that this case be tabled until the September 4, 1984, meeting. The petitioner is
contemplating .withdrawing, his request. for a fail-service station on Mid-(.:.ities Blvd.,
but that fie may continue. to request gasolino sales on that site.
Nlr. John Deithloff made the motion thaat. the Commission grant Mr, Stak's request to
table this zoning ease until. September 4, 1984, and to continue the publics hearing at
that tirne.

Mr. I'fete Hennessey, Hennessey Engineering, stated that he had net with Staff to
discuss the subject plat.
Mr. Knight stated that N'lr. llerrnessey had met all requirements of the Subdivision
Ordinance regarding platting and he recommended approval of the plot provided the
developer place with the City a Perpetual Maintenance Agree;rnent on drainage
easements that cut through the property.
?'lr. I rxight further stated that the drainage syste.rn is underground and exceeds the
requirements of the Subdivision Ordinance (t.he ordinance requires an undergrMnd
systern be dc-signed on a five-year return frequency storm). the Miraia-.airM that -Mr.
Hennessey has designed will accoinmodLate in excess of a twenty-five (25) year return
to storm. Drainage easements provided will. accommodate the overflow above: the 2._t
year up to the 100 year return frequency storm. The Perpetual Maintenance
Acre erraent requested assures that drainage easements rrts provided by platt.irri; will be
kept free of obstructions on the above-ground easement.
Mr. Hennessey stated that tie would comply with Mr. 1�rright's request.
Chairman Lynch inquired as to the future improvement Mans of TVestpark Way in
regard to this project.
Ylr. Knight stated that Mr. Hennessey had prepared a cost estimate for the developer's
pro-rata shore of the paving. funds will be escrowed with the City to cover Vie cost
of paving, of one-half of the 49 foot back-to-back of curb streets as t1 he property can
the other side of the project develops or when the City desires to complete the
roadway. A unit cost breakdown for the paving has been included to cover the paving,
sidewalks, excavation, and related drainage that would be associated with it. lie
further stated that there is an 80 foot right--of-way existing for West Pipeline Road.
fUr. Deithlo`f made a motion to approve the final plat, including requiring the above
referenced Per°pettr.al. ilai.ntenance Agreement for the drainage easement.

Chairman Lynch stated the rules and opened tare Public Hearing by asking for
proponents of this request.
Mr. Larry Emery, 100 R-idgecrest, petitioner for the request, submitted copies of the:
Plat of the area and summarized the history of the de.vel.opanent. Ile discussed how
the noise, pollution, and traffic from airport. Freeway was disrupting his neighborhood.
ylr. Emery was further concerned with the safety of the children as they travelled to
school or played in the neighborhood. Ife also felt that the homes in Park Crestmoor
are not marketable:.

Owens, I0.1 .Ridgecrest; Ms. Rebecca I3atkin, 306 Itidgecrest; Mr. R. 11. Owens, 103
Ii,idgeerest; and Mr. Mike Bowden, expressed their concern for the ssrfety of the
children, pedestrians crossing the freeway, pollution and excessive noise from: the
freeway, traffic taking shortcuts through tbe:ir neighborhood, and weeds on vacant lots
that obstruct the view of motorists.
Chairman lynch read a letter that he had received frorn Harold Copher, one of the
property owners named in this zonings request.. Mr. Copher was unable to attend the
meeting due to a serious; illness. The letter stated, "I will be unable to attend the
Public': flearing for Zoning Case T#84--21:3, but Its=ould like to leave You enter into your
records my approval for the rezoning from R--1 to C-22."
5,tr. Knight remarked that staff had received a letter from Mr. and Mrs. Jinn Carroll,
owners of Lots 6 & 7, Block A, Sheppard Addition in which they both approved the
request for rezoning.
Chairman Lynch then asked for any opponents.
Vernon Nash, 105 Windward Wavy, sUited that he had no disagreement with the request,
but lie Ranted to know, ghat commercial property would be, Located there:. Ile
objected to having a convenience store next to his property. He further inquired
about .living on property that had been zoned commercial.
Mr. Knight. and Chairman Lynch suggested that the zoning would fallout a variety of
urns, such as gas service station, convenience store, etc.
lr. Tyson explained that a convenience. store 3-night not necessarily be built there.
Mr. Nash also wanted clarification on the 200 foot requiren-,ent, of which Chairn-,an
Lynch explained how the property owners were notified. Chairman Lynch also
explained the uses of commercial and residential zoning.
Mrs. Helen Davies.. 21.4 Sheppard; Mr. Jay McGinnis, 103 Ridgecrest; Mr. Bill Trussell,
205 tVindward Way; Nir. Henry Kitchens, 109 Ridgeerest. Mr. Ben Taturn, 203 Skyway;
L. T. .tlr.le, 206 Ridgecrest; Mrs. Joy Brake, 216 S. Sheppard; and Mrs. Clloria Lay, 220
S. Sheppard, expressed their concern that the rest of the neighborhood was being
neglected; traffic would be increased, the safety of the children would be its jeopardy,
property values would. decrease, taxes would increase, and it would be difficult for
homeowners to reinodf:1 or rebuild.

