HomeMy WebLinkAbout1997-06-26 MINUTES ZONING BOARD OF ADJUSTMENTS JUNE 26, 1997 The regular meeting of the Zoning Board of Adjustments was called to order by Chairman Jack Hill at 6:00 p.m. for consideration of scheduled items in the Council Chambers in Building"B"of the Municipal Building. The Pledge of Allegiance and Invocation was given by Bill Williams. VENEERS AND STAFF PRESENT: ABSENT: Chairman Jack Hill Eddie Price Fred Bowen Victor Blood Roger Bates Bill Williams Kevin Mercer, Development Services Manager Donna Brown, Staff Secretary Dolores Tijerina, Staff Secretary VISITORS: Randy Hayes Charlene McKinzie Tom Trowbridge Adele Trowbridge Eleanor Jones Jack Mapes Mike Sullivan Gary Caldwell Mike Lawrence Glenn Moon Albert Davis REGULAR AGENDA APPROVAL OF MINUTES Board Member Bill Williams made the motion to approve the minutes of April 17,1997, Zoning Board of Adjustments meeting as presented and the motion was seconded by Board Member Victor Blood. The vote was as follows: Zoning Board of Adjustments Page 2 June 26, 1997 Ayes: Board Members Jack Hill, Roger Bates, Bill Williams, Fred Bowen, Victor Blood Nays: None The motion carried. ITEM I. PUBLIC HEARING - ZBA#97-03 - 407 DICKEY DRIVE Public input regarding the request of Mr. Thomas Trowbridge for a variance to the 25 feet platted building line and the 15 feet minimum side requirement of the R-1 zoning district for the property located on Lot 13, Block 3, Oak Crest Estates Addition. Chairman Jack Hill opened the Public hearing and asked Kevin Mercer, Development Services Manager, to give the presentation. Kevin Mercer stated that Mr. Trowbridge was requesting a variance to the 25 feet platted building line and the 15 feet minimum side yard requirement of the R-1 zoning district. Chairman Jack Hill asked the applicant, Mr. Trowbridge, to address the members and audience. Mr. Trowbridge stated he was requesting the variance to replace the cover which had deteriorated with a unit of heavy gate steel. Board Member Victor Blood asked why there was a 25 feet side yard where other subdivisions of the same age have a 15 feet side yard. Kevin Mercer stated when this property was originally platted and developed it was in the City of Ft. Worth. It was deannexed from Ft. Worth and annexed into the City of Euless. Board Member Bill Wlliams asked how much of a deviation would there be. Kevin Mercer stated that it would be the full 25 ft deviation from the platted building line and a 15 ft. deviation from the minimum zoning requirement. Chairman Jack Hill stated this would be a 50% deviation. There being no opponents or proponents, Chairman Jack Hill dosed the Public Hearing and opened the item up for discussion among the Board Members. Board Member Bill Wlliams stated the degree of deviation was substantial and the property previously had a carport and once a non-conforming use was done away with, there was not an automatic right of replacement. Board Member Victor Blood stated that he had a problem with 100%encroachment. Board Member Fred Bowen stated he had an issue with the degree of non-conformity regardless of it being side yard or front yard. Chairman Jack Hill called for a motion for ZBA #97-03. Board Member Roger Bates made the motion to deny the variance. The motion was seconded by Board Member Fred Bowen. Nays: None ITEM II ZBA#97-04 - 1314 EL CAMNO REAL Public input regarding the request of Mike Sullivan for a variance to the 25 feet minimum side and rear yard requirements of the PD #379 for the townhouses located on Lot D, Block 2, Avante Townhomes Addition. Chairman Jack Hill opened the Public hearing and asked Kevin Mercer, Development Services Manager, to give the presentation. Kevin Mercer stated that Mr. Mike Sullivan was requesting a variance to the 25 feet side and rear yard setback required for his property. The property is under Planned Development #379 district standards for townhouses requiring 25 feet setbacks. Chairman Jack Hill asked the applicant to come forward and state his request. Mr. Mike Sullivan stated he had built a closet on the rear of the existing townhouse zero feet from the side property line and approximately 9.5 feet from the rear property line. The patio cover also encroached into the 5 feet utility easement along the rear property line. Mr. Sullivan stated he had a 8 feet fence and his backyard was not visible. Chairman Jack Hill called for proponents and opponents. Mr.Gary Caldwell, 1308 El Canino, didn't have a problem with the structures that Mr. Sullivan had added to the property. Mr. Mike Lawrence, 1312 El Camino, stated that Mr. Sullivan had been able to make good use of a small backyard. Mr. Lawrence did not have a problem with the structures. Mr. Glenn Moon, 1316 El Canino, stated he had no problem with the structures and the improvements have enhanced the property. Chairman Jack Hill introduced a letter signed by Mr. Don Brooks, 1312 El Camino, in favor of Mr. Sullivan's structures. Mr. Jack Mapes, 1303 VVoodvine, felt the issue was not how good the structures looked but it was constructed without obtaining the authorization from the City. Mr. Mapes stated the addition would negatively affect property values. Zoning Board of Adjustments Page 4 June 26, 1997 Mrs. Eleanor Jones, 1301 Woodvine Dr., stated she was in support with Mr. Mapes. Chairman Jack Hill dosed the public hearing and opened the item for discussion among the Board Members. Board Member Victor Blood stated he did not have a problem with the patio cover but had some concerns with the doset and egress. Board Member Roger Bates stated he does not have a problem with the patio cover existing the way it is. Board member Bates asked if there was a height requirement that had to be met? Kevin Mercer, Development