ZONING BOARD OF ADJUSTMENTS
SEPTEMBER 9, 1996
The regular meeting of the Zoning Board of Adjustments was called to order by Vice-
Chairman Jack Hill at 6:00 p.m. in the Council Chambers of the Euless Municipal
Building. The Pledge of Allegiance and Silent Invocation was given by Eddie Price.

ITEM I. APPROVAL OF MINUTES
Board member Eddie Price made the motion to approve the minutes of the
August 12, 1996, Zoning Board of Adjustments meeting as presented and
the motion was seconded by Board member Bill Williams. The vote was
as follows:
Ayes: Board Members Jack Hill, Curtis Wallace, Bill Williams, Eddie Price,
Roger Bates
Nays: None
The motion carried.

ITEM II. ZBA #96-06 - LOT 23R, BLOCK D, CHELSEA PARK ESTATES
Request of Mr. & Mrs. David Holsinger for a variance to the minimum
required side yard setback requirements of Planned Development#973, for
a carport located at 2699 Scrimshire Court.
Vice-Chairman Jack Hill opened the Public Hearing and asked Rod Tyler, City Planner,
to give the presentation.
Rod Tyler stated that this case was a reconsideration of ZBA case#96-06-Lot 23R, Block
D, Chelsea Park Estates. This case was previously heard by the Zoning Board of
Adjustments on August 6, 1996, in which the vote to approve the request was announced
in error. A variance request is required to be heard by a minimum of four members of
the ZBA and also require four concurring votes to grant a variance to the ZBA. The vote
was 3 to 2, 3 to favor the variance and at that the audience concerned with the case
walked out believing the variance had been granted. It was later brought to attention that
it required 4 concurring votes. Basically it was announced in error that a variance had
been granted. One of the members on the prevailing side not in favor of granting the
variance, Mr. Bill Williams wrote a letter in which he requested the item to be reheard in
order to give the applicants a chance in hearing what conclusion the board reached. The
reconsideration means that the board members are not bound by their previous decision
making this a new public hearing.
Rod Tyler also stated that re-notifications had been mailed out to property owners within
200 feet of this request. He also mentioned that the Development Review Committee has
reviewed it and found that the application has been submitted in proper form to warrant
review by the Zoning Board of Adjustments.
Vice-Chairman Jack Hill asked the applicant to come forward and state his request. Mr.
David Holsinger stated that he and his wife purchased the house about two years ago
and have enjoyed living in Euless. The house is unusual and does not have an attached
garage. There was a large concrete area around towards the back for parking. He and
his wife decided putting in a garage/carport in that area. They consulated with a
contractor and after arriving at a financial agreement covering labor, materials, any
required City permits, the two-vehicle shed was build on the existing pad. It was not until
inspections on a swimming pool being built that it was discovered that the carport had
been built one (1) foot off property line. Mr. Holsinger mentioned Sec. 8427 of the Euless
Code of Ordinance authorizing the Zoning Board of Adjustment to grant variances to the
zoning district standards provided they find certain conditions satisfied. Of the three major
division in that section, two were satisfied in the first meeting,(1) the public convenience
and welfare is not prohibited and (2)this building does not prohibit the City of Euless to
�-- provide police, fire or water service to the general public nor does it effect drainage.
Whatever the outcome of the meeting, Mr. Holsinger stated that he and his wife would
abide by the boards ruling.
Mr. Paul Peters, 2701 Scrimshire Ct. stated that he supported Mr. and Mrs. Holsinger in
their request and would like to see an approval by the board.
There being no opponents to the request, Vice-Chairman Jack Hill closed the Public
Hearing and opened the item up for discussion among the board members.
Board member Bill Williams commented on the uniqueness of the property.
Board member Eddie Price mentioned that it would be a hardship to the owners to move
the carport and that their neighbors had been in favor of Mr. & Mrs. Holsingers request
in the first meeting.
The motion was made by Eddie Price to approve the variance. The motion was
seconded by Roger Bates. The vote was as followed:
Ayes: Board members Roger Bates, Eddie Price, Curtis Wallace, Bill Williams
Nays: Jack Hill
The motion carried.
ADJOURNMENT:
There being no further business the meeting was adjourned at 8:16 P.M.