Chairman Lynch asked for a show of hands from the citizens who opposed this rea€lest,
of which there was approximately 15 hands.
Mr. Kitchens felt that the City had let them down regarding the heavy traffic through
the neighborhood due to the new signal .light at Ector and S.H. 10.
Chairman Lynch remarked that P & Z had no control over traffic safety, but he would
instru0 staff to conduct an investigation and make recommendations. Chairman Lynch
them closed the PUblrc Hearing and asked for discussion a1D011g the P 3c Z.
The members generally agreed that either all of the neighborhood should go
commercial, or none of it should.
`lvson did not feel that commercial zoning was needed because .A was an
established neigliborhood and had a residential atmosphere. He expressed his concern
with traffic in Park Crestmoor.
Chairman .1 vnch stated that this area would} need :a Planned Development before lie
could support a change.
Mr. Hill; made a motion to recominend denial of Zoning Case, #84-23.
Mr. Deithloff seconded the motion, and the vote was as follows:
Ayes: Mrs. Park, Messrs. .ingram, Hill, Deithloff, Lynch, Tyson, and N-1cfV11illon.
Nays: None
Chairman Lynch declared the motion carried.
Chairman lynch declared a five-minute break. At 8:40 p.m., the meeting reconvened.

Chairman Lynch stated the rules and opened the Publics Hearing by asking for
proponents of this request.
Mr. Mike Sherrill, Hcagar Construction, presented the request for rezoning. He fe.it
that this zoning would be compatible with the surrounding zoning. lie desired standard
zoning to speed tip the zoning request. lie further ;added that the R-1-A would be
more defined than a Planned De:velopnient..
N-1r. Tvson was concerned with the kind of single-family attached dwellings and parking
for the; sutKlivision.
Mr. Sherrill renaa.rked that lie had met with staff to discuss the adjacent properties.
He said that the parking would be in the rear of the dwelling. He had no problem
with P & Za making that point a part of a motion.
C-;hairinan Lynch added that there would need to be a reciprocal deed requirement
in order for that to be enforceable by the property} owners.

My. "Tyson wanted a deed restriction regarding parkitag, atrel wanted to know if the
adjacent property owners would be able to get deed restrictions. lie asked if deed
restrictions would be filed at time of platting.
Chairman Lynch and Mr. Knight stated that deed restrictions would be made at
-
platting time.
C hairman Lynch then asked to hear any proponents; there being none, he asked for
opponents. 'There being none, Chairman Lynch closed the public hearing.
Mr. 11 night explained the R-1-A zoning district in the zoning ordinance. He referred
to previous subdivisions who asked for variances from the standards that were set up
for single-fant.ily dwelling districts. The staff was instructed to devise an R- 1--A zone.
lie stated that this zoning request was the first of its size to make such a request
for 'R-1-A.
Chairman Lynch was concerted with speculation of lot configurations. The streets
would be 31 foot back-to-track with a 50 foot right-of-way.
Mr. 'Tyson expressed his concern with what could happen at platting time regarding
alley ways and right-of-ways.
Mr. Knight suggested that there could be driveways between the units.
ltIr. Tyson made a request to see a lot layout at the time of platting.
Mr. Ingram concurred with Mr. Tyson regarding alley ways and parking. He also
desired to see lot layouts at platting time.
Mr. Deithloff made a motion to approve of Zoning Case 'r84-24 as presented,
,Mr.. Hill seconded the motion, and the vote is as follows:
Ayes: Mrs. Park, Messrs. Ingram, Hill, Deithloff, Lyrach, McMil:l.on, and Tyson
Nays: Norge

