PUBLIC ,HEARING - SPH-#87-01 - REQUEST OF JERRY L. HAYES, D.V.M. TO OPERATE A TEMPORARY MOBILE ANIMAL CLINIC IN THE K-MARI PARKING LOT ON JULY 2 & 3, 1988, AND SEPTFXBER 24 & 25, 198€1. THE PROPERTY IS GENERALLY LOCATED IN THE SOU rBEAST CORNER OF S.H. 10 AND F.M. 157. {Chairman Ingram explained that this item had been forwarded to the Planni.ng & Zoning Cottmiss:ion from the City Goancil for a public hearing and a recommendation. He then explained the rules governing :a public hearing and opened the public hc?aring, Dr. .Terry L. Ha.ye:a, 4550 Mansfield Highway, Fort Worth, Texas, pre- sented his request and explained that Animobil.e Veterinary Clinic is ,a fully equipped service that has served in marry of the neighboring cities. He further stated that he has :nerved ire Tarrant County for two year's and Dallas Goun t y for five years. In. response_ to a Question by Mr. Owens, Dr. Hayes explained that there had been an Ani_mobi l.e`. Veterinary Clinic_ set up for service less than two miles -From his office on Mansfield Hl.ghway i.n Fort north, and thi.*, had not affected his practice. There being no further questions for Dr. Hayes, Chairman Ingram caller:; for any additional proponents. GMs. Heinrich explained thaat routine vaccinations are offered through this service, and their- services are more rea:z:c±nabl.y priced, tli.ts, enabling those who would normally riot take their pets for shots to de so. There being no further questions for Ms. Beinrich, Chairman: Ingram asked for any additional proponents. `there being none, Chairman Ingram asked for any opponents. Mr. Frank. Douglass, 502 Martin, Euless, Texas, explained that In approving a request of this nature, a precedent. for corner venders would be established and was not fair to the nermartent merchants and. ci.tize[Es of Euless. y Dr. E. T. Skidmore, 2501 :Main, Euless, Texas, stated he rank the Euless Animal Hospital.. Dr-. Skidmore felt there was no need for this ttlpe of service in Euless because there are seven diets in Euless alone, not to mention those :t.n the entire mid-cities. He felt this wotil.d not be fair to the merchants who pay tares in Euless, and Further stated he felt Dr. Haves was possibly breaking the Code. of Ethics est,zblished for Texas veterinarians. Dr. Skidmot-e then re- cluested that, should the P & anal City Council decided to approve this, as $3,000.00 fee be charged to fir. Hayes because, in his, oiSiEa:i.c;an, this would make the situation a xxtt.Le more fair to the veterinarians e>stahl.islaed in the City of :Euless. 1987--€799 PLANNTNG & WRING C0WIISS1(XQ DECEMBER 1 1987 PAGE THREE Dr , Tom Bradford, 1.6 W. Euless Blvd. , Mid-Cities Animal Hospital, explained that he was not worried about the mobile clinic depleting his practice because of four days out ;tf the year, but was more concerned about the service and the general good that it really would furnish to the citizens of Euless. Dr. Bradford's concerns were that the animals being vaccinated would not receive the total examination they needed and, thus, potentially doing more harm to the general public_ than good. There being no further questions for Mr. Bradford, Chairman Ingram asked for any additional. opponents. There being none, Chairman Ingrat:t closed the public hearing and opened discussion among the Commission members. Mr. Tyson stated he was riot in favor of this request because be felt it was not in the best interest of the citizens of Euless; now because of monetary reasons, but because it may have the effect. of reducing the total quality of veterinary services in the City and erode the City's tax vase, both of which would be detrimental to the general welfare. Mr. Owens explained that, in his opinion., the zoning c•1.assificati.on for the a.r£.-`.a in which Dr. Hayes wanted to operate from was not in- tended for temporary uses. Mr. Deithloff stated that allowing "mobile" type operations may be appropriate where such services are not offered, but veterinary services are available; and to allow such an operation, wS_?L3ld serve no purpose.. Chairman Ingram felt the City of Euless was adequately covered with animal vaccination services and there was no need for the additional services offered by a mobile clinic, Chairman Ingram asked Dr. Hayes if he had any comments regarding the discussion. Dr. Hayes explained that all veterinarians are required to practice in accordance with state law, not by the AVNA. Dr-. Hayes further stated tttat he was not violating the Veterinarians Code of ethics, nor was he in violation of state. laws. He reiterates: that Animobile Veterinary Clinic has been in business for five years and has not been found to be illegal. There being no further discussion between the Commissioners, Chairman Ingram stated he would entertain a motion. -?r. (>,iens made a motion to re.ccm:taatend- denial of Si'H-ii8 j-€31 because_ hct felt a Sp::!cific Use. Permit would not be. applicable for this type of use. Mr. Deithloff seconded the motion. 1981--100 PLANNING & ZONING CQMMISSION DECEffB}sR 1 1987, PAGE FOUR There: was some discussion between the Comn.zssi.oners as to what way really being requested. Tt. was clarified that this request was itrst a Specific Use Permit, but permission from! City Council vii. a resolution. which would allow the use under the terms specified in this case, such as for the days specified, and the location requestrid, etc. Mr. Nens withdrew his motion. Mr. Zahn made a motion that the com-ril.s.s i_on recommend the City Council deny Dr. Hayes' request -to operate a temporary r:ohile animal clinic in the K-Mart varying lot on the days specified because such an eperati.cn would be. more detrimental to the genera'- public welfare than benefi- tial. Mr. Owens seconded the motion and the vote was as follows- Ayes: Messer.s. Zahn, Owens, Tyson, Ingram & Deithlof Nays: None ("hai rman Ingram declared the mot:i.on carried. II.
