Mr. Don Gossett, Land Surveyor, presented this request. He stated that work
would begin as soon its approval was g:i.ven. He also stated that the reason for
res:_tbmit.tai. of the preliminary plat was for an easement change its order to make
more land available for the building orx the kacetrac site.

Chairman. Ingram explained the rules governing a public hearing and then opened
the public hearing.
Mr. John Cockrell., Jr. , 2215 Clive Street, Dallas, Texas, representing CoEqu'ity
Corporation, presented this request. He stated that the project was for 51 zero
lot line single-family houses, m:i.ni-warehouses and a small parcel on N. Malin
Street. for C-2 zoning. tor. Cockrell stated that previously the Commission
approved the rezoning on this property to attached and detached condominiums;
however, due to the turn in the economy, Coi±•quity has been unable to obtain
financing to build the project. With this request, they hope. to be more on
target with the current market demands for more single-family zero lot line
homes, mini-wa-rehouses and a commercial pad site compatible with the existing
shopping center.
Mr. Cockrell referred to the staff letter to the Commission r:renibers :sated
December 31, 1.987, in which three items of primary concern were noted. The
first item referred to the houses being 100% brick including the second floor on
the sides on the property line. He understood this referred to any gables or
second stories having to be masonry brisk_. He thought that the houses would he
single story and would not affect that request.
The second item noted in the staff letter recommended that the fence between the
mini-warehouse property and the single-family areas should be masonry. Mr.
Cockrell stated that this would be a substantial expense and that since there
was no potential buyer for the min i-warehou sets, as yet, he was unable to know
for sure what objections they would have either from a cost: or use standpoint.
He stated that they want the single-family logs to be attractive and desirable
so that the builders would build on them To t'rese ends, they propose to set
the wood fence slightly back from the property line and plant two trees in the
rear of single-family lots for screening.
The third item, in the staff letter referred to the C.-2 request, Mr. Cockrell
s'ated that the main difficulty they have with the C:-1 zoning district is that
it does not allow drive-ins or drive-thru windows. Again, Mr. Cockrell stated
that they do not have a user for the property yet, and the C-2 zoning, because
it allows more uses, would less restrict their ability to sell it. He farther
stated that the shopping center to the north is zoned C:-2 and, therefore, C-2
zoning would be more compatible than C-1 .

Mr. Robert Carlin, part owner in the Harwood Crossing Shopping Center adjacent
to this proposed request, stated that he was in favor of this project. He also
stated that Mr. Cockr:el.l. Worked With them on the concept: of the existing zoning
for attached and detached coandominiu:ms. However, since that time, the market
than changed and the felt that the new concept-, if done tastefully, would blend
With the existing shopping center on the west and multi-family housing on the
east.
Chairman Ingra:hh asked if there were any ether proponents. There being Acne,
Chairman Ingram asked if there were any opponents.
Mrs. Flaine Fries, 117 Stoney Creek, Euless, Texas, stated that she bad been
before the Cogwiission when this property was first rezoned and, at that tine,
she was a:assured that this extra space would not he used for commercial use,
Mrs. Fries stated that the company representing this request has comp in asking
for a little e more commercial area and that next time they will he requesting
even more commercial area. She also st_a.ted that until there was a buyer for
this property, this request should be voted against;.
One specific objection of Mrs. fries was the proposed street directly alongside
the fence on the south side of the project. She felt this was in conflict With
what: ha.ci previously been approved and contrary to what the existing residents
wanted.
Additionally, Mrs. Fries stated that when the shopping center was proposed, the
homeowners were assured the lights and noise would not affect them in any way.
She stated that the lights and noise do affect the homeowners even to the point
that she has been awakened at early hours of the morning by the durnpster_ removal
service and the delivery 1 trucks. She also stated that she had N3 i.nstal.l a
bamboo curtain on her patio in order to shield it from the lights of the shop-
ping center which disturbed her on summer evenings. In i-aer• opinion, moving the
commercial area cl user to the existing residents would only Worsen the problem.
Chairman Ingram inquired if there were any other. opponents. There being none,

