HomeMy WebLinkAbout1983-05-23 l� C — ZONING BOARD OF ADJUSTMENTS MEETING City of Euless 201 North Ector Drive Euless, Texas — May 23, 1983 CALL TO ORDER The Zoning Board of Adjustments (ZBA) Meeting was called to order at 7:40 p.m. MEMBERS PRESENT MEMBERS ABSENT Marland Ernest Charles Smith Helen Lightbody Sam Huston Ralph Gibson _ Bill Pasteur - Alternate Frank Douglass - Alternate INVOCATION The invocation was given by Mr. Marland Ernest. ELECTION OF CHAIRMAN _ Inasmuch as the ZBA had not met since May 28, 1980, and new members nad been appointed to the ZBA, the first order of business was the election of a Chairman. Mr. Gibson made a motion to elect Marland Ernest as Chairman to preside over the meeting. Mrs. Lightbody seconded the motion. There being no additional nominations, Bill Pasteur moved to elect Marland Ernest Chairman by acclamation, the vote is as follows: Ayes: Mrs. Lightbody, & Messrs. Gibson, Douglass & Pasteur Nays: None Abstentions: Mr. Ernest I I. PUBLIC HEARING - REQUEST OF MR. DAVID MARYOL WITH H & M CON- - STRUCTION COMPANY, INC., FOR A VARIANCE TO THE MINIMUM SIDE YARD REQUIREMENTS Mr. David Maryol, President of H & M Construction, explained that when he first began building in Euless he understood that there was a four foot (4') and nine foot (9') side yard requirement, but mainly for the reason to maintain thirteen feet (13') between Page Two - ZBA t`( ting - May 23, 1983 homes. When he applied for a building permit for 1402 Timber Ridge, he was told that the thirteen foot (13') minimum no longer applied. He then assumed that the four foot (4') and nine foot (9') requirement did not apply. He stated that he then centered the foundation on the lot leaving side yards of 6' 5-1/2" on the left and 6' 9-1/2" on the right and a distance of 11' 4" between the home on the right and 17' 4" between the home on the left. Because the proposed foundation has forms set, poured piers, sand, rough-in plumbing, graded beams, and steel and brick ledges attached, he is asking that a variance be granted regarding the nine foot (9') side yard requirement. -- There being no additional comments from the audience, the public hearing was closed. Each of the board members agreed that the petitioner had made a mistake by not _ checking into the ordinances further, and there was concern about the limited access to the rear should the prospective homeowner decide to build a pool or extend the drive to the rear. Mr. Gibson made a motion to deny the request for a variance of the minimum side yard requirements. Mrs. Lightbody seconded the motion, and the vote is as follows: Ayes: Mrs. Lightbody & Messrs. Ernest, Gibson, Pasteur & Douglass Nays: None Chairman Ernest declared the motion carried. III. ADJOURNMENT There being no further business to be discussed, the meeting adjourned at 7:57 p.m. Chairman