Chrair.man Lynch explained the males and opened the, public hearing.
Mr. William Peifer, representative, of D/F Development, felt that the north area
needed a buffer for the s ingle- family. He described the attractiveness of the tract
and explained the expense that would be incurred in regard to drainage a.nd flood-
plain. lair. Peifer was of the opinion that this property worald be compatible with

surrounding properties. He discussed a drawing that showed ttae future development
and neighboring developments. I-le stated that the property to the north would be
developed as a single project. The single family would be subdivided out and sold to
builders.
Chairman Lynch asked Mr. Peifer to explain what was to be planned as far as the
standard units in the R-4 section was concerned.
Mr. Peifer stated that the density would be kept at .l.6 u/ a for the 18 acres. The units
would be 75% wood and masonary and would be two story. 18% would. "be efficiency,
700 square feet, one bedroom. The studio apartments would be approxir-nately 1,03 6
square feet. The eight duplex units would have their own individual entrances 6innilar
to condos.) and be approximately 950 square feet. The average square feet would be
a little over 800.
Mr. Tyson inquired about the roads that are to be included in the request as well as
existing roads.
Mr. Peifer stated that Mrs. Clark, owner of the honne on tti estpark 1. 'ay, had approved
a street through tier propert:,% that would exit onto Westpark Way.
Chairman Lynch theca asked for additional proponents.
Mrs. Kay Fuller, Box 23 7, expressed her desire to see this request pass.
Mr. Ric-hard Drunnnnonds, president and 50% owner of D/F Development, discussed the
.attractiveness of the property and the cases of the surrounding properties. fie felt that
his company would develop a quality product.
There being no other proponents, Chairman Lynch entertained opponents to this zoning
case.
Mrs. Becky Lwart, 2404 Westpark Way Circle; Mrs. Jan Juniper, 2514 t'cestpark Way
Circle; Mr. Gary Guthrie, 602 Live teak Drive; and Mr. Brad Jones; 2405 Westpark Way
Circle, were opposed to this zoning request. It was felt that only the ex.i4ting
pr°oper°ty owners would benefit from: this development, the increase in school-aged
children would interfere with the quality of the TIER set,ools, there was no need for
more inulti-family zoning in this area, and that the beauty of the area Mould be
destroyed.
There being no additional opponents, Chairman Lynch closed the public hearing.
Mr. Deithloff stated that he did not want RV-4 in back of C-2 and declared his
opposition to this ease. Tie did agree with the C-2 portion of the request.
Mrs. Park felt that the frontage on Pipeline could be C-2. Sh.e opposed pocket zoning,
and thus opposed this ease.
Mr, CMill0n Was canc'erned with the drainage on the property; he desired that the
property remain R-1. dire to the density that had been proposed.

major planning problems in developing this property. Ile stated that lie would support
this request if it was a. PD; and was concerned with the number of units per, acre,
traffic flow, and terrain. Ile did riot totally oppose this case because of the zoning
on the surrounding property, but was not in favor of category zoning.
Mr. Tyson opposed multi-farnil.y in this area and did riot totally agree with C-2 oil
Pipeline. He expressed his desire to see R°I and C--1 on the property in this zoning
case.
A-1rs. Park made a motion to recommend denial of Zoning, Case #84-25) irk order to keep
the present R-1. zoning on this area.
Mr. Deithloff seconded the motion, and the vote was as follows:
Ayes; sirs. Park, Messrs. Ingrain, Hill, Deithloff, Lynch, Mclrlillon, and Tyson
Nays: Done
VI.
DISCUSSION -- PRC)IjER`-1"Y OWNER NOTIFICATION
Chairman .Lynch asked for a report by staff regarding the notification of property
owliers in zoning; cases.
Mr. Rod Tyler, Senior Planner, distributed pictures that had been taken r=cgar ding
zoning change signs that had been placed inappropriately and how the s.ipens had been
relocated so as to be, more visible. Ile stated that steps would be taken in the future
to prevent these problems. Ir°. Tyler explained the current procedure that is followed
to notify property owners of zoning changes. Ile then made the following proposal:
1. Continue to notify from last approved tax rolls as per state law.
2. Continue: placing• sign; on the property.
3. Notify all property owners within 200 feat. of the zoning change by addPessing
correspondence to "Citizen" according to platted .lots. These notices will no
longer be sent by certified mail, but will be ]rand delivered to the Post Office
for a postmarked validation and delivery.
Mr. Knight stated that this new procedure would significantly aid in notification of
property owners. The roost would be &pproxinnately for#y cents as cornparec to $1.55
to send the notices by certified mail.
Chairman Lynch was primarily concerned with adequately notifying property owners in
the most efficient way possible.
Air. Deithloff inquired as to .newspaper notification.
Mr. Tyler stater. that a notice is published in the newspaper after P & L hears the
case and before the ease is heard by the City Council.

Mrs. Liz Newlin, Mid---Cities Daily News, stated that she does not get an agenda far
enough in advance to publish a copy in her paper.
Mr. Deithloff made a motion that the P & ' adopt the new property owner
notification as presented by Mr. Tyler.
Mr. Ingram seconded the motion, and the t=ote is as follows:
