I. PUBLIC HEARING - #ZC-86-06
Request of David Bergh, of Bergh .IV, for a Specific Use Permit to
allow a 500 foot Communications Tower on a portion of Block E,
International Regional Industrial. Complex, located east & adjacent to
Westpar k Way, across from the City of Euless Animal Shelter & Service
Center, totaling 17.3873 acres.

Request of Mr. & Mrs. Charles Brake. for a Specific Use Permit for a
satellite dish antenna over twelve (12) facet in height and Less than

CALL TO ORDER
The regular meeting of the Planning & 'e oning Commission was called to order at
7:30 p.m. in the Council Chanters of Euless City Hall. by Chairman John

Chairman peithloff explained the rules governing a public hearing and then
opened the public hearing.
Mr. Gene Penrod, Kilo Distributing, stated that. fie was working with the applicant
in the building of the co-mmunicat ions tower. , and he would answer ally questions
the Commission may have.
Chairman ueithloff asked if fie had received approval from the F.A.A. and the
F.C.C. and any other authorities.
Mr. Penrod stated that they did have approval from:t the F.A.A. to construct. a 494
foot structure and that this was the only government authority they had to have.
approval from. He stated that the F.C.C, did not have control over the. struc-
ture itself.
After some discussion as to the height of other structures for reference, 'fir.
Tyson asked Mr. Penrod to explain the exact use of the tower.
Mr. Penrod stated that it would be a communications support structure. for
antennas for cellular phones and the like. He added that there would be no
distortion or interference with television, radio or with the City's fire and
police communications within the City.
Mr. :Engle asked if there would be any other structures on the lot other than the
tower itself.
?sir. Penrod stated that this tower sat on a forty-five foot (45' ) base from leg
to leg. Under the tower would be a building to house all repeaters and other
equipment deeded. Eventually, they propose to put in a T.V. studio and possibly
a two-way shop for servicing mobile radios.
There being no further questions, Chairman. Dei.thloff asked for any proponents.
There being no further proponents, Chairman Deithloff asked for any opponents.
There were no opponents.
Mr. Tyson stated that he would like to ask the tower manufacturer about the
structure as far as wind security.
Mr. Himey Raesx, Bector Structural, Mansfield, Texas, stated that they had
extensive experience in wind. protection and that this Lower would be able to
withstand winds of up to 1.70 miles per hour, which well exceeds all requirements
for such a tower.

Mr. Tyler asked Mr. Penrod if he was aware that this lot would have to be final
platted and buil.di.aag permits issued before cor:struction on the tower could
begin.
Mr. Penrod stated he was aware of this.
There being no additional discussion Chairman Deithloff closed than public
hearing.
Mr. Tyson stated that this area was :zoned industrial, and that the City was
looking for industrial uses ii-n this area, so: he felt that this was a good use
for this property.
Mr. Ingram made a motion to recommend approval of #Z,C-86°06 subject to Rod
Tyler's letter dated May 1, 1986, and construction of the tower beginning within
one (1) year after City Council approval..
Mr. Balsinger seconded the motion, and the vote is as follows:
Ayes: Messers. Ingram, Bal.singer, Deithloff, Hill, Ingram, Owens & Tyson
Nays; Done

USE PERMIT FOR A SATELLITE DISH ANTENNA OVER TWELVE FEET (12') IN HEIGHT AND

S. SHEPPARD DRIVE) OF THE PARK CRESTMOOR ADDITION
Chairman Deithloff explained the rules governing a public hearing and then
opened the public hearing.
Mrs. Joy Brake, 216 S. Sheppard, stated she was the applicant of this -request,
She explained that about one (1) year ago they decided to buy a satellite di

