The minutes of the June 15., 1993, Planning and Zoning Commission
meeting were approved as written,

Chairman Young stated that the Commissioners have been reviewing the
Unified Development Control Document and tonight they are reviewing

ers had any comments or questions regarding this section of the
document,
joe Henniq; Director of Development and Operations, stated that staff
had been working on Article 4 and wanted to present items of clarifi-
cation to the Commission.
Rod Tyler, City Planner, stated that one item that came from the Goals
and Objective meetings was the need for, well 'landscaped and well
maintained residential districts. lair. Tyler staled that the responsi -
bility of who provides and maintains landscaping needed to be clari-
fie? He asked the Commissioners whether the private sector, should
provide adequate landscaping or should the City have regulations to
require a €rrin'f€€€um amount of landscaping on new subdivisions
Commissioner Owens, stated that he felt it would be a problem to
regulate hat the developer~ should provide on each individual lot and
that should be between the €evelo er and the homeowner. Commissioner-
Owens stated that he -felt the Commission should develop some requireR
€rents on the entrances to the subdivisions,

Commissioner Tyson, wanted to know if FHA (Federal :sousing Administra-
tion) required a minimum amount of landscaping on homes they financed.
Commissioner Hill staged that BHA does require some minimum standards
for financing, taut does not know the exact requirements.
Rod Tyler, stated that Brooks Builders had a minimum landscaping
package that is automatically rolled into the price of the house. Mr,
Tyler also stated that he had suggested that the builder put in
landscaped entrances and the City maintain them and this would help to
keep property values up
Commissioner Dei-thloff asked if a homeowner put landscaping in between
the property ling: and the curb, and then the City needs 'to dig it cep
for repairing a water leak, who is responsible for replacing W

Joe Hennig responded by saying that it was the homeowners responsibil-
ity, however, anytime this occurs Public Works replaces anything that
has been removed or damaged.
The Commissio ners discussed the issue of requiring minimum landscaping
on residential lots and how to police and enforce; it. €'.:ommissi one r„
Owens stated that he felt the Commission should require minimum
requirements for entrances into the subdivisions.
The Commissioners discussed the possibilities of Homeowners Associa-
tions in the subdivisions to maintain landscaped entrances such as the
l-railwood Addition.
joe Henni.l, Assistant City Manager, summed €€p the discussion by
concluding that staff needs to amend the landscaping requ-iremen't to
include Single Family.
Commissioner Billy Ownes recommended appointing a s€b--c:camittee to
work with Pod Tyler and other .staff members on the Landscaping section
of Article 4.

Commissioner dill stated that he would rather the multi-family deve1-
ope,rs build a nice pr,o ect instead of spending their money getting
approval f or the project. lair. Hennig stated that the other side of
that thinking; would be not to spend the money for approval or on the
project and end up with a project that would not be acceptable.
Mr, Hennig stated that staf=f would continue to work on Specific. Use
requirements for Multi-Family,
The Commissioners discussed staff's proposal to add a new ".Q" dis-
trict, P-1 Executive and Single Family Detached, The R- 1 Cluster
zoning would be smaller ler lots and the P- 1 Executive would be the larger
lotww Mr. Tyler handed out proposals detailing the purpose, primary
uses and district site development standards to the commissioners goner"s for
their review.
The general consensus on this item was to find another title for the
P-1 Executive and the R-1. € l€rster- zoning need f urther~ consideration
and discussion due to the complexity.
Mr. Rod. Tyler~ stated that under Article 5 Parking Requirements is
similar to what our current requirements are. That is each durelling
unit has two car parking garages behind the building line, if the
parking occurs in front of the unit, it must be a carport or garage,
if it is behind the Eunit. it ?gust be a parking pad with a screen. Mr.

Tyler, stated that the Zoning Board of Adjustments has had several
cases where citizens have enclosed their garages without a periiiit and
had to come before the ZBA.
Mr. Tyler recompended that because of these occurrences, the parking
section should to be amended to require all newly --nstructe.d. dwelling
units to be built with a two car garage. If it is not newly con--
struQted then garage enclosures will be allowed unless deed restric-
tion or, some restriction prohibits it. There will still he two off
street parking spaces on the lot someplace, but not necessarily the
garage. Mr. Tyler stated that 75% of the ZBA cases are garage enclo-
sures.
There was discussion among the Commissioners concerning the Off Street
Parking requirements .
Mr. Tyler stated that Article 5 currently does not address over sized
or commercial vehicles being parked in residential zones,
It was decided that staff would present additional recommendations at
a later date concerning the off street parking.

Rod Tyler invited the Commissioners to a Planning and Zoning workshop
in Horst, He informed them that they could meet at City Hall and ride
the City van,
