INTRODUCTION
On September 23, 1950, voters incorporated the municipality of Euless. It was
abolished in an election on January 3, 1953. Then, on February 21, 1953, voters incorporated
the municipality again. Following is a time line of the incorporation, disincorporation (the
word commonly used for abolishing the corporation) and incorporation. Following the time line
are copies of pages from Tarrant County Commissioners' Court Minutes detailing the process,
plus copies of some pertinent newspaper articles. The newspaper articles are some that I have
had for a long time. I have not done an exhaustive search of newspapers for all articles about the
process. The time line is based manly on the Commissioners' Court Minutes and the newspaper
articles that follow.

TIME LINE
1950
August 30--In response to a petition presented to the Tarrant County Commissioners' Court by
22 Euless residents for an election to incorporate the "Town or Village of Euless", the Tarrant
County Judge orders an election to be held on September 23. (Tarrant County Commissioners'
Court Minutes, vol. 43, pp. 571-575.)
September 2-a--Election is held, with 48 votes in favor of incorporation and 19 against. (TCCC

October 2--Tarrant County Commissioners' Court certifies results of incorporation election.

November 1 1--Election of officials for the "City of Euless;" Mayor elected, R. W. Fuller; City
Marshall, E. V. Anderson; Aldermen, C. A. Horton, S. W. Mills, A. E. Tillery, W. T. Arnett, G. L.
Anderson. (it was not until November 13, 1952, that County Commissioners' Court certified

A ril 3--Euless' second municipal election is held (this is election day for most Texas
municipalities); with approval of the town aldermen, Mayor R. W. Fuller scratches his name
off the ballot after polls open; the election had been declared invalid by April 12 and a new
election ordered. (Fort Worth Star -Telegram, April 12, 1951.)
September --Mayor is Homer Fuller and Councilmen are Steve Huffman, Tracy Arnett, Comer
Horton, Albert Tillery and Troy Fuller; the City Council is negotiating with Wisenbacker, Fix &
Associates of Tyler for installation of a water system. (Fort Worth Star -Telegram, September,
1951.)
October 1--City Council grants Wisenbacker, Fix & Associates a thirty-year franchise to serve
Euless with water; city has option to purchase system six months after start of operation;
former Mayor R. W. Fuller has sold a water well to the water company. (Fort Worth Star -
Telegram, October 2, 1951.)
October S--City Fire Chief Johnnie Edwards, also Euless School Superintendent, expresses
pride in new water system, which will improve the city's fire fighting ability. (Fort Worth
Star -Telegram, Evening, October 5, 1951.)
October 17--City Council has set tax rate of $1 per $100 valuation and tax statements will be
mailed out soon for the first time. (Fort Worth Star -Telegram, October 17, 1951.)
1952
August 18--City Council discuses delinquent taxes of about $1,500, representing about 45% of
expected revenue. (Fort Worth Star -Telegram, August 15, 1952.)
November 13--County Commissioners' Court certifies election of city officials held on
November 11, 1950. (TCCC Minutes, 44:564-565; Fort Worth Star -Telegram, Morning,
December 3, 1952.)
December 3--A petition signed by Euless voters has been presented to the County
Commissioners' Court for an election to abolish the city; the tax rate is 75 cents per $100

December 10--In response to a petition presented to the County Commissioners' Court by 44
Euless voters for an election to abolish the incorporated "City of Euless," the County Judge

January --Election is held, with 43 votes in favor of abolishing the incorporated City of

February 4--Petition by Euless residents for an incorporation election is presented to County

February-6---In response to a petition presented to the County Commissioners' Court by 47
Euless residents for an election to incorporate the "Village of Euless", the County Judge orders

February 21--Election is held, with 59 votes in favor of incorporation and 27 against. (TCCC

Now, therefore, by virtue of the authority vested in me under Article 1133 et seq.
of Title 28, Chapter 11, of the Revised Civil Statutes of the State of Texas, I, Gus
Brown, County Judge of Tarrant County, Texas, do hereby order that on the 23rd day of
September, 1950, at the Public School in Euless, Texas, an election shall be held for
the purpose of enabling the inhabitants of the Town of Euless, Texas, to determine
whebher or not the said town of Euless, Texas, as designated by the map or plat attached
to aforesaid petition, shall be incorporated under the laws of the State of Texas.
It is further ordered that notice of said election shall be posed in three public
places in the town or village of Euless for at least ten (10) days before the date of
such election aforesaid as required by law.
That the polls shall be open for such election at the Public School in Euless, Texas
on September 23rd, 1950, between the hours of 7 A. M. and 7 P. M.; Mrs. S. W. Mills, wh
is an inhabitant of the town of Euless and a duly qualified elector is hereby appointed
manager and the person in charge of said election, and she shall appoint two judges and
two,olerks to assist in such election.

