Owens &: Ingram stated their opposition to the request being that tizey did not feel it was the best use for that location. Mr. Ingram Was also concerned with the possibility of the bowling center tailing, and what. would end up in that location. Mr. Tyson stated that if the bowliiq,;, center failed, any of the C---L uses that are already allowed without the Con- missioWs approval could be utilized. He was also concerned with maintenance of the open space and the owner's li ibi.i.ity° ?;fr the public crossing the area to reach the City parks. Mr. Knight stated that if the developer executes a perpetual inaintenance agreement, tic will t.e required to maintain the property. If lie fails to, the City has the right to maintain it and attack a loin on the property. Isle noted that Mr. C-lin left open the possibility of dedicating the open space to the City-. The City Council would address that Option at thr; time of platting if the developer chose to offer dedication of that are. M.r. Hill asked if a 100-year flood analysis would be reclu.ired. Mr. Knight stated that a detailed analysis would be addressed with platting of the _>roperty. Mr. Ingram made a motion to recommend denial of fi1C` 85-38. Mr. Engle questioned how the comprehensive review and upcinte of the zoning and subdivision ordinances would affect this area. Mr. `Tyler stated he did not J avow at this tin,(.;.
