PUBLIC HEARING - #ZC-87-04 Request of Facetrac Petroleum, Inc. , for a change of zoning on a portion of Tract. iJIA of the A.J. Hu.it.t survey, Abstract 684, totaling 0.89 acres, FROM its present zoning of C-2 TO C-2 with a Specific Use Permit for a general business pole sign of increased height and area. The property is generally located on the north side of the :300 block of S.H. 10, at the intersection of 5.H� 10 and Martha Street.. II. REPORTS 1987-053. REGULAR MEETING Planning ,& Zoning Commission June 2, 1987 CALL TO ORDER The regular meeting of the Planning & Zoning Cocmission was called to artier at 7;33 p.m. in the Council Chambers of Fglees, City Ball by Chairman Larry Ingram. PUBLIC SING - #ZC-87-09 - REQUEST OF RACETRAC PETROLEUM, INC., FOR A CHANGE OF ZONING ON A PORTION OF TRACT 131A OF THIS A.J. HUITT SURVEY, A°684, TOTALINC 0.89 ACRES, FROM ITS PRESENT ZONING OF C-2 TO C-2 WITH A SPECIFIC USE PERK TT FOR A GENERAL BUSINESS POLE SIGN OF INCREASED HEIGHT AND AREA.. THE PROPERTY IS GENERAUY LOCATED ON THE NORTH SIDE OF THE 300 BLOCK OF S.H. 10, .AT THE INTERSECTION OF S.H. 10 AND MARTHA STREET Chairman Ingram explained the rules governing the public hearing and then opened the public hearing. Ma. ,loan Harrington, Plano, Texas, real. estate representative for Racetrac Petroleum, recapped that at. the meeting for their previous zoning case, they requested an 800 sq.ft. sign which was denied.. `i'hey withdrew the zoning case and are now requesting a 200 sq.ft. sign, 28 ft. high. She also noted that according to Racetrac:°s standards, the property is considered a highway location, drawing traffic from the interstate highway, Chairman Ingram asked if there were any additional proponents. Ms. Juanita Motley, Marietta, Georgia, real estate representative for Racetrac Petroleum, stated that she worked on this site location.. She mated that Racetrac Petroleum appeals mainly to interstate traffic. They buy gas in volume and their profit is just a few pennies a gallon above cost. Their signs are their only advertisement. They have noticed that their least profitable stations are the ones with smaller signs. She mentioned stations located. on Grapevine Highway in North Richland Hills, Pioneer Parkway near S.H. 360 in Arlington, and Loop 820 at S.H. 10 in Hurst. The stations in Arlington and on Grapevine Highway leave signs around 50 sq. ft. and have become unprc-�fitable stations because the signs Kure not large enough for the traffic to see the gas prices. The sign. in Hurst is approximately .171 sq, ft. , 30 ft. High and appears to he large enough to draw traffic off the freeway. Ms. Motley noted that signage used to not be a problem for Racetrac. However, because of the reduced sales from the stations with smaller signs, Racetrac now includes approval. of signs as a contingency to closing oil property. That is the case in this location. Chairman Ingram asked if there were any additional proponents. There being none, be asked for any opponents. There being none, he closed the public hearing. Mr. Tyson believed that the size of the sign would not influence sales and that. the ordinance should be adhered. to. Mr. Owens noted he was in favor. Ingram, Zahn, and Tyson AbstenL.ions: Mr. Bill Chairman Ingram declared the motion not carried. Mr. Tyson stated that he was familiar with the site and was not aware of any topography problem, nor had one been doctmented by the applicants as required by ordinance and, therefore, rrlade a motion to recommend denial of M-87-09, as presented., Mr. /ahn seconded the motion. Messrs. Deithloff and Owens thought that there was a topography problem and that a larger sign was needed since the property was not located directly on the freeway. They also thought that the sign ordinance needed to be rewritten. Chairman Ingram agreed with ter. . Tyson and stated that the sign ordinance, along with the rest of the zoning ordinance, had recently been reviewed by the Commission and passed. on to 'the C'iLy Council. The vote was as follows: Ayes: Messrs. Tyson, Zahn, and Ingram *gays: Messrs. Owens, Balsinger, and Deithloff Abstentions: Mr. Hill Chairman Ingram declared the motion. not carried. Additional discussion took place among the Commission concerning the locations and sign sizes of the area R.acetrac stations. Mr. Zahn noted that this location wca!ld. primarily verve local traffic and the sign should stay close to the ordinance regrzirement.s. Mr. Owens discussed with the applicant the possibility of rr.?coring the request to 171 sci.f i, , equal to the one in HEXrst. After consideration,, Ms. Motley amended her zoning request for a maxilmim size sign of 171 sq.ft.. , 28 ft. high. Mr. Balsinger made a motion to recommend approval of #7C-87°09, as amended. Mr. Owens seconded the request. Mr. Tyson state(] that there was not a sign:i.ficant difference between 200 and 171 sq.ft. and that it still. did not comply with the :intent. of the ordinance. The vote was as follows: Ages: Messrs. Hill, Owens, Deit.hloff and Balsinger Nays: Messrs.
