The portion that lies in Page Two, Planning & Zoning Commission, November 20, 1984 1984-171 €-.tie City of Euless is zoned for commercial uses and is divided into two lots (2.55 acres) by a proposed collector street. Chairman Lynch stated fie was concerned with a. coo.€lector street dumping traffic into Euless from a multifamily development in Bedford. I-le stated that he thought a t.ra.€'f.ic impact study should be prepared so the itnpact could be evaluated. In response to a. question from Mr. Deithloff, Mr. Knight stated he has not received copies of the Perpetual Maintenance Agreement. Mr. Knight stated that the Traffic Safety Coordinator liad reviewed the proposed plat and was concerned with the number of ;curb cut; on Westpark Wray, and therefore, recommended that access be Urnited only to Parkvi.ew Drive. Mr. Tyson cofnmented that lie was very concerned with a multifamily development located in another city utilizing Westpark Way as their primary access to and from Airport Freeway. He stated that since the commercial property in Euless could be served from Westpark Way thn.t lie could see no positive effect that a street at this location could benefit the Citv of Euless. Mr. Tvson made a motion to recommend denial of the Cofnbine'd Preliminary & Final Pfi.itting of Lot 3, Block 1, and Lot 4. Bloch 2, Parkview .Addition as submitted. Mr. Deithloff seconded the motion. Mr. Knight stated that no water will be available to one of the lots along Pipeline until the City planned sixteen inch (16") water line is in place. He stated that the runoff coefficients mentioned in Jinn McK€nna's letter have been corrected. Mr. Tyson stated that he recalled there was a /on.ing requirement to align the- private drive with 'Pray s Drive. He noted that they do not appear to align on t1 e plat. Stalks stated that there will be a forty foot (40') buffer in addition to the twenty-five foot (25') of right-of-w,-ay abandoned to the property owners; between the P, eadowview Addition and the building. There Will be r7 twenty foot. (20`) landscaped buffer along Harwood. The development involves €i convenience store wfg'asol.l.ne :merles as an anchor tenarit. I-le further noted that only 17`s, of the land will be covered with buildings. No pole signs will tae allowed and the facade will be 100% ninsonary except for the gr.lass windows rind wall sign marquee. The gas islands are to be designed with the salrre material as the buildings. Triland intends to build a, feriae along the new property .line adliacent to -leadowview Addition, rernov%e the old paven-,ent, and grass in that area. lie presented renderings depicting the front elevations. Stales stated that he will. commit to the renderings. Chairman Lynch asked if there were any additional proponents. There being none, he tasked if there were any opponents. Mr. T-3411 Garcia, 2312 Irwin Dr,, Beth Baker, 500 Parsley; Jim Baker, :100 Parsley; and Mike Baile v, 517 Holiday, each spoke in opposition to the zoning Change at Mid-Cities and Fuller--Wiser objecting mainly to the gas sales. They also spoke saginst the litter, crime problem, and late hours a associated with a convenience stare. There being no additional opponents, Chairman Lyraeh closed the public hearing. Mr. Knight stated that the only additional rrse r°er3rzested other than what is currently,, allowed is the gas sales. Pile. Tyson stated that gasoline stations have changed over the years and usually are not full service anymore. He felt that the landscaped screening; proposed by the developer has made the gas sales .less objectionable, and lie eoul.d be in favor of the zoning change. Mr. Deithlo.ff stated that the C-2 zoning to the east could have a gasoline station. Mr. S:taks stated the C-2 to the east is geared to S.H. 360 and that ten acres will be lost to the right-of-way of SAL 360. Chairman Lynch stated that this appears to be a quality, developmeDt and .felt that the trade-off between allowing gasoline sales on the site and the commitment of landscaping and desirable building treatment is in the best interest to the City and neighbors. She :stated that the property behind her home is on higher ground, and that the ten and one--half .foot 00 1l21) fence they have erected provides the same privacy as an eight foot (89 fence. She presented pictures to the Commission showing the fence behind her horne. Chairman Lynch noted that the fence was installed in two stages and that the posts do not extend above eight foot. (8'}. Mrs. Sanchez stated; tier willingness to -make sure it is structurally soai.rrd afacl submit a letter• from a cuali.fied engineer stating that the fence is structurally sound. Chairman I.yneh stated that the Board must consider specific requir=ements before granting a fence variance. Ile asked if there were additional proponents. There being none, he asked if there were any opf.x)nents. Mr. Allan Debevec , 301. Westover Dr., stated that he lives behind Mrs. Sanchez. He believes that the fence is unsightly and is concerned about the safety of his children should the fence fall down. Mr. Terry Allan spoke as a proponent stating he is a neighbor to the south of .l.T.s. Sanchez. He stated that tie had no problem wi b the height of the fence if it is made structurally, sound. These being no additional proponents or opponents.. Chair nian Lynch closed the public hearing. Mr. Tyson stated he believes all the neighbors are in favor of the feriae as .ton#; as it is aestf eti(.-all;- pleasing and the re is no safety problem. Page Seven ... The motion died for lack- of a second. The Commission discussed the effects of leaving the final control with a neighbor. It Wes brought out that the Board does riot have the power to delegate authority to the public. The Commission asked Mr. Debevec his opinion of aesthetics. Mr. Debevec stated that preferably there should be a new one, piece fe-rice orle piece put up. Otherwise, he stated the top should follow the bottom half in its slope; the top of the current fence is not vertical all the way. Mr. Tyson restated his motion for approval With the following provisions: that a signed and sealed certificate by a. registered and professional engineer qualified in the field of structural design stating that the fence is s tr tic turally sound enough to withstand area wind load and, aesthetically, the too of the fence and railing should follow the lay, of the band as the bottom of the fence does, The inotion died for lack of a second. She stated that her lot_ is of such an odd shape and design that the current fence requirements for her side yard would be too restrictive. She stated that the fence, as currently erected, does not clock the view of traffic or pedestrians from any angle but rather provides her and her neighbors with more privacy. The side street, Almond Lane, is not a through street, but ends in a cut- de-Sac in Which the wtrtefr tc)wer is locf;ted at- the opposite end. Tier neighbors do not object to the fence and have signed a petition stating their approval. hairman Lynch asked for any additional. proponents. Mr. Walter Coy,, 100 Almond Lane, also representing Mr. Jim Woodson, stated that the :fence muffles the sound of the traffic, allows the petitioner more back yard, and affords them privacy also and. therefore, supported the variance request. There being no additional proponents or opponents, Chairman Lynch closed the public hearing. The Board agreed that the fence does not adversely affect the neighbors or the City and is not a self--created hardship. illf'.
