He stated that these population forecasts still hold true:. He ev+lained that the number of water connections were fare-- cast, using expected population increases and future growth In non-residential activities. He stated that these figus are used by TrI.nl.ty Rzver Authority for bang range planning des. Chairman Hill, asked if there were any questions. There being none, he called for a recommendation to this endorsement. Commissioner Owens motioned to approve the endorsement of the popula- tion and water connection foremasts as prated. Commissioner Maloney seconded the motion and the vote was as follows: Ayes: O mmsissioners GmNs, Maloney, Deithloff,, Young, Hill, Zahn and Tyson Mays: None" Chairman Hill declared the motion carried. Mr. Rod Tyler, Assistant Director of Development, stated that this item is being considered to amend the present Zoning ordinance by add..inq a new zoning district with regulations entitle. "Texas 10 Multi-use District". Ho ver, no specific land parcels have been, identified to have this designation as yet. He said that this is a new zona-nq district, category and would be more intensive than. the C-2 district bait less than the L-1 district. It corresponds very closely with utiat mr. John Pitstick, Director of Developer with the City of Hurst, explained to the Camussioners at the July 2, 1391, Planning and Zoning reeting. The City of Hurst City Council and City of Euless City Council both are tentatively scheduled to consider this item next week.. Mr. Tyler briefed the Com ssionners on some highlights to the district by stating that the primary purpose of the district was to encourage a business corridor; encourage more intensive uses in the area; e, aur- age larger buildable areas; allow for outdoor display behind the building line; provide for landscaped buffer strips along riot-of-ways; bride a masonry screeninnq fence adjacent to residen- tial properties; and to have consistent sign regulations between the Cities of Mess and Hurst. The uses permitted in this district include al=st all retail, service, restaurants, hotels, office buildings, as well as, warehousing, manufacturing, and assembly type uses. Gormssioner Maloney asked which zoniM district would allow pawn sly since they are not listed. Mr. Tyler advised the Commissioners that as of September 1, 1991, ate statue require cities to specify a zoning district that pawn shops, licensed by the State, may be located in by right. Furthermore, the new statutes prohibit cities from requiring pawn shops to first obtain a Specific: Use Permit before offing. Our ordinance alley sales of secondhand merchandise in the C-2 district or in districts that are more intensive, prcvided a Specific Use Permit is first obtained. The City Attorney has determined that pawn shops wcul d be pen,,ii tied. Pawn shops cold be specifically al.l o in this district if the Commissioners decide to do so. After mx�h discussion among the Comussioners it was the consensus of the comissioners, to not specifically include pawn shops in this district at this time. Mr. Tyler further advised the Commissioners of the lot area and yard, requirements; ma=.= height limitations; outdoor sales and di TICINS Mr.. Tyler stated that this district addresses is raised in the City's 199 0 report on yxmic Development Strategies for the mLC allowing more uses, bat with development requirements that will enhance the quality of develcpnent along the corridor. Mr. Steve Nord, Assistant to the City Manager, stated that a lat of input went into this new wing district and it has the port of the Highway 10 Business As�a cation as well as the City of fit,. He expressed appreciation to Rod Tyler for all his work with coordinating ng with Mr. John Pitsti.ck at the City of Hurt. There being none, he closed the public hearing and asked for discussion among the Conw-ssioners. Commissioner Maloney asked why churches were not included in this district and how far down B. H. 10 the corridor will extend. Mr. Tyler stated that churches are not allow in the TX 10 district. He stated the limits of the corridor have not yet been defined, fiver it would probably begin at the Hurst/Euless city limit line and extend eastul °� to F.M. 157 or all the way to S. H. 360. Chairman Hill called for a motion. Clommissioner Young moored to approve Resolution No. P&Z 91-01 to adding a new zoning district to the present