twenty one years, and unless he or she.snall have resided in the town or village of

town of Euless shall place upon their ballots the words "no corporation".
On or before the tenth day after such election, the person holding such election sha

age of twenty one (21) years, and all of whom have resided in said town or village of
Euless for the six months next preceding the filing of this petition and are otherwise
qualified electors under the laws of the State of Texas, do hereby respectfully petition
and request that the aforesaid town or village of Euless be incorporated under the laws
of the State of Texas, that the name of said town when incorporated be "Euless, Texas",

Tarrant County, Texas, and who being by me duly skorn each upon their oath ddposes and
says that they have personally conducted a house to house canvass and investigatlon to
determine the exact number of residents or inhabitants in the un-incorporated town or
village of Euless, Tarrant County, Texas; that said canvass or investigation was taken
only in the district or area which is to be incorporated and known as the town oe village
of Euless, Texas, which area is shown on the map or plat attached to the petition for
incorporation dated August 28, 1950; the undersigned af£iants further say that they and
each of them conducted a complete and thorough canvass and investigation to determine thl
actual number of inhabitants of the area to be incorporated as the town or village of

WHEREAS, Pursuant to an order by the undersigned County Judge of Tarrant County,
Texas, of August 28, 1950, there was held in the town of Euless, Texas, on September
23rd, 1950, an election to decide the question of whether or not the aforesaid town
of Euless should be incorporated under the laws of the State of Texas; and
WHEREAS, the total votes cast were 67 and the majority of said total votes were
cast in favor of the proposition for the incorporation of the Town of Euless, Texas,
under the laws of the State of Texas, said vote being 48 for and 19 against.
I, the undersigned County Judge of Tarrant County, Texas,do hereby order and de-
Clare that the town of Euless, Tarrant County, Texas, is, as a result of the aforesaid
election on September 23rd, 1950, from hereon henceforth an incorporated town under the

A motion was made by Commissioner Wright, seconded by Commissioner Hinton and
carried that all the proceedings of the Election for Abolishment of the Corporation of
the Town of Euless, Texas, be placed on the Minutes of the Commissioners' Court as re-
quested by County Judge, Gus Brown. Proceedings as follows:

1953, at First Methodist Church in the City of Euless, Tarrant County, Texas, an elec-
tion be held for the purpose of submitting the question of whether or not said oorpor-
ation should be abolished and dissolved to a vote of the qualified electors of said in-
corporated City of Euless;
that on the aforesaid date and place voting polls be kept open between the hours of
7:00 A. M. and 7:00 P. M., and that only those persons who are qualified under the
terms of Article 1243, Revised Civil Statutee of Texas, be allowed to vote, said
article providing in substance as follows:
'All persons who are legally qualified voters of the State of Texas and
County of Tarrant, and are resident property taxpayers in the City of Euless, as
shown by the last assessment roll of such City of Euless, shall be entitled to vote
in such eleotion.".

the County Judge of +arrant County, Texas, the returns of a certain election hereto-
fore called to be held on the 3rd day of January, 1953, to enable the qualified propert;
tax paying voters of the City of Euless to determine whether ouch corporation shall be
abolished; and it appearint to me upon counting such returns that 43 votes were cast
in favor of abolishment and 39 votes were cast against the proposition to abolish the
corporation and that such election carried in favor of such proposition to abolish the
incorporation by a majority of 4 votes;
IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED that the corporate existence of the

in Exhibits "A" and "B" attached hereto and

NOW, THEREFORE, IT IS ORDERED that an election be held on the 21st day of March,

Euless Plans to
Elect Officials
EULESS, Oct. 6.—A city elec-
tion to name a mayor, a city mar-
shal and five aldermen will be're-
quested for the middle of Novem-
ber, Walter E. Jordan, city attor-
ney of Grand Prairie, said Friday.
Jordan has been employed by
Euless citizens to handle the le-
gal phases of incorporation.
Euless voted two weeks ago
Saturday to incorporate by a
48-19 count. Only 10 of the 79
qualified voters failed to mark
ballots.
Frank F. Tipps, Euless real es-
tate man, one of the sponsors of
incorporation, said the communi-
ty wanted to incorporate so water
could be provided.
"Although our city limits touch
the city of Fort Worth on the
south at the Pipeline Road, we
did not fear annexation by Fort
Worth. We want water and we
are already talking to a Fort
Worth water company about it,"

reported Thursday.

