HomeMy WebLinkAbout1993-05-03 MINUTES ZONING BOARD OF ADJUSTMENTS MAY 3, 1993 The regular meeting of the Zoning Board of Adjustments was called to order by Chairman Marland Ernest at 6:00 P.M. , in the Council Chambers of the Euless Municipal Building. The Pledge of Allegiance was led by David Massey. The invocation was given by Martin Case, Jr. MEMBERS & STAFF PRESENT MEMBERS ABSENT Marland Ernest none David E. Hennig, Director of Development & Operations Rod Tyler, City Planner Barbara Chambers, Staff Secretary VISITORS Mr. and Mrs Erle Breithaupt I. CONSIDER REQUEST OF Mt. ERE W. BREITHAUPT, FOR A VARIANCE TO THE MINIMUM OFF-S1REET PARKING REQUIREMENTS FOR R-1 (SINGLE FAMILY DETACHED DWELLINGS). THIS PROPERTY IS LOCATD AT 705 EAST CLIFF DRIVE. Chairman Ernest opened the public hearing for the request for a variance located at 705 East Cliff Drive. Mr. Erle W. Breithaupt, 705 East Cliff Drive, was present for the variance to the minimum off-street parking requirements for R-1. He stated that he has lived at this address for nineteen years and the last four to five years he and his wife had contemplated enclosing the garage to accommodate their hobbies. Mr. Breithaupt stated that he was unaware that he needed a permit to enclose his garage until the project was 98% completed. Mr. Breithaupt stated that out of the nineteen years they have been Euless residents, they had never broken the law or even received a traffic citation. __. Chairman Marland Ernest asked Mr. Breithaupt if he knew or had studied the ordinance, after he found out that he needed a Building Permit, in order to understand what the off-street parking requirements were. — ZONING BOARD OF ADJUSTMENTS - MAY 3, 1993 - PAGE TWO Mr. Breithaupt stated that he had not read the exact ordinance, however, he planned to park his cars in the driveway. He stated that they had never parked their cars in the garage. The garage has always been used for hobbies and that was the reason for the enclosure. Board Member, Daniel Grant, stated that the ordinance that surrounds this type of issue is basically to prevent building a garage enclosure that does not meet the ordinance requirements. He stated that the ordinance is to guard the well being of the general public well past the time a homeowner occupies the property. He further explained that this is the reason that a permit is required because it gives opportunity for citizens that are unaware of the ordinances to be confronted with what can and can not be done. Mr. Grant asked Mr. Breithaupt if City Officials had discussed what his options were. Mr. Breithaupt replied that he had received a letter stating that his options were 1) . Deny the request; 2) . Approve the variance as requested; 3) . Approve the request with conditions. Mr. Breithaupt stated that the conditions had already been met to include a landscape buffer between his house and the neighboring property to soften the view. Alternate Board Member, Martin Case, stated that by looking at the plat drawing on Lot 28, it is visibly clear that the lot is shorter than the rest of the lots. This gives little back yard and the side access is almost non-existent. Mr. Case stated that this lot is different compared to the surrounding lots. He further informed the Board that he felt since the lot was different in shape and size this was reason for granting the request. Board Member, Daniel Grant, asked City Planner, Rod Tyler, in the event this variance request was approved, does the applicant have to obtain a permit and go back through the inspection process. Rod Tyler stated that he would. The motion was made by Charles Poole and seconded by David Massey, to grant the variance as requested, due to the unusual lot size and shape. Board Member, Bill Williams, made the motion for an amendment to the original motion, to include the condition of a hedge to be placed along the tree line on the east side of the driveway. The motion for the amendment died, due to a lack of a second. The vote on the original motion was as follows: Ayes: Massey, Williams, Grant, Poole Nays: Ernest The motion carried. Mr. and Mrs. Breithaupt thanked the Board for their decision and stated that it was never their intention to break the law or try to avoid the City ordinance. ZONING BOARD OF ADJUSTMENTS - MAY 3, 1993 - PAGE THREE Board Member, Charles Poole, recommended that a brochure containing informa- tion about the permit process and building requirements, be placed in the water bills or the Mayors Newsletter, to inform citizens about their responsi- bilities. APPROVAL OF MINUTES The motion was made by Bill Williams and seconded by Daniel Grant to approve the minutes of the April 5, 1993 meeting of the Zoning Board of Adjustments. Ayes: Massey, Williams, Grant, Poole, Ernest Nays: None The motion carried. ADJOURNMENT: There being no further business the meeting was adjourned at 6:40 P.M.