Services Manager, replied No. There being no further proponents or opponents, Chairman Hill dosed the Public Hearing. Board Member Fred Bowen made the motion to approve Case #ZBA 97-04 variance request. The motion was seconded by Board Member Roger Bates. The vote was as follows: Ayes: Board Members Hill, Blood, Bowen, Bates, Williams Nays: None The motion carried. ITEM III. ZBA#97-05 - 507 OAKINOOD DRIVE Public input regarding the request of Albert Davis for a variance to the 25 feet minimum front yard requirement of the R-1 zoning district located on Lot 19-R, Block 3, Oakwood Terrace Addition. Chairman Jack Hill opened the Public Hearing and asked Kevin Mercer, Development Services Manager, to give the presentation. Kevin Mercer stated the applicant, Mr.Albert Davis, was requesting a variance to the 25 feet minimum front yard requirement to construct a carport in front of the residence. Zoning Board of Adjustments Page 5 June 26, 1997 The carport would encroach over the 25 feet building line required in the R-1 zoning district by approximately 15 feet. Chairman Hill asked the applicant, Mr. Davis, to come forward and address the members and audience. Mr. Davis stated he was present to request a variance to construct the carport, mainly as a convenience for him. Chairman Hill asked Mr. Davis if he had considered putting the driveway on the northside and going around the back yard. Mr. Davis stated there would be limited space between his neighbor next door and would be more of an expense to build. Mr. Davis stated in his single car garage he is limited in space to get around with his walker. Chairman Hill asked Mr. Davis if the house at one time had been a two car garage. Mr. Davis answered when he purchased the house it was just as it is now. Chairman Hill called for proponents or opponents. Mrs. Carolyn Davis, 507 Oakwood Drive, stated she would like the variance approved to help her husband in approaching the house in bad weather. Chairman Hill called for opponents, there being none he closed the Public Hearing and opened the item for discussion among the Board Members. Board Member Victor Blood stated that this part of the neighborhood did not have carports and the request would be a deviation from what is standard for this vicinity. Board Member Bill Wlliams stated the request was for personal convenience and not a public convenience. Board Member Bill Wlliams made the motion to deny variance request ZBA#97-05. The motion was seconded by Board Member Victor Blood. The vote was as follows: Ayes: Board Members Hill, Bates, Williams, Blood, Bowen Nays: None The motion carried. ITEM IV. #,ZBA-97-06 - 810 N. ECTOR DRIVE Public input regarding the request of Randy Hayes for a variance to the 30 feet platted building line and the 25 feet minimum front yard requirement of the R-1 zoning district located on Lot 16-R, Block 30, Midway Park Addition. Chairman Jack Hill opened the Public Hearing and asked Kevin Mercer, Development Services Manager, to give the presentation. Zoning Board of Adjustments Page 6 June 26, 1997 Kevin Mercer stated the applicant, Mr. Randy Hayes, was requesting a variance to the 30 feet platted front building line and the 25 feet front yard setback requirement so that he may have a carport in front of his house. The carport would encroach over the 30 feet platted building line by approximately 6 feet. The structure would encroach approximately 1 foot over the 25 feet front yard setback required in the R-1 zoning district. Chairman Jack Hill asked the applicant, Mrs. Charlene Hayes to address the members and audience. Mrs. Hayes stated they have three vehides and five children and the garage was congested with items belonging to the children. This leaves little room to maneuver. Board Member Victor Blood asked if the post had already been set. Mrs. Hayes stated they had hired someone to construct the carport and the contractor had not applied for permits. Board Member Bill Williams suggested shortening the carport by six feet. Board Member Victor Blood suggested setting the pole adjacent to the location where the faucet is currently located to another location. Board Member Bill Williams stated if the post dosest to the street were moved back towards the house by 1 foot, Mr. Hayes would not be in violation of City Code. Also, Board Member Bill Williams stated if 2 feet of overhang were sufficient cover there would not be a violation of any City code and a variance would not be necessary. Chairman Jack Hill asked for proponents to come forward. Mrs. Lois Booth, 808 N. Ector Dr. stated she was in favor of Mr. Hayes request. Mrs. Carol Greer, 814 N. Ector, she stated also was in favor of the request of Mr. Hayes. There being no opponents to the request, Chairman Hill dosed the public hearing. The item was opened for discussion among the Board Members. Board Member Victor Blood stated all the houses in the neighborhood appear to be set with 30 feet setbacks and the other carports in the area are on houses that are L - shaped. Chairman Hill stated if Mr. Hayes would forego 1 foot, it could be built in conformance and a variance would not be needed. Board Member Bill Williams confirmed with staff regarding the 30 feet setback if a variance would be needed. Kevin Mercer stated any time a building line that is platted in excess of the minimum zoning requirements, that it is nothing more than a platted deed restriction. Chairman Jack Hill called for a motion for ZBA #97-06. Board Member Bill Williams made the motion to deny the variance. The motion was seconded by Board Member Roger Bates. The vote was as follows: Ayes: Board Members Hill, Bowen, Bates, Blood, Williams Nays: None Zoning Board of Adjustments Page 7 June 26,1997 The motion carried.
