HomeMy WebLinkAbout19-1556 09-10-2019 RESOLUTION NO. 19-1556 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS, REQUESTING A REFERENDUM ON THE CONTINUATION OF THE EULESS CRIME CONTROL AND PREVENTION DISTRICT; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Euless, Texas ("City") is a home rule city acting under its charter adopted by the electorate pursuant to Article XI, Section 5, of the Texas Constitution and Chapter 9 of the Local Government Code; and WHEREAS, on November 7, 1995, the citizens of the City of Euless voted to establish a Crime Control and Prevention District within the City; and WHEREAS, Chapter 363, Texas Local Government Code, provides that a Crime Control and Prevention District expires or is dissolved five years after the election that created the District if no continuation referendum is held; and WHEREAS, on August 12, 2000, the citizens of the City of Euless voted to continue the Euless Crime Control and Prevention District within the City for an additional 20 years; and WHEREAS, Section 363.251, Texas Local Government Code, authorizes the City Council, after public hearing, by resolution to request that the Board of the Euless Crime Control and Prevention District order a referendum on whether to continue the Crime Control and Prevention District within the City; and WHEREAS, Section 363.2515 of the Texas Local Government Code allows a district to be continued for a period of 5, 10, 15 or 20 years; and WHEREAS, after notice and public hearing on September 10, 2019, to receive public input, the City Council desires to request that the Board of the Euless Crime Control and Prevention District order a referendum on the continuation of the Euless Crime Control and Prevention District and sales tax for a period of 20 years. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS, THAT: SECTION 1. The City Council of the City of Euless, Texas, hereby requests that the Board of the Crime Control and Prevention District order a referendum to be held on May 2, 2020, for the continuation of the Euless Crime Control and Prevention District and the extension of a local sales and use tax for a period of 20 years, as authorized by Subchapter F of Chapter 363, Texas Local Government Code. SECTION 2. This resolution shall become effective immediately upon passage. APPROVED AND ADOPTED at a regular meeting of the Euless City Council on September 10, 2019, by a vote of 7 ayes, 0 nays, and 0 abstentions.
