Deithloff motioned that variances be grunted on Lots 30R and 28R, Block A, and the variance be denied For Lot 79, Block A. Mr. Owens sf:cQ ded the motion and the vote was as follows: Ayes: Hill, Owens, Smith, De thloff, Young, Zahn and Tyson Nays; none Mr. Hill l declared the ?notion carried. III. DISCUSSION OF THE CITY'S :E`13TURE ]AND USE PLAN Chairman Hill adjourried the meeting to the conference zoom to discuss the revision ._1t the Future Land Use Flan at 0:50 p.m. Mr. Hill informed the Commissioners that the P & L Commission had been requested to review the Future Land Use Map specifically the northwestern most .section of the City. lie stated that there is the possibility of a shopping mail an this proper.i�� �h ir,Lz is it oo:z �iu+ with the current Future i,and Use Plan. He stated that the. recent application .read: by Mr. Purvis for a residential dez-elopment on this property had been apprc?ved because it was in rompliarice with city ._rc:i.na.a.r.:e:_:.. Residential zoning is not consie:fere d the best iise for this property; thus, the review of the Future Land Use Man. Mr. Tyner informed the commissioners that conditions have changed since the city last formulated its Future Land Use Plan. issues such as the D/Fl+ expansion plan, construction of highways and changes A the community's desires have occurred aril it is evi&mt t.t3at the city' s Future Land Use Plan does not reflect these changes in attitude:'. Tyler asked what cause. of aetio-ri the Commission scanted to take. Mr. . Deit.h toff inquired if City Council was instructing the Commission to update the Future Land Use Plan and if a great deal of time was to be spent on this, Be staged that other cities review their FLU plan every few years. PAGE FIVE Mr. Hill stated that there were obvious discrepancies in the current Future Land Use Plan and recent development. He sited the land planned as showing multi-family is where W-Ko ,southwest is now being built. Mr. Hill suggested that the Future Land Use Plan be reviewed for the entire city and to review one section at a time beginning with the- northwestern most part of the City. Mr. Hilt requested that Mr. Tyler consult with the City Attorney as to the legalities of changing the Plan. `"her: was discussion as to the possibility of shopping ,calls being brought ir.l_o the area and the Plan being amended to accommodate such. Mr. wrens stat.ied that he felt the Pisan should not be charged on a whim and that they should not be influenced by a good salesman wanting a change. Mr. Owens also :Mated that he ;era?old prefer further direction from City Council. Mr. Tyson suggested regular work sessions to. ruview and adjust the entire map. Chairman Hill suggested that Mr. Tyler put together a packet with any needed changes for the Commission to review. Chairman Hill suggested they proceed by addressing properties adjacent to SH 12:1 north of Mid-Cities first and moving to the east. 11r, ?ahn stated that he would rather see a ir..ot i.on to look at the entire city and then divide and address each with the direction of the Chairman. Mr. : eithloff stated that he would prefer starting with the property with the most.. activity at this time and suggested property Owner notification be node to all people within 200' of the proposed changes. Mr. Smith suggested the Commission decide ghat portion of the City to change and then present the change in a public hearing. Mr. Owens observed that if we were going to review the whole city, the cost of notifying everyone by mail would be very great. He suggested that notification be made after. the Commission had studied the issues further, PLANNING & ZONING QMKISSION AIL 2 1993 PAGE SIX Mr. Zahn stated that he would prefer the attorney's opinion and more information before any changes are made and that only problem areas be addressed. Mr. Smith seconded the e motion and the Vote in favor was unaninauR s. Mr. Hill declared the motion carried. Mr. Fill stated that the Land in the northwestern most portion of the city bad already been discussed and asked if this should be the first property to review. The general consensus was that it s>-Rould he considered first. Mr. Smith suggested changing the FLU crap to show this property as co..-m nerc i a.a at. that t me. Mr. Zahn concurred. Chairman Hill stated that legal council :should be sought, Mr. Tyson stated that seeking legal council would be the responsible avenue. Mr. . Tyson motioned that the Commission recommend to City Council that the Future Land Use Plan be amended to show the land west of SH. 121 and.. north of N'.i.d-Cities he changed to commercial. Mr. Smith seconded the motion and the vote was as follows: Ayes: Hill, Tyson, :smith and Young Nays: Owens, Zahn and Ueithloff There was discussion among the members to include the pui area or not.
