Mr. Little sated that not only had the screening torah been increased _ to a height of eigl'lt feet (8' ) , but the itself had lh'e n lowered three feet. (3' ) . T.-he building was relocated (flipped) as requested at the first meeting and was located I{ feet from the comr?on property .line; this was further away from the coo-mon property line than discussed originally, Air. . Manuel's property as is currently the problem. Mr. Little stated that eac-h property owner in opposition on July 3, 1990, had received a hand delivered letter and revised site ply._. prior to this meeting. Mr. Little thanked the Commission for the opportun- ity to readdress this issue and stated that Mr. Jeff .Bryan, owner of Durable Specialties, Inc. , was present to answer questions concerning the operation of this facility. Mr. Bryan, owner, apologized to the Commission for his inability to attend t.i-t?_ meeting on July 3, 199C and offerer to answer any ques- tions they may have concerning the operation of such a facility. 1he Comndasion's primary concerns -were ant.icsy>atF`d traffic at the facility,it`y', :and the ;lour:_ of operation. Mr. Bryan explained that His, was primarily a "drop-off" type operation.ion. so traffic should be mF.e'i1.mal. Hlthough nothing was definite, the .latest g&me should 3i? ending at 11:00 p.m. The primary ,ages of participants, according to Mr. Bryan, ;could be 7 to 15 years The Ccrm;,is_,'ioners� i haF_;�ed Er. Bryan for attending this meeting and stated they had no further questions Mike Ballard, 405 Rambling, asked if he could spear. Caro Hill stated they would listen st.:n to ?fir. Ballard' s comments, but that the public Fearing had been closed at the first meeting and Mr. Little was only presenting the amended site plan as requested by the citizens at the original meeting. Additionally, Mr. Ballard stated the neighborhood t.ad formed a petition against this type +- i:a ilit.y as well as the -hange of zcning. Mr. Ballard stated that i was his underst.andi.nq t hat the zoning was not changed until the City Council had .heard the case. Mr. Hill informed Mr. Ballard that he was correct: ,31 that until the City Co ncAl. had hear; and ruled on the zoning change request, this property remained C-1. However, the Planning & Zoning Commission had made a. recommendation to t he City Council on July 3, 1990, to approve the change of zoning, and this recommendation was after determining that none of the opposition was against that category of zoning, only the layout of the facility Mr. Hill .further explained that with a Specific Use Permit, the citizens would know what its going to be in this facility, and the Commission and Council could put stipulations and restrictions con things sunk as hours of operation, etc. Even remaining a C—I district, the potential _-xi8`.:8 that a much worse use would move in there and the citizens would have no say at all. Mr. Hill wanted the adjacent property owners to understand the control the City would have over a Specific Use Permit opposed to straight cf:rmmer- cial. zoning. (Secretary's Note: Mr. Ballard gave Chairman H-3,111 copies of signed petitions, Exhibit A, opposing the facility at this site. }r. Ballard stated has intention to present these at the ,:my 24. 1990 City Council it meeting. ) Ms. Dorothy Ryan. 4i^ Rambling, asked if it woold be possible for the Commissioners to place a provision mandating the participants be dropped off and picked up by a parent or guardian, but was informed by the Commission .heat suci a stipulation could not be. .Qandated by the City -- not even the police department. Mr. 'troy Manuel, 413 Rambling,ing, stated that he had received the letter and plan from Mr. Little and appreciated the fact that Mr. Little was working with the residents; however, he was still extremely concerned with the traffic that would be generated her this facility. t_e general consensus of the Commission was that :'fir. Little had addressed every concern raised at the original meeting. The inability to make a left turn onto Midway is a concern, but the Commission stated that patY.yms leaving would most likely make a "u--turn" from Midway instead of tracking through the neighborhood. Goodson, Jr. . , Inc. , for Southwestern Bell Mobile. Systems (SWBMS) , explained that SWBMS planned on doing a. preliminary plat of the entire property, and the final plat would be only of Lot 1, Block A, Southwestern Bell Mobile Systems. in response to a question by the Commission, Mr. . Jacobs stated that he had the zoninq category on the _:lat, as required by ordinance. Mr. Hill explained that the City does not have an "L;"` zoning classi- fication. It was the Comm-i s sions underst.anUing that the City Council had requested the entire area be zoned £-B -- but were curious where the "L:C_" came from. Mr. Jacobs s explained that was obviously a mistake and he would correct it prior to Council presentation. Mr. ingrain made a motion To approve Subject to the :'on ng classification being corrected on the plat prior to Council presen- tation. Mr. Owens seconded the motion and the vote was as follows: Ayes: Messers. Ingram, Owens, Bal inger, will and 'L'V>on Nays: Non Chairman Hill declared the action carried. General Homes has had a tremen- dous success with the ih'estpoint Addition and 't1hey -anticipate this phase to be lust as successful. Mr. Hill expressed a concern with deleting a portion of the C--2 buffer and the mouses backing up to S,H, 10. he advised that he did not feel this is the best use for this property. :fir. Additionally, the Commission felt that even though they were initially unsure. of the ;uccess o,'_ Yiestpoint, they were impressed with it now and had ne! problem with th appro ing a second phase.
