ZONING BOARD OF ADJUSTMENT

CALL TO ORDER
The meeting of the Zoning Board of Adjustment was called to
order by Chairman Kerry McCombs at 6:00 p.m. , in the Council
Chambers of the Municipal Building.

APPROVAL OF MINUTES
The minutes of the previous meeting of June 5, 1990, were
approved as written.

ZBA-#90-04 - REQUEST OF DON TIPTON, INC. , CONSULTING ENGI-
NEERS, FOR A VARIANCE TO SECTION 7-1000 (5) OF THE EULESS
ZONING ORDINANCE WHICH SPECIFIES THE MINIMUM LOT WIDTH
REQUIREMENT IN A SINGLE FAMILY ZONING DISTRICT (R1) IS 65
FEET
Mr. Greg McCall, Don Tipton Engineers, Inc. , informed the
Board Members that the Developer was in the process of
replatting this addition to conform to single family hou-
sing. The property is zoned R-1-A (Single Family) , and was
originally platted for 50 units. Replatting the property to
conform to single family housing requirements will reduce
the number of units to 25. The variance requested is for
three lots, 6R, 7R, and 9R, Block B, Sunshine Meadows
Addition, which will be one foot less than the required 65'
lot width. Mr. McCall explained that the Planning & Zoning
Commission and City Council had approved the replat, P-#90-
05, provided the Zoning Board of Adjustment granted the
variance on the three (3) non-conforming lots.
Mr. Massey made a motion to approve ZBA-#90-04.

Chairman McCombs declared the motion carried.

ZBA-#90-03 REQUEST OF MR. & MRS. G. G. STONEKING, 1103
PRINCETON, FOR A VARIANCE TO THE REAR YARD REQUIREMENTS OF A
PLANNED DEVELOPMENT, ORDINANCE #908, WHICH SPECIFIES A
MINIMUM REAR YARD OF 15 FEET
Mr. & Mrs. Stoneking explained that they were requesting
this variance for the patio cover they recently had instal-
led. Browns Awning was the contractor hired to do the work,
and this company never informed the Stoneking's that the
City required permits or had setback requirements. The
Stoneking's informed the board members that this patio cover
cost approximately $800.00.
Mr. Sims asked the Stoneking's if the patio cover could be
detached from the house.
The Stoneking's explained that they did not see a way to
'''^ detach the cover from the house and maintain the effect for
which they had paid. Mr. Stoneking explained that he is ill

and cannot travel in the car, nor can he tolerate sunshine
or heat. Covering his patio so that he may sit outside is
the only way he gets out of the house.
The board members were concerned that they would be setting
a "precedence" for the rest of the addition if they approved
the variance for the Stoneking's but, they also felt that
the Stoneking's situation would create a "hardship" for them
financially if asked to remove the cover. The board members
asked if the Building Official could contact the contractor
responsible for this and let him correct the problem.
Mr. Craig told the Commissioners that the Building Official
would send a letter to the contractor explaining that a
permit is required for the patio cover installation at 1107
Princeton, and that it was encroaching on setbacks. The
letter will inform the contractor that it will be in his
best interest to come in and register with the City, pull
the necessary permit and correct the cover on the Stone-
king's patio. If the contractor doesn't respond within a
specified time frame (i.e. , 5 days), the contractor will be
informed that further legal actions could be pursued.
Mr. Massey made a motion to approve the variance requested
by the Stonekings.
The motion died for lack of a second.
Mr. Sims explained that he did sympathize with the Stone-
kings situation but he did not think the variance should be
approved. He stated that the Stoneking's have recourse,
legally, with the contractor.
Mr. Sims made a motion to deny the variance requested at
1107 Princeton.
Mr. McCombs seconded the motion and the vote was as follows:
Ayes: Messers. Sims, McCombs, Huneycutt, and Massey
Nays: None
Chairman McCombs declared the motion carried.

ZBA-#90-02 - REQUEST OF MIDWAY BARBER SHOP, 603 WEST EULESS
BOULEVARD, FOR A VARIANCE TO SECTION 7-502 OF THE EULESS
ZONING ORDINANCE WHICH REQUIRES A 20' FRONT YARD SETBACK IN
A COMMERCIAL ZONE (C-2), AND SECTION 8-500 (1) WHICH RE-
QUIRES AN ALL-WEATHER SURFACE PARKING LOT
Mr. Todd Stroud, Midway Barber Shop, explained that a friend
of his, who is also a contractor, did the remodeling for
him. The contractor told Mr. Stroud that he had obtained
all necessary permits and everything had been approved. Mr.
Stroud assumed that since the building permit had been
issued, everything was acceptable.
Mr. Stroud then explained that he was requesting a variance
to leave the parking lot covered in gravel at least until
the work on S.H. 10 was complete.
Chairman McCombs explained that the Zoning Board of Adjust-
ment has no authority over the parking lot. The parking lot
is grandfathered and the only variance this board will be
able to grant for Mr. Stroud is the building encroachment.
Mr. Sims made a motion to approve the variance requested by
the Midway Barber Shop.

ADJOURNMENT
There being no further business to conduct, the meeting
