ZONING BOARD OF ADJUSTMENTS
OCTOBER 23, 1997
The regular meeting of the Zoning Board of Adjustments was called to order by Chairman
Jack Hill at 6:00 p.m. for consideration of scheduled items in the Council Chambers in
Building "B" of the Municipal Building. The Pledge of Allegiance and Invocation were
given by Victor Blood.

APPROVAL OF MINUTES
Board Member Bill Williams made the motion to approve the minutes of June 26, 1997,
Zoning Board of Adjustments meeting as presented and the motion was seconded by
Fred Bowen. The vote was as follows:
Ayes: Board Members Jack Hill, Bill Williams, Fred Bowen, Victor Blood, Eddie
Price
Nays: None
Absent: Board Member Roger Bates

ITEM 1. PUBLIC HEARING - #97-08-ZBA - 2417 CONIFER DRIVE
A. Public input regarding the request of Todd Anderson for a variance to the
80 feet front setback requirement R-1 (Single Family Detached Dwelling
District) to allow an accessory building approximately 35 feet from the
property line
Kevin Mercer, Development Services Manager, gave a brief description of the property.
He stated the applicant was requesting a variance to the 80 feet front setback
requirement to the R-1 zoning district for an accessory building which would be located
approximately 35 feet from the front property line. He stated the nature of the request
was sent to the City Attorney for review and approval to determine whether or not the
ZBA had authority to review the case. He stated the City Attorney did respond with
authorization for approval that it did meet the criteria for the Zoning Board of Adjustment
to authorize granting the variance if they determine the following conditions had been
met: 1.) Granting the variance will not be contrary to the public interest; 2.) The
variance is needed to relive an unnecessary physical hardship impacting the property
such as narrow, shallow, shaped, rough (topographical), and; 3.) The spirit of the code
and substantial justice will be served.
Chairman Jack Hill opened the Public Hearing and asked the applicant to present his
presentation.
Todd Anderson, 2417 Conifer Drive, stated the variance would increase the outward
appearance of the community by concealing the storage shed in an unnoticed corner
area. Mr. Anderson stated that he would take steps immediately to have the fence higher
in that area and surround the building with large shrubs covering the East and West
sides. He also stated that by placing the storage building in any other area of the yard
would restrict future plans for a pool, patio or sunroom, causes drainage problems, blocks
view from any window in the house and disrupts a newly installed sprinkler system. Mr.
Anderson stated that when the property was purchased the lot had a 13 degree slope.
A 102' x 5' retaining wall was installed and numerous loads of dirt brought in to level off
the yard.
There being no opponents or proponents, Chairman Jack Hill closed the Public Hearing
and opened the item up for discussion among the Board Members.

B. Consider the request of Mr. Todd Anderson for a variance to the 80 feet
required front setback for accessory bukings in a R-1 District
Board Member Bill Wlliams asked Mr. Anderson if he had considered tying the structure
into the existing building.
Kevin Mercer, Development Services Manager, stated that in the R-1 zoning district it
does require a minimal roof pitch of 6 on 12 to tie into the existing structure and would
be treated as an addition to the house and not as an accessory building. Additions to the
house may be constructed as long as they fall behind the 15 feet sideyard building line
and the 25 feet front yard building line. He also stated to Mr. Anderson that he would be
happy to meet with him and help resolve any questions if he chose this alternate plan.
Board Member Victor Blood stated that it is possible to place the structure in that
easement if its on a wooden type foundation where it could be moved and also could be
placed within 3 feet of the sideyard on the South.
Board Member Fred Bowen stated that Mr. Andersons presentation was very helpful and
the efforts to beautify the property were greatly appreciated.
Chairman Jack Hill dosed the discussion and called for a motion for#97-08-ZBA Board
Member Fred Bowen made the motion to deny the variance. The motion was seconded
by Board Member Bill Williams. The vote was as follows:
Ayes: Board Member Price, Bowen, Williams, Hill
Nays: None
Abstain: Altemate Board Member Victor Blood
Absent: Board Member Roger Bates
The motion carried.

There being no further business the meeting was adjourned at 8:20 P.M.