tion is to be called after Mayor
R. W. Fuller .scratched his name
off'of all the ballots after the
polls had. opened.
Fuller said that due to illness
his physician had advised him
against xunning for mayor. ` He
said his name was 'scratched off
with approval of the aldermen.

prices for land between Euless
and the airport for residential

to purchase the water . system
after six months from the start
of operation but the hitch —the
price the Tyler firm will ask for
the plant.
The franchise will cover a 30-
year period.
The water people want to be as- :y
sured of 110 customers. Euless
had 102, but they rustled up

The firm plans to install a 75,-
000-gallon overhead reservoir,.

six-inch mains, install meters, 12

Tyler Firm Purchases
Water Well at Euless
EULESS, Oct. 2 (Spl).—A deep
water well has changed hands
here with Wisenbacker, Fix &
Associates of Tyler making the
purchase from R. W. Fuller, for-
mer mayor of Euless.
The new owners will drill a
second well, part of a plan to
assure Euless of an adequate wa-
ter supply. The East Texas firm
recently obtained a 30-,year fran-
chise to serve Euless with water.
Eight -inch lines are being con-
nected to a 250,000-gallon surface
storage tank and a large pump is
planned for the Fuller well. Op-
eration is expected in two weeks..

EULESS,. Oct. 5.—A former
basketball coach is now putting
out fires at Euless.
Fire Chief Johnny Edwards,
lately of the TWC Rams, has the
water, a fire truck and 12 brand
new fire plugs and a community
of volunteers to do the job.
Now superintendent of Euless
schools, Edwards is proud of Eu-
less' new water system.
"We didn't have any pressure
before and we'd have been in a
bad fix if we'd had a fire," Ed-
wards said, as he showed two of
his American history pupils how
to uncap a fire plug.

to Smithfield.
"Very few towns start off a
water system with eight -inch
mains," Mayor Fuller said. "If we
grow, we'll be ready and we're
going to get lower fire insurance
rates."
Euless is expecting a substan-
tial growth in 1952, when the
Greater International Airport
goes into operation.
Acreage here is being set aside
for future development for a
large housing project.
Water is going to help the home
builders obtain loans.
Also proud of the system are
Mayor Homer Fuller and his
brother, Warren Fuller, a former
mayor and former owner of the
Trinity deep . well which is now
supplying Euless with water.
Located in Warren Fuller's
back yard, the well has been tied
in with eight -inch mains, part of
the new water system installed by
Wisenbacker, Fix ,& Associates of
Tyler.
In a few days the water will be
flowing into a 250,000-gallon
ground storage reservoir, located
in north Euless on the highest
spot in town.

Tax statements will be
mailed in a -few days for the
first time at Euless. Tuesday
morning's Star -Telegram re-
ported that the statements
were being mailed at Hurst.
Mayor T. J. Page of Hurst said
his city did not have a munici-
pal tax.
Mayor Homer Fuller of Eu-
less reported that the Euless
City Council has set a $1 rate
on the $100 valuation to finance
increasing municipal expenses.

Euless to Discuss
Delinquent Taxes
At Next Meeting
EULESS, Aug. 15 (Spl).—The
Euless city council will meet at
8 p. m. Monday to discuss a
possible solution to delinquent
tax cases blocking construction
of a new Community Center
building.,
Mayor H. H. Fuller said Friday
he did not know exactly what
could be done but that some-
thing is necessary.
The taxes due —about $1,500--
represent about 45 per cent of
expected revenue.
The proposed building will
house the fire department and
provide office space which will
be rented to business concerns.
The building will serve as a social
and civic center.

County Examines Petition
To Disincorporate Euless
The county tax office was
checking late Tuesday on the
validity of signatures on a peti-
tion filed by Euless residents
seeking disin corporation of the
city.
The petition, signed by 47 per-
sons, was filed in the office of
County Judge Gus Brown earlier.
County Assessor -Collector Stew-
art must determine whether the
signatures are those of qualified
property owners before an elec-
tion can be ordered.
S. W. Mills, defeated for alder-
man in April, circulated the pe-
tition for dis incorporation. He
also was one of the persons who
circulated a petition to incor-
porate in 1950.
The city was incorporated
Sept. 23, 1950, after a special elec-
tion. The action was not ap-
proved until Nov. 13, 1952, when
the results of the election were
presented to Commissioners
Court.
Mills contends that residents
of Euless are not receiving serv-
ices in proportion to taxes paid.
A city official said that while
very little in services has been
offered the residents, plans for
the future call for an expanded
municipal program including a
new fire truck, a fire house and
police protection.
"We had hoped some day to
build a city hall and operate like
a city should be operated," he re-
ported.
Other city officials said disin-
corporation will mean the loss of
the present municipal tax of 75
cents per $100 valuation.
