HomeMy WebLinkAbout1998-01-22 MNUTES ZONING BOARD OF ADJUSTMENTS JANUARY 22, 1998 The regular meeting of the Zoning Board of Adjustments was called to order by Vice- Chairman Eddie Price at 6:00 p.m. in the Council Chanters of the Euless Municipal Building. The Pledge of Allegiance and Prayer was given by Roger Bates. MEMBERS AND STAFF PRESENT: IVENBERS ABSENT: Eddie Price Katherine Houk Gene Sloan Bill Williams Roger Bates Fred Bowen Victor Blood Kevin Mercer, Development Services Manager Donna Brown, Office Technician Dolores Tijerina, Staff Secretary VISITORS: Gordon Jones Chris Green REGULAR AGENDA APPROVAL OF MNUTES Board Member Fred Bowen made the motion to approve the minutes of November 30, 1997, Special meeting Zoning Board of Adjustments as presented and the motion was seconded by Roger Bates. The vote was as follows: Ayes: Board Member Sloan, Bates, Bowen, Price, Nays: None Abstained: Bill Williams, Alternate: Victor Blood The motion carried. ZONING BOARD OF ADJUSTMENTS MEETING - PAGE TWO ITEM I. ZBA#97-09 - Harwood Court, Lot 3, Block A, Harvkood Courts Addition Public input regarding the request of Mr. Gordon B. Jones for a variance to the 25 feet minimum side yard requirement in PD #1146 Planned Development #1146 Zoning District) to allow for the construction of a residence Vice-Chairman Eddie Price opened the public hearing and asked Kevin Mercer, Development Services Manager, to give the presentation. Kevin Mercer stated that Mr. Jones was requesting a variance to the 25 feet minimum side yard setback required in the Planned Development#1146 Zoning District. Vice-Chairman Eddie Price asked the applicant, Mr. Jones, to address the members and audience. Mr. Jones stated that all building setbacks and easements shown on the recorded final plat were abided by. He also stated it wasn't until the plumbing and cable placement were completed that the inspection for the foundation was denied by the City because of the statement on an exhibit in the PD Ordinance which called for a 25 feet setback off of Harwood Road Right-of--Way. He interpreted this to mean the existing Harwood right of way prior to plat filing since if the right-of-way line after the plat filing is used would render this lot unbuildable. Mr. Jones stated the home had already been sold and respectfully requested the variance so that the construction may continue. There being no opponents or proponents, Vice-Chairman Eddie Price dosed the Public Hearing. Alternate Board Member Victor Blood asked Mr. Jones if the plat showed a 7.5 feet side yard on the plat or does the plat not show a side yard at all. Kevin Mercer, Development Services Manager, answered that the plat was not showing a side yard, but it does show a 7.5 feet utility easement. Board Member Bill Wlliams asked Mr. Gordon Jones what was his understanding of the setbacks. Mr. Jones stated his understanding was that it was 5 feet and that they were abiding by the 7.5 feet drainage easement shown on the plat. Alternate Board Member Victor Blood stated that was referring to an internal property line not a street, and in most cases a street would have a larger setback. Vice- Chairman Eddie Price asked Mr. Jones if he was aware of how far from the fence the house on the south east corner of Wnston & Harwood was situated. Mr. Jones stated that it looked to be about 10 feet. Alternate Board Member Victor Blood stated that with a hip-roof the structure would not be taller than the wall and the roof slopes up both directions reducing the visual impact into the easement. Board Member Bill Wlliams stated that on the 8.5 feet it was a 100%variance request and had not heard from the builder an alternative method to lessen the severity. Alternative Board Member Victor Blood stated that language should be attached in reference to allow the primary building as shown but that any accessory structures would be 15 feet from the property line. ,.� ZONING BOARDING OF ADJUSTMENT - PAGE THREE Vice-Chairman Eddie Price called for a motion for ZBA #97-09. Board Member Bill Williams made the motion to grant the variance limited to the primary structure without attachments or accessory buildings. The motion was seconded by Board Member Fred Bowen. The vote was as follows: Ayes: Board Members Sloan, Williams, Bates, Price, Bowen Nays: None Alternate: Board Member Victor Blood ITEM II. PUBIJC HEARING - ZBA #97-10 - 1015 HARWOOD COURT, LOT 4, BLOCK A, HARWOOD COURTS ADDITION Public input regarding the request of Mr. Gordon B. Jones for a variance to the 25 feet minimum side yard requirement in PD #1146 (Planned Development #1146 Zoning District) to allow for the construction of a residence Vice-Chairman Eddie Price opened the Public Hearing and asked Kevin Mercer, Development Services Manager, to give the presentation. Kevin Mercer stated that Mr. Gordon Jones was requesting a variance to the 25 feet minimum side yard setback required in Planned Development #1146 Zoning District. Mr. Gordon Jones stated nothing had been built on the lot but the lot had been sold and the plans would be revised to comply with the 15 feet setback. He informed the Board the structure would be a one story L-Shaped building. Board Member Williams stated a variance for Lot 4 would still be required to change the 5.5 feet setback to a 15 feet setback thus granting a variance from 25 feet to 15 feet. There being no opponents or proponents, Vice-Chairman Eddie Price dosed the Public Hearing. Having induded Lot 4, Block A in the discussion on Lot 3, Block A, Board Members declined any further discussion. Board Member Roger Bates made the motion to deny ZBA#97-10 request as presented. The motion was seconded by Fred Bowen. The vote was as follows: Ayes: Board Members Sloan, Wlliams, Bates, Price, Bowen Nays: None Altemate: Victor Blood ZONING BOARD OF ADJUSTMENTS - PAGE FOUR The motion carried. Board Member Roger Bates made the motion for ZBA #97-10 that the variance be granted to 15 feet minimum side yard setback requirements. Board Member Bill Wlliams seconded the motion. The vote was as follows: Ayes: Board Member Sloan, Wlliams, Bates, Price, Bowen Nays: None Alternate: Victor Blood The motion carried. ITEM III ELECTION OF OFFICERS Nominations were taken for Chairman. Secret ballots were counted and Fred Bowen was voted Chairman. Nominations were taken for Vice-Chairman. Secret ballots were counted and Bill Williams was voted Vice-Chairman. ADJOURNMENT: There being no further business the meeting was adjourned at 6:55 P.M. airman Fred Bowen e
