APRIL 21, 1992
The Pre-Commission meeting of the Planning & Zoning Commission was called to
order by Chairman Jack dill at 6;00 p.m. , in the Conference Room of the Euless

Mr. David Allen, GIS Manager, conducted a tour of the GIS Department. Mr. Allen
briefed the Commissioners as to what types of information could be obtained from
the program; i.e. street maps, zoning district maps, water and sewer maps,
voting information.

Chambers at 7.31 p.m. , for the consideration of scheduled items.

The minutes of the April 7, 1992, Planning and Zoning Commission meeting were
approved as written.

Chairman Mill explained the rules governing a public hearing and then opened the
public hearing.
Mr. Rick Simmons, 2704 Wooded Trail Court, Grapevine, Texas, was present repre-
seating Western Rim Investors. Mr, Simmons advised the Commissioners that they
are requesting a change of zoning on Lot 1, Block 1, Wildwood Addition. Mr.
Sims stated they are proposing to build another unit of 20 apartments in the
northeast quadrant of the property. The proposed building will occupy land
currently being used for recreation and open space purposes. He stated that
they have invested $230,000 in the apartments by adding new appliances, covered
parking, security and other amenities.
Mr. Marcus D. Piles, managing partner in Western Rim Investors 1991-4, L,P. ,
2900 Bristol Street, Suite 8301, Costa Mesa, California, 92625, and own-
er/operator of 13 apartments across the United States, stated they purchased the
apartments on an all cash basis for a long term investment. He stated that
Western Rim Investors and are a very stable company with long term investment
plans.
Mr. Daryl Perry, engineer for Washington & Associates, Inc. , 500 Grapevine
Highway, Suite 375, Hurst, Texas, advised the Commissioners the proposed build-
ing will be located the same distance from the adjacent properties as the
existing units with a 90 foot buffer. Mr. Perry stated that there currently
exists ample parking and the playground facilities will be moved towards the
center of the apartment complex.
Ms. Ann Mullin, Wildwood Apartment manager, stated they have been upgrading the
property inside and out in order to make this a superior complex that everyone
can be proud of. Ms. Mullin stated that the rent ranges from $340 to $555 per
month, with a greater demand for the larger 2 and 3 bedroom units.

Mr. Lee Stallings, 200 W. Bear Greek Drive, a resident of Wildwood Apartments
since 1900 said he supported the proposed change because these apartments
provides a wholesome atmosphere for his family, has security and is a very nice
place to live.
Ms. Pam Shaw, 200 W. Bear Creek Drive, also a resident of Wildwood Apartments
since 1991 stated that she supports the proposed change because she likes the
family atmosphere as well and the new amenities which have added to the
appearance of the complex,
Mr. Simmons stated that when construction begins they will be removing only one
(1 ) tree and replacing the playground to the center of the complex. He stated
that security is provided to the residents, however there is concern with trying
to keep children out of the drainage way, as well as keeping children from
cutting through the apartment complex in order to visit neighboring children in
the residential areas. He advised the Commissioners that monitoring cameras
have been installed on the property and he will Mork with the adjacent neighbors
in trying to solve the problems with the children, Mr. Simons emphasized that
they plan to build one more structure of apartments and plan no additional units
in the future. The proposed building will be architecturally compatible with
all existing buildings.
Chairman Hill asked for other proponents. There being none, Chairman Hill asked
if there were any opponents.
Mr. Fred Brodsky, Brodsky/Dlperton Euless J.V. , 12555 N. Central Expressway,
#800, Dallas, appeared before the Commissioners stating that he has no problem
with the zoning change, however is concerned that the proposed drainage would
increase water draining onto his property which is located south of the
apartments. Mr. Brodsky said he did not object to the request if no additional
storm water was directed onto his property.
Ms. Michele L, Campbell, 300 Bear Creek Drive (Lot 3) , stated she is against the
zoning case and feels that the apartments could come back later and build in the
opposite corner of the property. She is concerned with the schools being
overcrowded, an overpopulation of the apartment complex and stated there are
other areas in the City which were vacant could be developed for apartments She
stated that recent events such as the proposed D;FW airport expansion have had a
devaluation effect on the area and the neighborhood does not need anymore
negatives in the City. Ms. Campbell emphasized that there has been a problem
with the drainage area not being maintained by the apartments and they do have a
responsibility to maintain the moving of the areas around the drainage.

