to approve the minutes for the regular meeting of
September 28, 2017. Vice Chairman Moore seconded the motion. The vote was as
follows:
Ayes: Chairman Crites, Vice-Chairman Moore and Board Members: Elliot,
Cinquemani and Young.
Nays: None
Abstention: None
Chairman Crites declared the motion carried. (5-0-0)
ITEM 3. HELD A PUBLIC HEARING FOR ZONING BOARD OF ADJUSTMENT
CASE NO. 18-01-ZBA
Chairman Crites opened the public hearing at 6:40 p.m.
Senior Planner Stephen Cook gave a brief description of the case. The applicant was Mr.
Scott Dennett, homeowner.
Location/Zoning: 100 Arbor Park Drive — Planned Development (PD) zoning district.
The applicant is requesting the following variance:
Variance of a twenty-five (25') foot building line established by Final Plat of the Arbor
Glen Addition No. 2.
Mr. Dennett owns a residence located at 100 Arbor Park Drive within the Arbor Glenn
Addition No. 2. Approval of the Final Plat of this subdivision was granted in August 1994.
A twenty-five (25') foot building line is established from the western boundary of the
subdivision adjacent to Main St. Mr. Dennett's residence is one of five (5) homes impacted
by this building line. This requirement applies to the west side yard of Mr. Dennett's
property and to the rear yards of the other four properties. Mr. Dennett is requesting a
variance from the twenty-five (25) foot building line requirement that would enable
construction of a 142 square foot (22' x 65) dining room addition on the west side of his

house. The addition would be located eighteen and a half (185) feet from his west
property line. We could speculate why the Arbor Glen developer proposed a twenty-five
(25) foot building line. The line may have been established to maintain sight visibility or
as a separation buffer between the homes and the traffic on N. Main Street. There is no
road intersection adjacent to the property and a six (6') foot masonry screening wall was
constructed on the west property line when the subdivision was developed. Therefore,
there are no sight visibility issues created by the proposed addition. There would be no
visual impact on Mr. Dennett's neighbor to the east at 102 Abor Park Drive. His home is
separated from his four neighbors adjacent to Main St. to the north by Arbor Park Drive.
Mr. Dennett explains in his application that fifteen (15) of the seventeen (17) property
owners who received Notice of the Public Hearing that he contacted, as well as the HOA,
are in support of his variance request. He further explains that the construction materials
used will match the existing structure, the addition will be in scale with his home and other
homes in the subdivision, and no drainage issues will be created. He also maintains that
new single-family residential subdivisions approved in recent years include fifteen (15)
foot setbacks adjacent to thoroughfares.
Staff reviewed the submitted information regarding the request for the variance and
recommended denial of the variance. Staff believes the situation could be characterized
as a self-induced hardship.
Chairman Crites asked to hear from the applicant if he wished to speak.
Scott Dennett stated to the Board that by granting him the variance, the construction of
the addition to his house would not create a life, health or safety issue with his property.
His new construction would not extend past an existing concrete slab. It is an area of his
property which is not used and the addition would add to the value of his property.
Mr. Dennett stated that the setback variance would not negatively impact the rest of the
neighborhood or the living conditions of the neighborhood. The new construction would
be in scale with the rest of the home and not be out of scale with other homes in the area.
The materials of the addition will match the primary structure.
Mr. Dennett continued to describe the gathering of signatures of his neighbors on his
street in support of the variance. He stated that the home owner's association originally
approved the addition to the home and had advised him of the need for a setback
variance.
Mr. Dennett presented several examples of newly constructed homes which hada smaller
setback distance from their subdivision walls than the distance he is requesting.
Chairman Crites asked to hear from any proponents/opponents who wished to speak.
Seeing no other comments, Chairman Crites closed the public hearing at 652 p.m.
Vice-Chairman Moore complemented Mr. Dennett on his presentation.

Board Member Cinquemani asked Mr. Dennett if the home owner's association would
have any approvals on the construction of the addition.
Mr. Dennett stated that the home owner's association approved the materials of the
addition to his home and he stated that he would comply with the home owner's
association approvals.
There were no further questions or comments presented by the Board.
Vice Chairman Moore made a motion to approve Case No. 18-01-ZBA for a Variance of
a twenty-five (25') foot building line established by Final Plat of the Arbor Glen Addition
No. 2.
Board Member Elliot seconded the motion. The vote was as follows:
Ayes: Chairman Crites, Vice-Chairman Moore and Board Members: Elliot, and
Cinquemani.
Nays: Board Member Young
Abstention: None
Chairman Crites declared the motion carried. (4-1-0)
ITEM 4. ADJOURN
There being no further business, the meeting was adjourned at 6:54 p.m
