REPORTS f`icel>ac kctsj -7-91.agn MINUTES PLANNING & ZONING MISSION MAY 7, 1991 The regular meeting of the Planning & •cniing Ceemmission was called to order by Chairman jack Hill at 7:30 p.m. , in the Councll Chambers of the Euless Municipal Building. MEMBIMS & STAFF PRESENT MEMBERS ABSENT jack Hill Todd Smith was attending Billy Owens a City Council function john Deithloff Ronald Young George Zahn Carl Tyson john Craig, Director of Development Rod W.Tyler, Assistant Director of Development Leah Culbertson, Staff Secretary PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Chairman Hill. INVOCATION The invocation was given by Mr. Zahn. AXPROVAL OF MINUTES The minutes of the April 16, 1991, Planning & Zoning Commission meeting were approved as presented. I. REPLAT #P91-04 - CONSIDER REQUEST OF TEXACO, INC., FOR A REPLAT OF LOT 4, A PORTION OF LOT 3 AND WYT A, EULESS GARDENS ADDITIONINTO LOT 4R. Mr. Mickey Nowell, representing Star Enterprises which owns this property, stated that a replat application had been and approved several years ago, but after several extensions given by City Council, the ;application expired without the public improvements being installed. He further stated that Texaco now has a potential purchaser for this land. Mr. Nowell stated that the City's consulting engineer recommends the purchaser of this property to put up "his fair share" of the -.11onies needed to construct the concrete lined drainage channel and the adjacent property owner would put up the other monies when the adjacent property were developed. He further stated that he ,-.as willing to place a Perpetual Maintenance Agreement as a stipulation to this plat. He further stated that this replat and engineering plans were very similar to the ones Texaco submitted in 1983. Mr. Robert Marshall of Goodson & Marshall, representing 7I mT'F?�X Inc. , addressed the Commission stating the purpose of this reF at is to develop a portion of this property for a Food i,ion Groc ia.['y Store. This development mould include the construction of an off-site storm drain under Harwood Road, 450 feet east to con3t c:t with can existing system behind the Kroger Grocery More. He further stated a landscape screening had been proposed along the north and west sides of t.'he building to screen the rear loading _area. Mr. Marshall stated that access from Harwood € oad will be by a private access agreement on Lot 2. The sale of Lot 3 is contingent Upon the execution of the private access. Mr. Young ung asked Mr. Marshall if he would be agreeable to listing the private access easement on the plat. Mr. Young moved to approve P9.1, -06, rF'plat, suhject to the :surveyor add3.rig bearing along the west property line, adding the existing addition name inside the boundaries of the plat, adding the recording: information for the private access easement on Lot 2, changing the lot, num:1ber and record .3_Vj information on the Century Plaza. PERMIT FOR SATELLITE RECEPTION DISH Chairman Hill explained the rules governing a public hearing ._.yid opened the hearing. -Mr. Timothy Geisel, owner of 110 Wi dbriar. , addressed the CoRitnission stating that he had found a notice of violation at his home one aay noting that his satellite e x ecept::.on dish was above the usual allowed height. He want on Uv state that he was unaware of t.nic- need for a. permit as his contractor said there was no, nE.'.E.'d for one.. Mr. Geisel stated the violation noted a fence was needed and he has since put a fence around the dish. He further explained that there is a 6' slope in his rear yard with several trees and a. a' fence behind this slope making he fence top approximately 12' above the ground level nearer the h:a se. He stated the satellite dish is on ._ pole near the house. Chairman dill called for further proponents. Vie-re being £acme, <<e called for opponents at whi.c.h time Ms. Barbara- folk, owner of 1702 Pleasant Trail, Euless, Texas, addressed the Commission. She stated that she resides in South Euless ess and owns property in he Subdivision where gees Specific rise permit is being requested. Ms. Pc•lk surfed that she is a real estate broker and feels that the satellite dishes depreciate the property on and around their z0:at iu_ s. She iL.i"tt_eL' stated that she wants to eve in a City where the ordinances, :are upheld. Mr. Geisel stated t.h.at if he conformed with the ordinance, the dish could be moved to the top of the slope at which time it would be Rare visible than it is at the present location. it could then :'be seen above the fence and above the house. There being no further proponents/opponents, Chairman Hill {closed the public hearing and called for a motion. Discussion took place among the Commissioners noting the slope of the back yard and the Aregula.ri.t..ies in the physical slope of the lot. The dish is less intrusive at its current location than if it- conformed to regulations, which meets the intent of the ordinance. Per. Deithloff :nosed to approve ##91-06SP.