Mr. Keith Ashburn, 213 Westover (Lot 5), a resident of three years stated that
this is the second time the drainage area has been mooted by the apartments. He
elaborated on the children cutting through the apartments and jumping over the
surrounding fences, which has caused residents to make constant fence repairs.
fie did state that he did not know if all the children were residents of the
apartments or if some of them were also neighborhood children. Mr. Ashburn was
also concerned with the screening between the proposed building and the adjacent
homes as well as the crowded situation at the school .
Mr. A. J. Molina, 107 Westover (Lot 15), advised the Commissioners that he is
against the proposed building. If this unit is built it will look out towards
the back of his house which would decrease their privacy and subsequently their
property values. He also mentioned that children are always cutting through his
back yard from the residential area into the apartment complex.
Mr. Don Lade, 145 Westover (Lot 16) , stated that he can see both sides of this
issue. He commented on how nice the apartments are maintained, but did not feel
the building would enhance the duality of the neighborhood. He feels that both
Lots 15 and 16 would be negatively impacted the most by the proposed building.
He has repaired his fence numerous times and stated that the children use his
fence to jump over into the surrounding apartments and neighboring homes. He
stated that if the proposal were approved, however, that no windows be on the
north side of the proposed building as the building would look directly into his
back yard.
Mr. Tony Florence, 113 Westover (Lot 11) , stated that if the case were approved
he would like to see additional landscaping between the parking lot and his back
yard. Presently there are no shrubs and car lights shine through the fence into
his back yard.
Mr. ,Jack Hixson, 109 Westover (Lot 14), mentioned that he is concerned with
security. His home of nine years was recently broken into, and there is a
constant flow of children between the apartments and the surrounding hones.
Chairman Hill stated that a period for questions and answers would now be
opened. He asked Mr. Simmons to come forward and respond to the citizen's
questions. The majority of the concerns dealt with the buffer along the north
side of the property, whether windows would be installed on the north side of
the proposed building, what to do about the fence situation and the children who
keep tearing the fences down.
Commissioner Maloney stated that the situation with the children is a present

problem and could increase if the proposed building is built.

this is a natural barrier to the children and hopes that suggestions could be
considered to help relieve the situation.
Commissioner Tyson stated that he was on the Commission in 1932 when the origi-
nal plans for these apartments were submitted. He stated the purpose of the
Zoning Ordinance and some of the items considered then were overcrowding of the
land, undue concentration of population and adequate provisions for school,
reasonable consideration for the character of the land and the most appropriate
use of the land. At that time, a high concentration of population was not
thought to be good nor in his opinion is good at this time. He does not think
that this is the best interest of the City, especially with the school
overcrowding, overcrowding the land and is not the most appropriate use of the
land.
There being no further opponents, Chairman Hill closed the public hearing and
called for discussion among the Commissioners.
After much discussion among the Commissioners, Commissioner Tyson moved to
recommend denial of the zoning change request for Zoning Case No. 92-05. The
motion died for lack of a second.
Commissioner Maloney roved to approve the zoning change request for Zoning Case
No. 92-05 with the following stipulations appropriate landscaping, prohibitive
vistas on the north side of the building, appropriate engineering of the
drainage and a method to decrease foot traffic. Commissioner Maloney stated
that she is concerned with the issues involving the children and solving this
issue is important.
The notion died for a lack of second.
Commissioner Tyson reiterated his concerns regarding overpopulation, inadequate
supply of classrooms in the school and that this zoning case is not in compli-
ance with the ordinance.
Chairman Hill called a fifteen minute recess in order for the applicant and
homeowners in the audience to try and resolve some of the concerns.
After the recess, Chairman Hill asked the applicant and homeowners if a decision
regarding the items discussed had been rude. Members in the audience stated the
drainage problem could be worked out with the help of the City Engineer, an
eight foot fence could be placed on the apartment property with trees and/or
shrubs as a buffer. Ms. Campbell stated she was still open to the request
because the population issue could not be resolved and is requesting written
specifics from the applicant regarding the other issues discussed tonight.

Commissioner Young moved to table Zoning Case Pao. 92-05 to such time that the
site plan can be amended and the applicant and neighbors could compromise on the
issues discussed at this meeting. He stated that when the applicant had trade
all the proposed changes, this case should be submitted to the Development
Department for reconsideration by the P & Z.
Commissioner Owens seconded the notion and the vote was as follows:
Ayes: Commissioners Young, Owens, Maloney, Hill and Tyson
Rays: None
Chairman Hill declared the motion carried.
