REPORTS REGULAR MELTING MY-SS PIING & WNING COMMISSION April 19, 1988 CALL TO ORDER The regular meeting of the Planning Zoning Commission was called to order at 7:33 p.m. in the Council Chambers of Etile.ss City Hall by Chairman Larry Ingram. INVOCATION The invocation was given by Mr. Carl Tyson. APPROVAL OF MINUTES The minutes of the regular meeting dated March 1, 1988, were approved as written. PAGE TWO PLANNING & ZONING CONNISSION STING APRIL 19 1988 I. CONSIDER PLATTING #P-88°03 REVISED PRELIMINARY PLAT AND ENGINEERING PLANS OF GLADE CROSSING BAPTIST CHURCH ADDITION, 19.76 ACRES, MUTED SOUTH. OF GI<ADE ROAD, NORTH OF iCIMON RIDGE ADDITION AND WEST OF OAR: HOLM ADDITION Mr. David C, Hughes, Jr. , P.E. , Elliott & Hughes, Inc. , presented the plat on behalf of glade Crossing Baptist Church. He pointed out that the northern portion of the property was recently rezoned, necessitating the. revised preliminary plat. He voted that the two southernmost lots will be retained by the church and one of those lots has been final platted. Mr. Owens made. a motion to approve #P_88-03 as presented. Mr. Hill seconded the motion, and the vote is as follows: Ayes: Messrs. Owens, Bill, Tyson, Zahn, and Ingram Nays: None Chairman Ingram declared the motion carried. Mr. Owens expressed that he felt the Council's changes in the development playa were good. II. CONSIDER PLATTING -- #P--88-05 - PRELIMINARY PLAT AND ENGINEERING PLANS OF RACETRAC ADDITION, 9.1531 ACRES, LOCATED ON THE EASTERN SIDE OF F.M. 157, APPROXIBATELY 200 FRET NORTH OF MIDWAY DRIVE Mr. Dave Nigh. wonger, Albert Halff & Associates, Dallas, Texas, presented the plat on behalf of .Richardson Savings & z,oan. He noted. that Lot:. 2 is under contract for purchase by Racetrac Petroleum, Mr. Knight asked Mr. Nighsworager if he had checked with the State Highway Department regarding additional right-of-way, needed. Mr. Ni.ghswonger responded that an additional fifteen feet (15' ) of right-of-way will be required along F.M. 157. Mr. Hill made a caotion to approve #P-738-05 subject to the proper right--of-way being provided at the time of final platting. Mr. Zahn seconded the motion and the vote is as follows: Ayes. Messrs. Frill, Zahn, Tyson, Owens and Ingram Nays: None Chairman Ingram declared the motion carried. PAGE THREE PIaAMTNG & 7f1N:fNG CA)MMTSSION MEETING, APRIL 1.4 1988 NOTE; There were several residents in the audience who wanted to speak regarding this item. Mr. Pete Kahler, 506 Parker Drive, stated that there were too arany gas stations in the area already. He was opposed to one next 'to the residences. Chairman Ingram explained that platting was an administrative process. He further explained that the plat must be approved if it met the subdivision ordinance requirements. He noted that the existing zoning on the pr-operty was C-k' and had been since 1964, and that a gas station could be constructed there without City approval as long as the property was properly platted. Mr. L. C. Simmons, Jr. , 509 Parker Drive, asked how close something could be c.onst ruc.ted near his property. Mx•. Knight stated that the commercial bu i ldi.ng cc7uld not be constructed closer than fifteen feet (158 ) to the rear property lime. IIT. PUBLIC REARIM -- #7.G-88-06 - REQUEST OF RACETRAC PETROLEUM, INC. , FOR A CHANGE OF ZONING ON A PORTION OF TRACT 7C, J. P. 11ALFOR1D SURVEY, A-711, FROM ITS CURRENT ;?ON NG OF C-2 (CA MMUNITY BUSINESS DISTRICT) TO C-2 (COMMUIWITY BUSINESS DISTRICT) WITH A SPECIFIC USE PERMIT FOR A GENERAL BUSINESS POLE SIGN OF INCREASED AREA. Ms. Joan Harrington, representatives for Rac.etrac Petroleum, presented the request for 171 sq. ft. sign. She stated that a 50 sq. ft. sign, as currently allowed by ordinance, would not be seen because of the 'fir. "Mi " Sig.-a. Chairman Ingram asked for any additional proponents. There being none, lie asked for any opponents. Mr. Pete Kahler, 506 Parker; Mr. L. C. Simmons, 509 Parker; and Mrs- Robert. Pourman, 601 Parker, spoke against the zoning request. They cited their be iefs that the sign would cause too much Light. in their backyards, deteriorate the visual effect of the City, and perpetuate the requests for oversized signs along 1v.M. 157. PACE FOUR PLANNING & ZONING COMMISSION MKOUNG FAIL I9 x.985 Chairman ingrain noted that Mr. John Gruspier, 503 Parker and Mrs. Aida Mc_Klnzie, 50.5 Parker, were also opposed, although they did not wish to address the Commission. There being no further opponents wishing to speak, Chairman Ingram closed the public hearing. Chalrman Ingram explained to Ms. Barrington that it is the petitioner's responsibility to fully document and ,justif,, the request for a larger sign dare to topography. Ms. Barrington reiterated that they were requesting the larger sign because the smaller sign would be blocked by the existing sign: of Mfr. "M" and the cleaners. Tiara Commissioners were in agreement that the sign ordinance was clear on this issue and they were not aware of any situation at the subject site- that would require a variance. It was also noted that the Paeetrac sign would block the Mr. "M" and cleaners signs from the north. Mr. Owens matte a motion to recommend denial of #ZC-88-06 due to the ordinance being definite in this regard. Mr-. Tyson seconded the motion and the vote is as follows: Ayes: Messrs. Owens, Tyson, Zahn, Hill and Ingram Nays: None Chairman Ingram declared the motion carried. Iv. :REPORTS There were no reports to be discussed. V.
