Morris. representing MCR International, explained that this is the same site plan that was brought before the Commission about 18 months ago by Fox & Jacobs, At that time, Fox & Jacobs envisioned building the area themselves and they planned on building condominiums on two (2) lots with all the property held in comr.a.-on. He stated Fox & Jacobs had undergone some organizational chart es and had dropped th.cir devc1opmc.rits of this nature. They sold the property to MCR International who.. because of the uncertainty in the condominum inarket, was unable to obtain any financing as long as it was a condo-minium. Therefore, they were proposing a site 0 pl-an which provides lots for each unit where there previously had beeli only two (2) lots. III doing this, they have lost four (4) dwelling units; so there is actually less density proposed now than there was eighteen. (18) anon-IM ago. The major difference betwec.n the previously approved plan and this one is that now, when soimcone buys one of these single family detached homes or one of the townhouses, they actually are buyIng Ille land as wel as the unit. Othcr than that, there are no changes except that city staff had a number of other concerns due to the way the ordinatnce is configured. He further stated that it has taken a long time, and thoug1h they may not feel totally comfortable with every aspect, they feel thit this is probably the best they can come up with in tr4!11100 to add lots in what was previously .I condominium type of development, Vice Chairman Deithloff asked Mr, Morris if he had received a copy of Mr. Rod Tyler's letter dated September 1.3, 1985. Mr. t'vl_orris stated that he had not. Mr. Dcilhloff stated tDat there were several variances noted on the letter and requested that Mr. Tyler elaborate on these va-Irlanccs, Mr. Tyler stated that the letter starts out by addressing the zero-lot line honks and the townhornIcs separatc-ly. f1c stated that the majority of the variances bein.- reclucsted, that differed from the previo-us site plan approved eighteen (18) months ago, were due to the in trod u­ ic)n of lot lives. He went over his letter to the. Mr. Tyson asked Mr. Tyler if this sign would lie conforminx should this specific use permit be granted. Mr. Tyler stated that it would. Mr. Tyson inquired as to whether or not the face of the sign or poll-- could be changed in the future to the same height and area requested should this specific use permit be granted, Mr. Knight stated that the zoning goes with the property. Mr. McNlillon stated that lac had no problem with the upgrading and mi.-.wernizing of the sign, but he would like to see a stipulation so if the building is sold, then would have to enrae back for a specific use permit before changing, the sign face. There was discussion among the Commission as to whether or not the specific use permit could be granted to this particular sign face and this particular pole; and should either one be changed in the future, a new specific use permit would have to be applied for. Mr> Stacy Smith, representing :Mr. 11roug Bochk, explained that a small neighborhood convenience center at this location would be in the public's interest, The property is locatcd on a coNver of a now rnajor arterial and this property is suitable; for a small neighbodmod convenience center of quality design & materials. He stated that they had worked with Mr. Tyler on an ingress lane to avoid :delaying traffic. He also explained that the building would be constructed of rnasonry and glass. Chairman Daithloff asked if they had a tertant scheduled foi- this building;, Mr. Smith: stated that they had no tenant scheduled, but were looking for cleaners, pizza place, sic., they want this to be a classy type building. l+r1r, Owens asked if he was aware that the previous owner's promised that this property remain single family? Mr. Tyson asked if the retail stores would front towards Main Street and also front towards the east, He. also stated that he was aware of the agreement with the previops owner to have these lots remain single family. Mr, Smith stated that some parking was in the rear; that the buildings would be narrow and would front only towards Main Street. He also stated that two (2) units had been built that we.,it into the setbacks. fie lists stated that on one of the units- the problem could be corrected, but the other unit it was a bcdrooni. Fie stated that none of the remainder of the units would- be built into the setback.