She noted that their dish had been up one (1) year when they received a red tag
from the City Inspections ;Department. She stated that she then called to find
out what the problem was. The inspector explained that he had driver by and
seen that it was not in compliance with the City ordinances. She explained that
t.hp salesman that had told them there were no City -requirements no Longer works
for the company, so they had no recourse with the dish company. She explained
that this is wiry they were asking for a specific use permit, to allow the dish
to stay where -it had already been installed and had existed for a year. She
stated that she had polled all her neighbors and no one had any problem with the
dish being in the location it was.
Mr. Hill asked if the satellite dish antenna company had conducted a wind
analysis to check ghat wind loading this antenna could withstand.
Mrs. Brake stated that she did not know,
Mr. Ingram stated that he had gone by their horse and that the dish was lit-
erally mounted into the structure of the house and he did not personally foresee
how there could be any danger from wind, regarding the antenna not being stable
enough.
There being no further questions for Mrs. Brake at that time, Chairman Dei.thloff
asked for any other proponents.
Mrs. Gloria may, 220 S. Sheppard, :sated that she had no problems with the
Brake's disc: in that location and asked that the Commission grant their request..
Mr. Bill Kelly, 300 i?idgecrest, also stated that he had no problems with this
request and that he would like to sere the Commission grant Mrs. }Brake's request.
There being no further proponents, Chairman Deithloff asked for any opponents.
There. Being none, Chairman P.eithloff closed the public hearing.
Mr. Tyson asked Mrs. Brake if there was not some way, possibly in the garden
area., that the dish could be erected within the codes of the City.
Mrs. Brake stated that daze to the wooded area, they were advised this could
cause problems with interference of reception,
Mr. Owens asked Mrs. Brake to clarify when they had installed the dish and when
the first time they had received any notice from the inspections Department that.
they were in violation of any ordinances.
Mrs. Brake stated they had the dish erected in the late part of April, 1985, and
were notified that they were in violation about a month ago, which was exactly a
year after the dish was installed.
Mr. Owens asked if there had been any construction on the streets around her
house, or anything that could. have brought an inspector out around her house.

Mrs. Brake stated that she had called after receiving the real, tag and asked what
had caused this after a year, and the inspector told her that he ju:.st happened
to drive by and saw that they were in violation.
Mr. Owens stated that he felt. the Wspectors were doing everything required
within their Job, but that it did hoofer him that it took them a year to find
such a violation and notify the homeowner. .
There being no farther questions, Chairman 0ei.thloff closed the public hearing.
Mr. Engle stated that there was no question that:. the Brakes were in violation of
city ordinances, which were written for a purpose. He further stated that it
was his personal opi.ni.on that the Brake's recourse could be against the company
that installed the disci and misinformed them of the City's requirements, Mr.
Engle stated he felt that it was not up to the Commission members to grant a
Specific Use Permit for everyone t hat came before them because they were not in
compliance with City ordinances.
Mr. Hill stated that he agreed with Mr. Engle.
'sir.. Owens stated that he felt that the Specific Use Permit procedure was estab-
lished for a reason, this being one of them. He felt that this dish had. been
erected for a year before- having anything done about. it.. So, in this instance,
he felt a Specific Use Permit should be granted.
After much deliberation between than Commissioners, Chairman Deithloff stated
that he would entertain a motion.

Nays: Messers. Deithloff, Engle, Hill, Ingram & Tyson
The motion dial not carry. Mr. Deithloff stated that he would entertain a motion
for denial or tabling.
Mr. Engle made a motion to recommend denial of #ZC-86-07.
Mr. Ingram seconded the motion and the vote is as fellows:

Nays: Messers. Owens & Balsinger

PUBLIC HEARING - #ZC-86-08 - REQUEST OF SHOWBOAT LANES FOR A SPECIFIC USE PEMIT

Chairman Deithloff explained the rubs governing a public hearing and then
opened the public hearing.
Mr. Keith a ittle, 4.151 N. O'Connor, Irving, Texas, presented the request, He
stated that they had nine bowling centers throughout the United States, some of
which are Don Garter Bowling Centers. He presented the commission members with
pictures of some of, these centers. He stated. that 55-65 jobs would be generated
by this bowling center. He stated that he had seven liquor permits in corjunc-
tion+ with his center:� and never had one citation regarding this. He stated that
there would only be one entrance -into the lounge from the outside, rather than
the two stated Ira Rod Tyler r s letter of May 1 , 1986, He further stated that
this entrance from the outside into the lounge was primarily for fire protection
purpose's and, because it J_s rewired, they just dress it up and accent it.
Mr. Kerry Hargrove, the architect for Showboat lanes stated the building would
be of tilt wall and stucco construction, and the commissioners could be assured,
that it would not be an eyesore.
Mr. Little stated that they would like to be open by October of .1.986 and they
had no problem with a stipulation that construction, begin, within one year after
City Council. approval.
In response to a question, Air. little explained that the estimate of liquor
sales not exceeding 30% of the gross receipt sales was based on projections and
estimates of their other bowling centers, however, they really* had no way of
anticipating what would. be the actual amount of total sales for this sate,
Mr. Engle stated that. the Don Carter }fowling Centers in the metroplex that he
was aware of were Mainly in "restaurant row" type areas, not so close to r.esi.-
dential, areas. He then. asked Mr. Little how many other bowling centers he had
built in a primarily residential area such as Euless.
#r. Little stated that he had one in Batan Rouge near LSU about a half block
from a residential area. He further stated that they had never had a complaint
from any neighbor about_ the Looks of the building, of any noise from the center
or anything. He assured the commissioners that they invest a lot of money to
ensure that everything is done first class.
Mr. Deithloiff asked if they had cond+xcted any kind of traffic studies for the
means of ingress and egress off the freeway.
Mr. Kerry Hargrove stated that they had not, other than just their visual. obser-
vance.

