Ball & Associates, Bedford, read a letter, from Westhaven Interests requesting the Commission to consider the C-2 request only, and Westhaven, in turn, will make application wit-bin ninety days for PD on the southern portion. Mr. Tyson asked if 75% of the design documents completed were for the southern portion. YVIr. Ball started that the design docunnents completed were for streets and utilities only. ITEM #2 - Mr. Knight stated that he was not specifying that an casement be put in; just pointing out staff's request. The advantage to the easement is that no structure could be constructed on it; the disadvantage is that any utility could use the easement. He further strated that it is a private system and will be the developer's responsibility for continuing rnaintcnarace. ITEM 11_1`3 T Owner is willing; to participate in one-half of the cost of necessary storm drainage improvements in Harwood Road. Bill Blackburn, 2800 one Main Place;, representing Kinder-Care Learning Facilities, stated that Kinder-Care has been in business "or 15 years and has 900 daycare facilities. Each facility accommodates 132 children. He believes this property is a good location for a daycare and will fill. a deed for the residents in the area. In rebuttal, Mr. Blackburn stated lie believed the daycare to ite a. compatible use in the residential area.. Mr. Tyson asked fkdr. Blackburn if Kinder--Care currently owned the property. The majority of the Commission members agreed that this was not the best location for a dayerare due to the heavy traffic, school crossing, and the feeling the property should remain residential. He- explained that the property has been undeveloped due to the lack of public improvements and the fact there are about 200 individual owners in the subdivision. Ile presented his proposal which includes '297 multi-fan ily dwelling units in a townlionie/eorldo;r-lirait!;r-� configuration in vwhict:t 3 out of 4 units will have garages and units ranging in size from 934 . ware .feet to 1,249 square feet. There are two general purpose con nieresial buildings proposed. The density of the project is 13.57 du/,ac, riot including the streets. He intends to provide a six to eight foot screening fence. There will be only one window in the bedrooms. He stated that the windows could not be reproved because the building codes require at least one window in a bedroom. NI r. tVarren ffagan, Boyle Engineering, Gaston Avenue, Dallas, explained the type of storm drainage 1.1n.provement's proposed. lie also stated that the existing portions of Kynette, Signet & Toplea streets are 31 'feet b.b. Mr, '.."vIike Owens, Chairman of the Board of Trustees at Calvary Baptist Church, stated that they are committed to stay where they are and plan to expand their facilities. He stated they prefer that the property be a type of residential as opposed to commerei,,A or industrial. He stated that they had traded with Mr. Brooks four non- contiguous lots on Nita for a contiguous lot next to the church. Prior to doing so, he checked on M.P. Brooks` reputation)utation and quality of vvork and found both to be goc�X1, . He stated he was pleased with the inclusion of garages. There being no additional proponents, Chairninn Deithloff asked if there were any opponents. Ms. Debbie Newman, 1505 rl'oplea, represented the adjacent homeowner,, opposed to the zoning request. She presented a petition signed by those in opposition. She stated she had checked with MPF Research reg�jrding the sale of condos. She indicated that 0 they were not selling very well and felt that the proposed condos will eventually turn into apartments for rent. Mr. f3rooks stated that he had no control over land he does not own; therefore, those lots were left out of they request. fie stated he had no financial cornmitments bought at this time, because tbey are only good for a short period of time; however, tie would have no trouble getting the financing. lie further stated that he was aware of the MPF Research report and had done research for three years and believed this to be a viable project. M'r. John Park ,stated that he and Carolyn owned Lot 6, Block 6, Bell Ranch Terrace. Ile stated he was not concerned about the people in the condos looking down into their lots, but, rather, having to look at the condos. 'Mr. Lynch pointed out that the City has looked at nurr.erous options for development of this property. The current single family attached buffer line matches that across North Main Street. They want the buffer zone to remain. There being no additional opponents, Chairman Deithloff closed the public hearing. Tile Commission me-mbers were equally concerned with the homeowners and felt there Should be a buffer area. The majority agreed that they could support the project with the assurance of a PD. Mr. Elliott stated they could corne back with a variation of the request to provide a buffer. Mr. Knight explained that the public hearing was cios-.ed and there would be no farther notice to the property owners. After additional discussion, Mr. Elliott requested the ;coning ease be tabled. Mr. Tyson made a motion to reopen the public hearing. Mr. McMillon seconded the motion, and the vote is as follows: Ayes- Messrs.
