MINUTES PLANNING AND ZONING COMMISSION MAY 5, 1392 the Pre--Commission meeting of the Planning & Zoning Commission was called to order by Chairman Jack Hill at 6:00 p.m. , in -he Conference Room of the Euless Municipal Building. Pi 1.AM Z T Cat OF SCNED ED I U M ERS The Planning and Zoning Commission continued their meeting in the Council Chambers at 7;30 p.m. , for the consideration of scheduled items. PLANNING AND ZONING C :ISS 1 ON. MAY 5. 1992 - PAGE TWO PLEDGE...OF..ALLEGIANCE The Pledge of Allegiance was led by Commissioner Tyson. INVOCATION 'The invocation was given by Commissioner Owens. PROVALe OF MINUTES The minutes of the April 21, 1992, Planning and Zoning Comanission meeting were approved as written. I. #92-05-ZC - RECONSIDER THE REQUEST OF NEWPORT CLASSIC HOMES, FOR A CHANGE OF ZONING FROM CUD (COMMUNITY UNIT DEVELOPMENT) CONFORMING TO -3 (MULTI-.FAMILY 12 U/A MAXI MM) TO CUD (COMMUNITY UNIT DEVELOPMENT) CONFORMING TO R--4 (NULTI-FAMILY LIMITED TO 14 U/A MAXIMUM) AT 200 W. BEAR CREEK DRIVE. Chairman Hill advised the audience that this item had been discussed at the previous meeting of April 21 ar:d asked Mr. Simmons if he had met with area homeowners regarding solutions to citizen concerns. Mr. Rick Simmons, 2704 Wooded Trail Court, Grapevine, Texas, representing Newport Classic Homes, advised the Commissioners that he had contacted each of the homeowners and the following conditions would be met: 1 . The addition of trees on the west side of the property as an addition- al buffer between the homes and the property; 2. The two (2) dead trees behind Lot 12 would be removed and replaced; 3. The addition of seven (7) 2 1/2" to 3" pear trees would be placed on the west side of the concrete channel; 4. Photinias Mould be placed against the fence at the rear of the proper- ty; 5. A hinged gate and lack would be added along the fencing behind Lots 13 and 14 at the rear of the property for maintenance purposes; 6. Six 5" trees would be added along the northern property line in the NE quadrant of the tract; 7. Various trees would be added on Lots 15 and 16 to help screen the proposed building; 8. Flood lights would be added on the northern portion of the property behind Lot 16; and 9. An 8` fence would be constructed along the property line common with Lots 14, 15 and 16. Chairman Hill stated he would like to hear from homeowners present. PLANNING AND ZONING COMMISSIQN, MAY 5 992 - PAGE THREE I. (cant.) #92-05-ZC CONSIDER THE REQUEST OF NEWPORT CLASSIC HOMES, FOR A CHANGE OF ZONING FROM CUD (COMINITY UNIT DEVELOPMENT) CONFORMING TO -3 (NULTI-FAMILY 12 U/A MAXIM) TO CUD (COMMUNITY UNIT DEVELOPMENT) CONFORMING TO R-4 (MULTITFANILY LIMITED TO 14 U/A MAXIMUM) AT 200 W. HEAR CREEK DRIVE. Mr. Derr Lade, 105 Westover (Lot 16) , stated that his property is one of two which would be most impacted by the proposed zoning change and he is still in opposition to the proposed building. Mr. A. J. Molina, 107 Westover (Lot 15), advised the Commissioners that he is still opposed to the proposed building. He stated the population to the area would be increased and he presently has a nice view out his backyard. Mr. Jack Hixson, 109 Westover (Lot 14), stated that all his concerns with security have been put to rest and he has no objections to the zoning change. Pis. Michele Campbell, 300 Dear Creek Drive (Lot 3) , stated that she feels good about the security and the additional trees, but is not comfortable with the apartments being added. She further stated that there is still a problem with overcrowding of the schools which also creates an abundance of traffic. She also stated that she has spoken with teachers at the school and they too are opposed to this addition as it would create overcrowding of the schools. Ms. Campbell stated that new apartments should be constructed on one of the several other sites in the City zoned for this use. Mr. Tony Florence, 113 Westover (Lot 11) , advised the Commissioners that the problem with the two (2) dead trees had been resolved and they had been removed. Mr. Keith Ashburn, 213 Westover (Lot a), stated his main concerns were with the traffic, children and the overcrowding of the schools. He advised that the Commissioners take this into consideration. There being no further discussion from opponents, Chairman Hill called for any discussion or questions from the Commissioners. Commissioner Tyson reiterated the same concerns regarding overpopulation, the inadequate supply of classrooms in the schools and that this zoning case is not in compliance with the ordinance and therefore moved to recommend denial of the zoning change request for Zoning Case No. 92-05. Commissioner Deithloff seconded the motion and the vote was as follows: Ayes: Commissioners Tyson, Deithloff, Young, Hill and Zahn Nays: Commissioners Maloney and Owens Chairman Fill declared the motion carried and advised the applicant that this case could still be presented to City Council for consideration. Rod Tyler is the proud father of a new baby girl barn on Friday, May 1st, and mother and baby are both doing fine.
