The minutes of the regular meeting dated May 21, 1985, were approved as written.

Mr. William Cothran, representing Dunning Development Corporation, explained that
they are seeking to subdivide a lot into two lots. The problem is one lot does; not front
on a dedicated street. He noted that the zoning ordinance allows the Commission some
latitude in rn€�a ia�; ch€s.s�Les to a developin-ent ping, as long as the intent, use, density,
etc., of the plan is not changed.

Mr. Peter Stfaks, Triland .Development, Inc., gave a brief review of the rezoning of the
property. He noted that no changes were being made in the Mari approved except the
placement of a lot line. The development plan was originally submitted with the lot
lane included, but staff requested its removal,
Mr. Names Knight stated that Mr. Stfaks was correct in his statement of the initial lot
line and its removaL The reason for removal is that the subdivision ordinance requires
that all lots have street frontage. The planned development ordinance requires that lot
lines be shown on the development plan.
Vice Chairman Deithloff asked Mr. Knight how it would be handled if the plat is
resubmitted to change the lot line to include the access easement.
Mr. Knight stated that in order for staff to review the plat to see how it would be
affected, the plat needs to be submitted approximately three weeks in advance.
Mr. Pat Donovan, Dunning Development Corp., stated that it was submitted in order
to get direction on how to correct the technicality. He felt that a four week delay
would hurt.
41r. Tyson made a motion to recommend denial of the Final Plat and Engineering Plans
of Lots i & 2, Block 2, Villages of Bear Creek, Phase V.
Mr. Hill seconded the motion, and the vote is as follows:
Ayes: Messrs. Ingram, Hull, Deithloff, McMillon, Tyson
Nays: Mr. Owens
Vice-Chairman Deithloff declared the motion carried.

Mr. William Cothran, representing Dunning Development, stated this plat also shows
two lots-, whereas., the development plan shows cane, However, the definition of a lot
is met in this case, He asked the Commission to approve the minor change which does
not affect the use, density, intent, etc.
Mr. Pat Donovan, Dinning Development Corp., stated that the lot line was originally
shogun on the developmer4 plan, but was requested to be removed.
!v r. Tyson questioned how the required parking would be affected.
Mr. Victor Liss.iak, Lissi:ak I ngineers, stated that the architectural Site plan has not
been submitted for review, however, the lot line and parking have been taken into
account.
Mr. Tyson felt the Commission needed to see the architectural plans before: making a
decision.

Mr. Cothran stated they could have the architectural site plan here shortly after
8.00 a.m. tomorrow morning.
�Mr. McMillon made a motion to table #P-85-08 until June 18th, Provided the
archictectural plans are brought in.

Mr. Hill made the motion to recommend approval of the Combined Preliminary and

Mr. Owens seconded the motion, and the vote is as follows:

Mr. McMillon made a motion to recornmend approval of the Site Plan for Lot 1, Block
1, Ferguson Addition, as submitted.

Mr. Al Bayer, engineer for the project, stated that the plat has been recorded at
Tarrant County and all improvements have been installed to date. This plat is beam-
abandoned in order to re-.Ubmit a plat that conforms to the development plan recently
approved.
Mr. Hill made a. motion to recommend approval of the abandonment of Chelsea Park
Estates, as presented.

Vine-Chairman Deithloff asked TIVIr. Bayer if he would comment on the staff's letter of

Mr. James Knight stated that no controversy existed; the letter dust outlined what
has takers place pertaining to this plat.
Mr. Tvsore asked if the street names are different.
Mr. Knight responded that the street names and configuration of the streets are the
same as previously platted.
Llr. Mc Millon made a motion to recommend :approval of the Final Plat of Chelsea Park
Estates, as submitted.
Mr. Ingram seconded the motion, and the vote is as follows:

Lice-Chairman Deithloff opened the public Bearing after explaining the rules governing
such hearing.
Mr. Charles Koetting, 'ITrustee. for United :Memorial Christian Church, presented the
request for rezoning. Ile stated the church has considered locating a new building in
front of the Arco pipeline. R--1, zoning requires a 25 foot setback; whereas, C-1 requires
a 20 .foot setback, allowing an additional .five feet to be gained with C-1 zoning.
Mr. lnryram asked if the additional five feet is the only reason for the rezoning,
Mr. Koe:tting stated that was only orre of the reasons; there: is a possibility they may sell
the property.
Luce-Chairman Deithloff asked for any additional proponents.
Mr. Tony Alcedo, 1113 -Ii.illcrest, believed t.{ai.s to be an ideal, location for neighborhood
b.lsiness.
There being no additional proponents, Vice-Chairman Deithloff ;.asked for any opponents.
Mns. Letty Maloney, 101 Oak Forest, submitted a petition with signatures of horneow.ner•s
opposed to the request. Their main; concerns were traffic, drainage, devaluation of
adjacent residences and loss of privacy.

Mr. Don NForgan, 108 Oak Forest, stated that the e\isting drainage system is not suitable,
and the problem: will be enhanced with C--I zoning.
NIrs. Ann Barton, 1314 Roundtree, questioned why the property had to be rezoned in order
for the church to add an addition.
Mr. Knight stated the property did not have to be rezoned; C-1 provided a five foot
relief.

public hearing.
Vice-Chairman Deithloff noted that three, additional opponents expressed their opinion
through the mail.
Mr. Ingrarn stated that he personally did not feel that the five feet gained justified the
rezoning.
Mr. Owens rude a motion to recommend denial of #ZC-8a-15 as presented.
Cdr. Ingrain seconded the motion and the vote is as follows:
Ayes: rressrs. Ingram, Hill, Deithloff, 1TeMillon, Tyson, Owens
Nays: bone

Vice-Chairman Deithloff opened the public- hearing after explaining the rifles governing
such hearing.
Mr. Anthony Scalise, Partner of Ornega Development, presented the request. He stateL
that an anchor tenant in a small shopping center is normally a convenience store; rnost
convenience stores sell gas which is not allowed in C-1 zoning.
There beiriw no additional proponents or opponents, Vice-Chairman Deithloff closed the
public hearing.

REPORTS
Mr. Rod Tyler reported that the zoning change request for the remainder of Pell Ranch
Terrace would come before the Commission on June 18th. The City Attorney stated that
the City can approve a lesser zoning than what was notified. The City can also reduce,
but not increase the area being rezoned.
N41'°. Tyler also reported that the Request for .Proposal on the zoning and subdivsion
ordinance updates is prepared and ready to be :nailed out to consultants.
Mr. Ingram stated that lie attended the COG seminar for planning & zoning commission
members and found it very informative.
Vice-C'hairnian Deithloff commended the staff on the well--prepared packets.
