PUBLIC HEARING - ZONING CASE #92-11 Request of The Woods/Euless J.Y. , Ernest Gatewood III, for a change of zoning for 11 .38 acres out of the Levi Franklin Survey, A-513, Tract 2G, from its present zoning of C-2 (Community Business District) to PD (Planned Development for Single Family Detached, small lots) . This property is generally located on the southwest corner of Bear Creek Drive and North Main Street. 11. PRELIMINARY PLAT - #P-92-12 - PULTE HOMES OF TEXAS Request of Pulte homes of Texas for the preliminary plat of 10.2 acres out of the Solomon Huitt Survey, A-705, Tracts 6E, 6F, 6B, 6C--1 and 6G into Lots 1-44, Block A and Lots 1-8, Block B, Bear Creek Bend Addition; generally located south of Harwood Road behind Harwood Crossing Shopping Center. The invocation was given by Commissioner Deithloff. APPROVAL Of MIMES The minutes of the November 3, 1.992, Planning and Zoning Commission meeting and the Capital Improvements Advisory Committee meeting were approved as written. I. #92-11-ZC - CONSIDER THE REQUEST OF THE l S/EULESS J.V., ERNEST GATEWOOD III, FOR A CHANGE DE ZONING FROM C--2 (COMMUNITY BUSINESS DISTRICT) TO PD (PLANNED DEVELOPMENT - SINGLE FAMILY DETACHED, SMALL LOTS); MORE GENERALLY DESCRIBED AS BEING ON THE SOUTHWEST CORNER OF BEAR CREEK DRIVE AND NORTH MAIN STREET Chairman Hill stated the rules governing a public hearing and opened the public hearing. Mr. Rod Tyler, City Planner, advised the Commissioners that this property has been zoned C-2 (Community Business District) but the applicant is proposing PD (Planned Development - single family dwellings with smaller lots) . He stated the proposed minimum lot sizes would be 5,000 square feet. The applicant will be fencing the property along North Main Street with a 6` high masonry wall and along Bear Creek Chive he is proposing a 6' high cedar panel fence with brick columns located every three panels. Mr. Tyler advised the Comaissioners that staff has reviewed the proposal and there is a demand for this type of housing, but does recommend the R-1 zoning. Mr. Ernest Gatewood, 1845 Woodall Rodgers Freeway, Dallas, advised the Commissioners that there is a demand in this area for homes between the $90,000 to $130,000 price range. He stated the homes will have smaller lots but will average 1,60+0 square feet in structure size. There will be landscaping around the proposed fence walls on Bear Creek. Drive and forth Main Street. lie stated there would be no cut through streets in this development. Mr. Fred Brodsky, 5223 Royal Lane, Dallas, has owned the property for ten years and is planning to sell a part of the property to Mr. Gatewood, but plans to keep the commercial property to the south as well as the northeastern corner. Mr. Brodsky also stated the property was initially to be used for a shopping center but it never developed. PLANK ZONING _CISSIQN. 1!fi31dEMBER 17, I99 PAGE THREE 1 . There being none, Chairman Hill asked if there were any opponents. There being none, he closed the public hearing and asked for discussion among the Commissioners. There was some concern as to why Mr. Brodsky wanted to keep the C-2 property to the north and south. Mr. Brodsky stated he was keeping the property to the south because Mid-Cities would eventually be expanded and the property to the north would be an excellent day care facility since there is an elementary school located to the west. The Commissioners were also concerned with the street access and felt there would be problems accessing onto Forth Main Street. They suggested that the entrance into the proposed addition come off of Bear Creek Drive or possibly from Mid-Cities Drive, or make both entrances into the proposed addition from Bear Creek Drive. Mr. Brodsky stated that the property south of the proposed addition is in a flood plain and a cut through street could not be built within this area. He also stated that his property is heavily encumbered with liens and hopefully the Commission can work with Mr. Gatewood and himself on this proposed addition. Commissioner Tyson moved to deny Zoning Case #92-11, request of Ernest Gatewood III, for The Woods/Euless J.V. Commissioner Young seconded the motion and the vote was as follows: Ayes: Commissioners Tyson, Young, Zahn and Hill Nays: Commissioners Maloney and Deithloff NOTE: Commissioners Maloney and Deithloff both stated they felt the project could be worked out. Chairman Hill declared the motion carried and advised the applicant that this case could still be presented to City Council for consideration. CONSIDER PRELIN1NARY PLAT #P-92-12 - REQUEST OF POLTE HONES OF TEXAS FOR THE PRELIMINARY PLAT OF 10.2 ACRES OUT OF THE SOLOMON HUITT SURVEY, A-705, TRACTS 63, 6f, 6B, 6C-1 AND 6G INTO LOTS I-44, BLOCK A. AND LOTS 1-8, BLOCK B, REAM CREEK BEND ADDITION; GENERALLY LOCATED SOUTH OF HARWOOD ROAD BEHIND HARWOOD CROSSING SHOPPING CENTER Mr. Donald Grantges with Los Prados Development Company, 1901 Stadium Oaks, Arlington, was present representing Pulte Hones. Mr. Grantges advised the Commissioners that Carter & Burgess, Inc. , had found the owner of the five-foot gap located on the south side of the property. He stated the owner is L & N Properties and that Lomas and Nettleton has agreed to a Quit Claim Deed and they intend to comply with all of staffs concerns. Commissioner Young moved to approve the Preliminary Plat #P-92-12, for Bear Creek Bend Addition subject to: (1) prior to the final plat being submitted that the five-foot gap is resolved and included into the plat; (2) the street names conform to the request of the Street Naming Committee; and (3) the planned development zoning request be approved by City Council . Commissioner Deithloff seconded the motion and the vote was as follows: Ayes: Commissioners Young, Deithloff, Maloney, hill, Zahn and Tyson Nays: Norge Chairman Bill declared the motion carried. 111. Mr. Joe Nennig, Director of Development and Operations, advised the Commissioners that there are no future residential projects in progress and there is another specific use request for a church which is scheduled for the Commissioners in December.
