into compliance with the Minimum Housing Code

MINUTES
PLANNING AND ZONING COWISSION
AUGUST 4, 1992
The Pre-Commission meeting of the Planning & Zoning Commission was called to
order by Chairman Jack Hill at 5:50 p.m. , in the Conference Room of the Euless
Municipal Building.

Commissioner Tyson brought a video tape entitled "The Abilene Paradox" for the
Commissioners to view.
After the video tape, the Commissioners had some questions and discussion
regarding the Minimum Housing Code which was scheduled for tonights meeting,

Assistant Director of Development, Rod Tyler, reviewed with the Commissioners
the Unified Development Control Document (UDC) for articles four and five. He
briefly explained that Article IV deals with zoning district regulations and any
permitted primary uses for these districts. Article V contains information on
the harking requirements in the City.

The Planning and Zoning Commission continued their meeting in the Council
Chambers at 7:05 p.m. , for the consideration of scheduled items.

The Pledge of Allegiance was led by Commissioner Maloney.
The invocation was given by Commissioner Deithloff.
APPROVAL QE MINES
The minutes of the July 21, 1992, Planning and Zoning Commission meeting were
approved as written.

CONSIDERATION OF RESOLUTION NO. P&Z 92-02 TO ESTABLISH NINIRM LIVING STANDARDS
FOR ALL DWELLINGS IN THE CITY OF EULESS
Air. Craig, Director of Development, briefed the Commissioners on the proposed
minimums housing ordinance. He stated that the proposed ordinance had been
drafted per the discussions at previous meetings and is now before the
Commissioners.
Commissioner wens asked about the staffing and enforcement of the program for
the minimum housing ordinance and inquired as to where and how the funds
generated by the program would be spent and how this money would be accounted
for. He also emphasized that this money should be used on this program and not
used for other means.
Assistant. City Manager Kay Godbey informed the Commissioners that this money
would go into an account line item specifically for this revenue source, and
this money Mould be spent out of the inspection budget for the personnel and
supplies for this program.
Commissioner {lumens moved to approve Resolution No. P&Z 92-02 establishing
minimum living standards for all residential dwellings in the City.
Commissioner Young seconded the Motion.
Chairman Dill called for discussion before calling for the vote.

Commissioner Maloney voiced her concerns with the ordinance being directed
towards only single-family dwellings, and stated it should also include the
multi-family dwellings as well.
Director of Development, John Craig, advised the Commissioners that it should be
lasted as both single-family and multi-family dwellings.
Commissioner Maloney stated she had strong reservations regarding the proposed
ordinance. (1 ) As to the basic purposes for improving the quality of life,
particularly in the multi-family housing and protecting them against landlords;
(2) uniformity of the enforcement of the ordinance and the fears of the lack of
uniformity will leave the City liable to civil actions and (3) a serious
question as to whether or not the intent shrouds the notion to systematically
exclude certain people from the City of Euless.
Commissioner Tyson stated that he adamantly disagreed with Commissioner
Maloney's statement because he felt this is a very good ordinance for which the
City would now have the authority to require any apartment or residence to bring
their property up to at least a minimum living standard. He mentioned that in
the past the City had no authority in dealing with the apartment owners or
private residences which had become an eyesore in the community.
Commissioner Owens was in favor of the proposal, stating that the citizens of
Euless should be afforded this type of protection and deserve these rights. He
also stated the motion should be amended to include all funds collected may only
be used to finance this program only.
Commissioner Young stated he was unaware of any hidden agenda trying to exclude
any group of people from the City and stated the ordinance will benefit all
residents in the City especially those individuals living in apartment complexes
by extending rights to there.
Chairman Hill" mentioned that we should have some method of policing those few
individuals who abuse and let their properties run down. He feels the
individuals who are now luring in apartments would greatly benefit from the
minimum housing ordinance because presently the tenants have little to no rights
regarding the safety and welfare of their housing.
Chairman Hill called for the vote on the minimum arousing ordinance, and the vote
was as follows;