Chairman Deithloff asked for any other proponents. There being none, he asked
for any opponents. There being none, Chairwan Deitblofa ctic,sed t.3 public
hearing.
Mr. Owens stated that in comparison he felt this bowling center far surpassed
the howling center recently considered by the Commission arid, therefore., felt
the new center would be a very welcomed addition to the City of Euless.
Mr. Tyson stated he was very pleased that Mr. Little would want to come to
Euless and get a bowling center of this caliber started; however, tae felt that.
this area was not the highest and. best use for property at this location. He
further stated that Euless was running out of vacant land along Airport. Freeway
where the City was trying to promote high rise office developments; therefore,
he felt that this property's highest and best use was not a bowling center, but
should be reserved for a multistory office building.
Mr. :Ingram stated that he basically agreed with Mr. Tyson and hail seen no
substantial evidence to lead him to believe that this was the best use for this
site.
Mr. Tyson ;Trade a motion to recommend denial to City Council of #ZC-86-08.
Mr. Ingram seconded the motion and the vote is as fellows:
Ayes: Messers. Tyson, Ingram, Hill., Engle
Nays: Messers. Deithloff, balsinger, Owens
Chairman Deithloff declared the motion carried.
Mr. Joy: Longton, 8100 Loma Alto, Dallas, a minority partner with Showboat Lanes
asked that the public bearing be reopened so he could make a statement to the
commissioners.
Chairman Deithloff asked if the commission so desired to bear Mr. Longtor_.
Mr. Owens stated that he felt they should.
Chairman Deithloff declared the public '-tearing reopened.
Mr. Longt.on stated that he was a c::onmrerci.al real estate broker in Dallas. He
stated that he was also a Greater Dallas Board of Realtor and, because of this,
was very sensitive and aware of land rase. lie referred to the commission's
beliefs that this was not good use of the property. and they thought they would
rather see a high rise office building in this location.
He wanted to point out to the commissioners that many of the office buildings
along Airport Freeway at this time had up to a 750 vacancy rage. Upon ques-
tioning from Mr. Engle, Mr. Lvngton could not name a specific building along
Airport Freeway which had a 75% vacancy rate. He continued to explain that.
there is a several year supply of high :rise office buildings in the metroplex.
Hi-:s wanted to point out that when there is this Kind of vacancy ratio, what is
seem is empty parking :Lots and lack of maintenance, He felt that Showboat Lanes
was good family entertainment that was a money making business.

Mr. Balsinger then stated that he had to agree: with Mr. hongston, that in his
business he calls on a lot commercial buildings and a lot of these buildings
had a tremendous vacancy ratio. He felt the City had plenty of proposed office
sites and that he would rather go ahead and see the bowling center goo in.
Mr. Owens stated he was not trying to promote any more office buildings, that he
would :rather promote some money making business.
There being no further new aspects to bring up, Chairman Beithloff closed the
public hearing and stated that the previous mbtion still stood.
IV.
RE"WORTS
Mr. Tyler made mention of NCTCOG Commissioners Training Series for "Planning for
Fiscal Responsibility, Part V" and advised that if anyone was interested they
should contact him for further information. Additionally, Hie pointed out an
article by Bruce McClendon that they may find of interest.
Tom Engle expressed his graditude to the Commission, City Council and staff for
their concerns and support after his mother's death.