zoniM ordinance. Rules to assist in the placement of land uses ware, agreed upcn by the C=udssioners as to being desirable locations. The folly rules for Commercial were identified: * Should be located at ra jor streets; Fuse or greater capacity of traffic, the should be rcre lard * ,Areas ale major frees should be commercially oriented; O=mrcial arm should be located, near major utilities (water and sewer); * Commercial areas may be located adjacent to amts; * Commercial arm may be located next to other commercial uses; Uses such as fast foods establishments, restaurants, media districts, and Mel uses should be recreationally grouped together to create districts of common use (critical r s) . The fallowing rules were weed upon by the Ommi:ssioners as to Commercial areas where they should be located: * Within flood prone areas; * Adjacent to single family,' * Adjacent to park Land; Near heavily wed areas; Areas ha-ring steep slopes associated with the site. The following rules for Multi-Family were identified: Should be located between multi family nodes; Used as a buffer between commercial and to%ykxn,es with similar type uses; Multi-fa ly may be located next to =wercial; Multi-family may be located next to certain non industrial uses such as warehousing, light assembly and the like. CONSIDERATION OF RESOLUTION MO. 91-02 CIAO Mr. Rod Tyler, Assistant Director of Development, presented a resolu- tion conveying the Capital Improvements Advisory Committee's (CIAO second semi-annual report for the period January 1, 1991, through .tune 30, 1991. Mr. Tyler stated that the report is required to comply with Chapter 395 of the Local Government Code. It recommends no changes to the Land Use Assumptions adopted on April 10, 1990, nor any changes to the "Capital Improvement Plan/Water & Wastewater Impact Study" adopted on May 22, 1990. It further states that the number of permits issued balances with the monies receipted and such funds are being kept in a separate interest bearing account. No inequities have been found due to the implementation of the impact fees. ADJtUtMENT There being no further business, Chairman Hill closed the meeting at 8:38 p.m, Chairman Jack Hill /1jl :minutesi09-03-9l.cip RESOLUTION NO. 91-02 CIAC A RESOLUTION CONVEYING THE SEMIANNUAL REPORT OF THE CAPITAL .► IMPROVEMENTS ADVISORY COMMITTEE, RELATIVE TO THE PROGRESS OF THE CAPITAL IMPROVEMENT PLAN MD THE IMPOSITION OF IMPACT FEES ICR IRE PERIOD BEGINNING JANUARY 1, 1991, THROUGH JUNE 30, 1991. WHEREAS, the City Council of the City of Euless, Texas, has adopted the "Capital Improvement Plan / Water and Wastewater Impact Study" (hereinafter referred to as "Capital Improvement Plans") required by Chapter 395 of the Texas Local Government Code for the imposition of impact fees for water and sanitary sewer improvements; and WHEREAS, the City Council, in compliance with Chapter 395, has appointed a Capital Improvements Advisory Committee to monitor and evaluate implementation of the Capital Improvement Plans; and WHEREAS, Chapter 395 requires the Capital Improvements Advisory Committee to file semiannual reports to the City Council with Respect to the progress of the Capital Improvement Plans and any perceived inequities in implementing the plans or imposing the impact fees; and WHEREAS, the Capital Improvements Advisory Committee has monitored and evaluated the implementation of Capital Improvement Plans and imposition of impact fees, NOW THEREFORE, BE IT RESOLVED BY THE CAPITAL IMPROVEMENTS ADVISORY (XW[TPEE OF ME CITY OF E LESS, TEXAS: SECTION 1. That adequate progress is being made to implement the Capital Improvement Plans for providing facilities necessitated by and attributable to new develop- ment. SECTION 2. The Capital Improvements Advisory Committee finds no inequities in imple- menting the Capital Improvement Plans or imposing the impact fees. SECTION 3. Further, the Capital Improvements Advisory Committee finds the impact fees are being collected and all funds collected are being maintained in accordance with the law. SECTION 4. It is recommended that no change be made to the Land Use Assumptions, Capital Improvement Plan, or impact fees adopted by the City. SECTION 5. The semiannual report, attached hereto as Exhibit "A" and the accompanying Exhibits 1 through 3, are hereby conveyed to the City Council of the City of Euless, Texas, for its consideration.
