Mr. Knight stated that once portion of the right-of-way of Teat, Creek Parkw,—;y dogs
not extend. all the way to the property line of property sold to one of the developers
at the northeast corner oC Ash Lane, and Bear Creel, Parkway.
Mr. Morris Aated that Tr Ari-nd and the other de-vel.oper are f'le;vible on the isstle. lie
stated that there are three options. (I) deed the property to the developer, (2) deed
right-of--way to the City, or () grant (-,,asernent for incvr•ess(egress. He :Mated that
it would be easier between now and the City Council meeting to grant an easen lent.
Mr. Krriight asked if it would he ra problem to exp;and the right-o`'-way of Bear CreeY
R,irkway so it would extend to than property line.
Morris stated that the only pr•oblein is that the other developer's property line is
at the delineated 100 year Plot?d plain, and Triland has accepted perpetual main enwice,
:at. that 100 year flood plain. If' they grant right-of-way, that mi`ht cause some
confusion,
Mr. Kriight stated he has reservations of having a strip of .hand that cuts a piece of
prof.+ert,s cff C roni access to :a roadway. That paz'tic:ULar develops-rie tt shows access of
a driveway into that area which would lie between the proposed crossing gates.
sNir, Morris stated tie told the developer it would be best for him to ;submit, to Staff
his plan showing, the crossing gag's similar or identicat to ones, they are instafl.it'q at
tote. 100 year .flood plain on his driveWa. That developer asked if he could he ptat. into
the sensor ;-ircu.it at ttre culvert so that his gaga worked exactly like the City's and
could go ahead and put it in the right-of-8y at his curb cut and just give it to the
City. fie stat.cq that is arrwfiiable to `'rilnd.
111r. Lynch stated his concern about crosion at the entrance, and exit of the caulverts
and that, it should riot be the City's cost to maintain. If the deli i-, is riot already%
projected to put most of the maintenance finder tlie, horrreosmier's associ:tion, he
would like to see it designed to do so,
y r. Morris stated lie would cheLek on the wording of the perpetual ma.intenance.
:;ireernent and have their attorney wr=ite an opinion before the City Coum-fl meeting
next week,.
Mr. Knight stated that the fifty Coot (501) right-of-way is basically from the headwall
of the culvert to the headwall of the eul cxt. Anything :xtyond that would be included
withiri the area covered by their perpetual ma_intemance agreement.
Mr, Kn.igi"3t stated that there is no fill involved across tt.e tl.oc>4.way. The culvert has
%a greater capacity than the existing, chamiel.
Mr. Lynch riiade a motion to .recommend approval of the 1•inal .Platt.i:tg; of the Right-
