HomeMy WebLinkAbout1992-09-08 MaN TIES ZONING HOARD OF ADJUSTMENTS SEPEEMEER 8, 1992 The regular meeting of the Zoning Board of Adjustments was called to order by Acting Chairman Harland Ernest at 5:35 p.m. , in the Council Chambers of the Euless Municipal Building. Acting Chairman Ernest explained the rules governing a public hearing and opened the hearing for the carport variance located at 105 Stony Creek Drive. Ms. Carol Orgain, 105 Stony Creek Drive, Euless, introduced Mr. Lanham, the contractor. Mr. Chuck Lanham, 6604 Betty Drive, Watauga, advised the Board that Ms. Orgain is requesting a variance from the side and rear yard setbacks for the installation of a carport for the protection of her vehicle. He stated that this is a dawn-sized lot size. The property is located at a curve in the street which required the house be set back farther than most in the neighborhood. The proposed carport would be located close to the house but not attached to it. Mr. Lanham advised the Board the proposed structure would be a pre-fabricated steel carport which would enhance the property and he also stated there are no utility easements on that side of Ms. Orgain's lot. Ms. Orgain stated she prefers proposal #2 as her first choice should the Board approve the variance. Proposal #2 is for a six (6) inch side yard and seven (7) foot rear yard. Acting Chairman Ernest asked for further opponents/proponents. There being none, he closed the public hearing and called for discussion among the board members. Mr. Massey motioned to approve the request as presented for proposal #2. Mr. Poole seconded the motion and the vote was as follows: Ayes: Messers. Massey, Poole, Huneycutt and Ernest Nays: None Acting Chairman Ernest declared the motion carried. II. CC SIDER 'DIE REQUEST C*' MR. JOSEPH J. Acting Chairman Ernest opened the public hearing for a carport variance located at 407 Walden Trail. Mr. Joseph Tirado, 407 Walden Trail, Euless, stated he was in the process of constructing the carport when he was told to stop the project due to not having obtained a permit. He stated he is doing the construction himself and he is asking for a variance to his side yard along a twenty-seven (27) foot stretch. He plans to attach an overhead carport to the side of the house and stated the carport would be supported by four (4) steel posts and four (4) 2" x 4" beams. He has already built up his concrete drive and taken care of the slope on the north side of his property. Originally he was building the carport to house his boat but he has moved the boat into storage. Mr. Tirado stated he has had problems with drainage in the past due to the slope, but it has been corrected. Acting Chairman Ernest asked for any other proponents. There being none, he asked for any opponents. Mr. Gary Roskydoll, 405 Walden Trail, advised the Board he lives next door to Mr. Tirado and he is opposed to the variance. He stated he objects to the carport being built due to the structure not being very sound and it is also not aesthetically pleasing to the neighborhood. Mr. Roskydoll is afraid the structure will not be maintained and after time it will look run dawn and reduce the value of all the hones in the neighborhood. PIING SEPTEMBER 8. 1992 - PAGE: THREE II. Mr. Guy Clay, 400 Walden Trail, Euless, wants to keep the property values up in the neighborhood and he is afraid the structure will be a detriment to the surrounding hones. Mr. Gary Dobiyanski, 402 Walden Trail, Euless, advised the Board the proposed structure seems to be more of a shed type structure and he feels the structure would deteriorate over a period of time. Acting Chairman Ernest closed the public hearing and called for discussion among the board members. Chairman Ernest reiterated to the Board and the audience that the ZBA could grant a variance only for such reasons as restricted shape, slope or area of the lot or due to an unnecessary hardship. There being no further discussion, Acting Chairman Ernest called for a motion. Mr. Massey made a motion to deny the variance requested at 407 Walden Trail. Mr. Huneycutt seconded the motion and the vote was as follows: Ayes: Messers. Massey, Huneycutt, Poole and Ernest Nays: None Acting Chairman Ernest declared the motion carried.