the applicant:.
Mr. Owens asked if they would be willing to adjust: their plan to alleviate some
of the concerns expressed.
Mr. Cockrell stated that they were still asking for C-2 in order to maintain
their options because of the difficulty of the marketplace and are trying to
make sure that they are as free as they can be to market the property.
In response -to ter. Tyson's concern over the proposed wood fence, Mr. Carlin
stated the wood fence separating the proposed residential from the shopping
center and proposed mini-warehouse would have a softer appearance and be less
costly than a masonry fence. He stated he could see potential problems with
cars running into the fence and damaging it because of the location of parking
on the mini-warehouse site, bit could not coimnent. on correct-JEve measures since
they, as yet;, did not have a user.

Mr-. Tyson inquired as to 'how they were going to maintain security with a wood
pence.
Mr. Carlin stated they had not had a chance to talk to potential builders of the
mini-warehouses.
Chairman Ingram asked Mr. Rod Tyler, Senior Planner, to clarify the 1100% masonry
wall requirement on the zero lot line wall.
Mr. Tyler stated that if a gable does end on the zero lot line, side of the wall,
i.t wil i need to be masonry. If its a two story unit, it would have to be
masonry all the way up to the roof deck. No penetration means that there are no
w1 ndows or doors on that wall. Masonry is -requi.red 'because it is the most
maintenance free material. k maintenance easement is also required cn the
adjacent property when maintenance is rze�::�ssi:toted.
Chairman Ingram closed the public_ bearing and opened the discussion armor; the
Commission Members.
Mr. 'Tyson stated that he was in favor of the concept proposed, i.e. , the
dedicated street and the zero lot line bouses, however., he also had some
reservations to the plan. as proposed. The first item that concerned him was the
proposed fifteen foot (15' ) rear hard setback adjacent. to the existing
dwellings. lie. stated that the c��xrrc_nt planned development an the property
requires a twenty-five foot (25' ) rear setback along; the south, and with the
proposed change, the setback would. be fifteen feet (15' ). He stated this would
encroach upon the existing neighborhood ten more feet than n what had b!em.,
;previously agreed to. Another concern of Mr. Tyson was the placement of the
street against the existing fence which was not planned before. The C;-2 zoning
also concerned Mr. Tyson since its rez.-Ming would completely eliminate any
buffer between the existing dwellings to the south and the existing shopping
center. He stated he was very concerned about the quality of life afforded by a
Douse that. backed up. to a shopping center. He felt that r.-mini-warehiouses do act.
a F some sort, of buffer, but work was needed on the screening requirements to
make sure the proposed units were adequately protected, He stated that, though
he liked the overall concept, he felt the negatives of the proposed plaza
out-weighed the positives and, therefore, unt:i.l these items were corrected, he
could. not support: it.
Mr. Owens stated that lie agreed with Mr. Tyson and wished the applicants of the
request were more receptive to making changes to the- proposed plaza.
Chairman Ingram asked if there were any other. discussions. There being none,
Chair man Ins;ram asked for a motion.
Mrs. Tyson trade a motion to recommend denial of 2'C488--01 as presented.
Mr. T:eti.tbl.o.f.f seconded the motion and the vote was as follows:

USE PERMIT TO ALLOW A SATE1JJT, RECEPTION DISH GREATER IN HEIGHT THAN 12 FEET
(I-F., 15'-8") AT 410 MORRISON DRIVE (LOT 6, BLOCK 3, BEAR CREEK. ESTAT&IS). THE
PROPERTY IS GENERALLY LOCATED CAN THE NORTH SIDE OF MORRISON DRIVE BET EEKN
DRISKILL DRIVE AND CaHIUW ANN DRIVE IN THE BRAR CRS ESTATES ADDITION
Chairman Ingram stated t'iat before he would open the public hearing he would
read a statement handed to him before the meE ti.ng. The statement dated .iP./Sa
reads, t17ear Commi.ssioners, I wish to withdraw my request. for specific use
permit in case gC-88-02. This request. is for a satellite eisll. T will remove
the dish witl;.:tn five days. I will resubmit an application at. a later date for a
