HomeMy WebLinkAbout1994-08-30 MINUTES ZONING BOARD OF ADJUSTMENTS AUGUST 30, 1994 The regular meeting of the Zoning Board of Adjustments was called to order by Vice Chairman Bill Williams at 6:00 P.M. in the Council Chambers of the Euless Municipal Building. The Pledge of Allegiance was led by Jack Hill. The invocation was given by David Massey. Nevares APPROVAL OF MINUTES The minutes of the previous Zoning Board of Adjustment meeting were unanimously approved as written. REGULAR AGENDA ITEM 1. Request of Mr. and Mrs. Jose R. Nevares, 1703 Pleasant Trail for a variance to the minimum rear yard setback requirements as specified on the filed plat of record. Vice Chairman Bill Williams explained the Zoning Board of Adjustments meeting format and Explained that the decision on this case could be one of the following decisions: 1.) Approved as proposed, 2.) Denied, 3.) Approved with variation to the request. ZONING BOARD OF ADJUSTMENT MEETING - PAGE TWO AUGUST 30, 1994 I. Randy Byers, Director of Public Works and Development introduced the request for a variance to the minimum rear yard set back requirements. Mr. Jose Nevares, 1703 Pleasant Trail, stated he and his family had lived in this home for eight years. Mr. Nevares stated over the past few years he has sustained carpet, baseboard, door frames and numerous other damage from the sun as the back of his home is to the west. The shape and floor design of the other homes in the neighborhood as well as the position on the lot differs from his, thus allowing them to construct a patio cover. Also, the 25' buildng line does not affect these other homes as it does his. The 25' building line runs through the middle of the concrete patio which is ten feet in length, six feet from the rear of the house. Board Member, Martin Case stated he did not have a problem with the patio cover, however, he wanted to be assured that the patio would never become enclosed. Vice Chairman Williams discussed alternative methods with Mr. Nevares and asked if he had considered a 6' ft. patio cover instead of the proposed 10' ft. Mr. Nevares stated since the patio already was 10' ft. and the patio cover would cover too small of an area. Mr. Nevares also stated that the other homes were in compliance when the patio covers were constructed because they were not affected by the 25' building line. Mrs. Nevares informed the Board of their high utilities due to the heat from the west sun. She also stated the need for a patio cover was for privacy and safety. She and her small children had been watched by a stranger looking over the fence and if the cover was added they could not have seen the children in the yard. She added that awnings were too expensive and would not have matched the design of the house as well as the patio cover. Vice Chairman Bill Williams closed the Public Hearing for discussion among the Board Members. Board Member Martin Case made the motion to approve ZBA Case#94-01 - Variance to the rear yard setback at 1703 Pleasant Trail with the restriction that the patio is not to be enclosed at any time in the future. Board Member David Massey seconded the motion. Board Member Jack Hill asked for an amendment to the motion by adding the statement that the homeowner is responsible for informing any new buyers of the property that there shall never be an enclosure to this property. The original motion and second was withdrawn. Board Member Jack Hill made the motion to appove ZBA Case #94-01 with the restriction that ZONING BOARD OF ADJUSTMENT MEETING - PAGE THREE AUGUST 30, 1994 subject property cannot be enclosed at any time and the burden is placed on the present owner to make the restriction known to any future buyer of the property. The motion was seconded by Martin Case. The vote was as follows: Ayes: Board Members Hill, Case, Massey, Williams Nays: None The motion carried.
